B.3 PERFORMANCE WORK STATEMENT

1.0 BACKGROUND

The Asheville VAMC has 2 Hanel Rotomat automated shelving systems that require semiannual maintenance to ensure proper working order. This is considered part of the preventative maintenance for the equipment and is only performed by the manufacturer’s channel partner. When properly managed, it will prolong the life of the equipment as well to ensure reusable medical devises are properly stored.

2.0 OBJECTIVE

The objective of this contract is to procure a service contract to ensure equipment is in working properly in accordance with the manufacturer’s recommendations.

3.0 SCOPE

The scope of this contract is to provide preventative maintenance of equipment semiannually at regularly scheduled intervals and to provide emergency service on an as-needed basis. The period of performance (PoP) is Base plus four (4) option years as follows:

Base Year 10/3/2025 – 10/2/2026 Option Year 1 10/3/2026 – 10/2/2027 Option Year 2 10/3/2027 – 10/2/2228 Option Year 3 10/3/2028 – 10/2/2029 Option Year 4 10/3/2029 – 10/2/2030

3.1 This contract, is “all inclusive”. Perspective offerors should read the entire SOW to ensure a complete understanding of the contract requirements prior to submitting a quote. The Government will not reimburse contractors for expenses incurred due to the failure on the contractor’s part to consider all the requirements of the contract.

4.0 TASKS

4.1 The contractor shall provide one (1) Certified Service Technician to perform services required under the terms of this contract. Two Preventative Maintenance Services shall be performed onsite, on a semiannual basis. The Contractor shall coordinate with the Chief of Sterile Processing Service (SPS) for the specific days of the month services will be performed. The Contractor shall develop a schedule depicting when services will be performed and provide a copy to the Contracting Officer (CO) within five (5) calendar days of contract award (Deliverables 1, 4). The contractor shall bear all expenses associated with certification and recertification of contractor personnel.

4.1.1 The Contractor shall present copies of certifications of all Instrument Technicians performing under this contract to the CO within five (5) calendar days of contract award (Deliverables 2, 6).

4.1.2 The contractor shall provide a Quality Assurance Surveillance Plan (QASP) to the Contracting Officer (CO) within five (5) calendar days of contract award (Deliverable 3).

4.2 The contractor shall perform on-site preventative maintenance of the two (2) Hanel Rotomat automated shelving units to include all items listed in the check list in the QASP provided by the contractor.

4.2.1 The contractor shall perform on-site emergency maintenance of the two (2) Hanel Rotomat automated shelving units on an as-needed basis to include emergency repairs of the equipment (repairs will be done by the manufacture’s channel partner) up to but not exceeding $10,000 total for all repairs during the contract term. If repairs exceed the $10,000 allotment during the contract term, contractor will provide a quote for the overages so that the CGVAMC can procure additional funds to cover the repairs. Contractor will provide a detailed statement of any charges billed for repairs.

Charges for repairs are billed as follows:

• $250/hour for portal-to-portal travel by technician

• $250/hour for on-site labor

• $385/day for living

• Current Hanel pricing of any parts necessary for the repair of the machine

• Shipping and Handling of any parts ordered

4.2.2 A detailed report shall be prepared for each day the Contractor performs on-site service and provide copies to the CO, Facility POC, and the Chief, SPS. The report shall include at a minimum:

• What service was performed on the units

• What repairs were made on the units

• What was unrepairable

6.0 MANAGEMENT AND SUPERVISION OF CONTRACT PERSONNEL

The Contractor shall be responsible for supervising the daily services provided under this contract.

The Contractor shall provide the name and contact information for a primary and alternate person designated to manage and supervise performance under this contract to the Facility POC upon award of the contract

B.4 SPECIAL CONTRACT REQUIREMENTS

NO SMOKING

Per VHA Directive 1085 Dated 3/15/19 All VA Health Care Facilities shall be smoke free. This directive applies to all patients, visitors, contractors, volunteers, and vendors.

BACKGROUND INVESTIGATIONS

A full background check is not required for this position; however, all contract employees must bring photo identification and advance notice from the requiring service to obtain a VA Badge to work on a VA facility.

CONTRACTOR PERFORMANCE ASSESSMENT REPORTING SYSTEM (CPARS)

(a) FAR 42.1502 directs all Federal agencies to collect past performance information on contracts. The Department of Veterans Affairs has implemented use of the Contractor Performance Assessment Reporting System (CPARS) to comply with this regulation. One or more past performance evaluations will be conducted in order to record your contract performance as required by FAR 42.15

(b) The past performance evaluation process is a totally paperless process using CPARS. CPARS is a web-based system that allows for electronic processing of the performance evaluation report. Once the report is processed, it is available in the Past Performance Information Retrieval System (PPIRS) for Government use in evaluating past performance as part of a source selection action.

(c) Please furnish the Contracting Officer with the name, position title, phone number, and email address for each person designated to have access to your firm’s past performance evaluation(s) for the contract no later than 30 days after award. Each person granted access will have the ability to provide comments in the Contractor portion of the report and state whether or not the Contractor agrees with the evaluation, before returning the report to the Assessing Official. The report information must be protected as source selection sensitive information not releasable to the public.

(d) When your Contractor Representative(s) (Past Performance Points of Contact) are registered in CPARS, they will receive an automatically generated email with detailed login instructions. Further details, system requirements, and training information for CPARS are available at www.cpars.gov. The CPARS User Manual, registration for online training for Contractor Representatives may be found at this site.

(e) Within 60 days after the end of a performance period, the Contracting Officer will complete an interim or final past performance evaluation and the report will be accessible at www.cpars.gov Contractor Representatives may then provide comments in response to the evaluation or return the evaluation without comment. Comments are limited to the space provided in Block 22. Your comments should focus on objective facts in the Assessing Official’s narrative and should provide your views on the causes and ramifications of the assessed performance. In addition to the ratings and supporting narratives, blocks 1-17 should be reviewed for accuracy, as these include key fields that will be used by the Government to identify your firm in future source selection evaluations. If you elect not to provide comments, please acknowledge receipt of the evaluation by indicating, “No Comment” in Block 22, and then signing and dating Block 23 of the form. Without a statement in Block 22, you will be unable to sign and submit the evaluation back to the Government. If you do not sign and submit the CPAR within 30 days, it will automatically be returned to the Government and will be annotated: “The report was delivered/received by the contractor on (date). The contractor neither signed nor offered comment in response to this assessment.” Your response is due within 30 calendar days after receipt of the CPARS.

(f) The following guidelines apply concerning your use of the past performance evaluation:

(1) Protect the evaluation as “source selection information.” After review, transit the evaluation by completing and submitting the form through CPARS. If for some reason you are unable to view and/or submit the form through CPARS, contact the Contracting Officer for instructions.

(2) Strictly control access to the evaluation within your organization. Ensure the evaluation is never released to persons or entities outside of your control.

(3) Prohibit the use of or reference to evaluation data for advertising, promotional material, preaward surveys, responsibility determination, production readiness reviews, or other similar purposes.

(g) If you wish to discuss a past performance evaluation, you should request a meeting in writing to the Contracting Officer no later than seven days following your receipt of the evaluation. The meeting will be held in person or via telephone or other means during your 30-day review period.

(h) A copy of the completed past performance evaluation will be available in CPARS for your viewing and for Government use supporting source selection actions after it has been completed.

HOURS OF OPERATION

The services covered by this contract shall be furnished by the contractor as defined herein. The contractor shall not be required, except in case of emergency, to furnish such services on Federal Holidays or during off duty hours as described below.

Normal working hours are Monday through Friday, 8:00am-4:30pm, excluding federal holidays which are as follows:

Any other day specifically declared by the President of the United States to be a federal holiday. When one of the holidays falls on Sunday, the following Monday shall be observed as a Federal Holiday. When a holiday falls on a Saturday, the preceding Friday shall be observed as a Federal Holiday.

BILLING AND PAYMENT

Contractor shall submit invoice semi-annually in arrears via payment request in electronic form via VA’s Electronic Invoice Presentment and Payment system https://authentication.tungsten-network.com/login. The following information must be included on all submitted invoices. Invoices submitted without the following information may be rejected for payment. Invoices shall include at a minimum:

• Date of invoice

• Invoice number

• Contract number

• Obligation number

• Vendor name

• CLIN and dates of service

CONTRACT ADMINISTRATION

Notwithstanding the Contractor's responsibility for total management during the performance of this contract, the administration of the contract will require maximum coordination between the Government and the Contractor.

The Contracting Officer is the only person authorized to approve changes or modify any of the requirements of this contract. The Contractor shall communicate with the Contracting Officer on all matters pertaining to contract administration. Only the Contracting Officer is authorized to make commitments or issue changes that shall affect price, quantity, or quality of performance of this contract.

The Facility POC shall be responsible for the overall technical administration of this contract.

IN THE EVENT THE CONTRACTOR EFFECTS ANY SUCH CHANGE AT THE DIRECTION OF ANY

PERSON OTHER THAN THE CONTRACTING OFFICER WITHOUT AUTHORITY, NO ADJUSTMENT

SHALL BE MADE IN THE CONTRACT PRICE TO COVER AN INCREASE IN COSTS INCURRED AS A

RESULT THEREOF.

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days;

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically). Offeror shall complete only paragraph

(b) of this provision if the quoter has completed the annual representations and certifications electronically at https://sam.gov/content/home .

All Offerors shall be registered and current in the System for Award Management (SAM) database at time of quote submission and at time of award.

Section D – Technical/Management Approach

Offerors shall submit a quote that addresses all aspects of the Performance Work Statement (PWS).

The offeror shall identify any subcontractors proposed under this solicitation. All technical elements applicable to the utilization of subcontractors must be addressed in the technical quote and detail provided.

The technical quote should be as detailed as necessary to fully explain the proposed methods and rationale; it should reflect a clear understanding of the nature of the work being undertaken. The technical quote shall include information on how the project is to be organized, staffed, and managed.

The Technical Volume shall not exceed twenty-five (25) pages in length (minimum 12-point font and no less than ½ inch margins). Page limitation includes any drawings, charts, images, etc., and excludes section dividers, table of contents, glossary of terms, cross-referencing indices, and resumes. If more than 25 pages (not counting excluded pages) are submitted, only the first 25 pages will be considered.

Section E – Past Performance

Identify all federal, state, and local government contracts as well as any private/commercial contracts of similar scope, size, complexity that are ongoing or have been completed within the last three years. List the following information for each contract:

• Company Name and Address

• Description of Services Performed

• Name, Telephone Number and Email Address of Responsible individuals who have first-hand knowledge of performance relative to similar type of services

• Dates of Contract Performance

• Contract Type (e.g., fixed price, cost reimbursable) and total contract value

Failure to submit a complete quote may result in an unacceptable determination.

2. Amendments:

Amendments to this solicitation will be posted on SAM.gov. Potential Offerors are advised that they are responsible for obtaining and acknowledging any amendments to the solicitation. Failure to acknowledge an amendment may result in your quote being considered unacceptable.

3. AWARD BASIS

Note that FAR Part 13 procedures will be used. The Government will award a firm fixed priced contract to the responsible offeror whose quote, conforming to the requirements in this request for quote, will be most advantageous to the Government, price and other factors considered. Award will be made based upon the following factors: Technical Approach, Past Performance and Price.

The following factors shall be used to evaluate offers:

Offeror shall submit company’s detailed technical approach/methodology for completing all requirements of the Performance Work Statement (PWS). The submission shall include but not limited to:

Past Performance factors will be rated on an “Acceptable/Unacceptable/Neutral” basis.

Past performance information will be utilized to determine the quality of the contractor’s past performance as it relates to the probability of success of the required effort. The Government will evaluate customer satisfaction, responsiveness to customer needs, and past demonstration of meeting delivery schedules and the delivery of quality services. Emphasis will be on recent, relevant past performance in the previous 3 years. Recent is defined as work performed within the last three years. Relevant is defined as work similar in size and scope of the work described in the Performance Work Statement (PWS).

Past performance information is one indicator of an Offeror’s ability to perform the contract successfully. Current and relevant information, source of information, context of data, and general trends in Contractor’s performance shall be considered as it pertains to the performance of work described in this solicitation. Offerors may provide information on problems encountered on identified contracts and the Offeror’s corrective action. The Government shall consider this information as well as information obtained from any other sources when evaluating the Offeror’s past performance.

Since the Government may not necessarily interview all of the sources provided by the Offerors, it is incumbent upon the offeror to explain the relevance of the data provided. Offerors are reminded that the Government may elect to consider data obtained from other sources.

Offerors with no relevant past performance or whom information is not available, shall not be evaluated favorably or unfavorably on past performance, but may be considered less favorably than a offeror with favorable performance history.

c) Price

Reasonableness determinations will be made by determining if competition exists, by comparing proposed cost/price with established commercial prices, other contract vehicles, and/or by comparing proposed cost/price with the Independent Government Cost Estimate (IGCE). The IGCE is not releasable to the public.
