About this file
This is a Justification for Other Than Full and Open Competition document for a federal contract action by the Department of Veterans Affairs.
The VA seeks to award a firm-fixed-price indefinite delivery requirements contract for Wireless Medical Telemetry Service (WMTS) frequency coordination, registration, and allocation services to Outdoor Wireless Networks, LLC (OWN), located in Sterling, Virginia. The contract has a 60-month period of performance and a total estimated value not exceeding $900,000. The VA Office of Information and Technology requires WMTS spectrum frequencies for remote monitoring of patients' health at VA medical facilities across all 50 states, the District of Columbia, and U.S. territories. WMTS encompasses devices that measure vital signs and transport patient data via radio links to remote locations, operating under 47 CFR Part 95 Subpart H regulations.
The justification for sole-source procurement rests on statutory authority under 41 U.S.C. § 3304(a)(5). OWN is determined to be the only available source because the Federal Communications Commission designates the American Society for Healthcare Engineering of the American Hospital Association (ASHE/AHA) as the exclusive WMTS frequency coordinator, and ASHE/AHA lists only Comsearch (now operating as OWN) as its technical partner. OWN maintains the FCC-mandated database of all Federal and civilian WMTS deployments. Market research conducted in December 2025 and April 2026 confirmed no alternative sources exist. The contract cannot be set-aside for socioeconomic groups due to OWN's large business status. Fair and reasonable pricing was determined based on historical data from previous VA contracts (VA118A-15-D-0015 and 36C10A21D0003). The justification was approved by the Contracting Officer on April 15, 2026.

WMTS Frequency Coordination, Registration, Control Number VA-26-00057913 and Allocation
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity: Department of Veterans Affairs (VA)
Office of Procurement, Acquisition, and Logistics Technology Acquisition Center 23 Christopher Way Eatontown, NJ 07724
2. Description of Action: This proposed sole source action is for a firm-fixed-price indefinite delivery requirements contract for Wireless Medical Telemetry Service (WMTS) coordination, registration, and allocation, to be issued to Outdoor Wireless Networks, LLC (OWN), 21515 Ridgetop Cir., Suite 300, Sterling, VA 20166-6509 (Cage Code 11UR8).
3. Description of Supplies or Services: The proposed action is to provide frequency coordination, registration, and allocation services for WMTS to the VA. VA Office of Information and Technology (OIT) requires WMTS spectrum frequencies for remote monitoring of patients’ health at all VA medical facilities located in 50 states, the District of Columbia, and United States territories. WMTS includes devices that measure patients’ vital signs and other important health parameters, as well as the devices that transport the patient’s data, via a radio link, to a remote location. VA OIT has a need for WMTS frequency coordination, registration, and allocation services to provide medical care to our Veterans in alignment with 47 Code of Federal Regulations (CFR) Ch1 Part 95 Subpart H, Wireless Medical Telemetry Systems. The anticipated period of performance is 60 months. The total estimated price of the proposed action, inclusive of all options, is .
4. Statutory Authority: The statutory authority permitting other than full and open competition for this acquisition is 41 U.S.C. § 3304(a)(5), as implemented by Revolutionary Federal Acquisition Regulation (FAR) Overhaul (RFO) 6.103-5(b)(1), titled “Authorized or Required by Statute.”
5. Rationale Supporting Use of Authority Cited Above: OWN is the only source for WMTS frequency coordination, registration, and allocation services. The Federal Communications Commission (FCC) is charged with regulating interstate and international communications for the United States, and, thus, is responsible for promulgating the service rules for WMTS. To protect patients using medical telemetry equipment from electromagnetic interference, the FCC dedicated a portion of the radio spectrum for WMTS. CFR, Title 47, Part 95.2309, WMTS frequency coordination, states, “Operation of WMTS devices is subject to the frequency coordination procedures.” CFR, Title 47, Part 95.2309(a) states that prior to first use of a WMTS device in a health care facility, the authorized health care provider shall register the device with a designated frequency coordinator. CFR, Title 47, Part 95.2309(a) states the FCC designates one or more frequency coordinators to manage WMTS use of the frequency bands designated for the operation of WMTS devices. The FCC’s website states the FCC designates the American Society for Healthcare Engineering of the American Hospital Association (ASHE/AHA) as frequency coordinator. ASHE/AHA’s website lists Comsearch as its technical partner. In 2025, Comsearch was purchased by OWN; OWN is now doing business as (DBA) Comsearch. Therefore, OWN is now the technical partner of ASHE/AHA and responsible for providing frequency coordination, registration, and allocation services for the WMTS bands. VA OIT requires WMTS frequency coordination, registration, and allocation services in all VA medical facilities to provide medical care to Veterans, and OWN is the only provider of these services. Without WMTS frequency coordination, registration, and allocation services, there would be in increased risk to the safety of Veterans receiving healthcare services in VA hospitals.
6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. This effort did not yield any additional sources that can meet the Government’s requirements. There is no competition anticipated for this acquisition. Additionally, the solicitation will be synopsized on the System for Award Management Contract Opportunities website in accordance with FAR 5.201 and the justification will be made publicly available.
7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the FCC rules that would enable future actions to be competed.
8. Market Research: The VA technical team conducted market research in December 2025 by reviewing C.F.R. and FCC regulations. Market research confirmed that the FCC designated the ASHE/AHA as the WMTS frequency coordinator and ASHE/AHA selected Comsearch, now OWN DBA Comsearch, as its only listed technical partner to provide frequency coordination, registration, and allocation services. The technical team confirmed that OWN maintains the FCC mandated database of all Federal and civilian WMTS deployments. The technical experts concluded that OWN is the only source for the required WMTS frequency coordination, registration, and allocation services.
In April 2026, the Contract Specialist (CS) used the internet to research the FCC and ASHE/AHA websites and through directly contacting OWN. The CS reviewed C.F.R.
Title 47, Part 95, and confirmed the mandate to use ASHE/AHA for WMTS frequency coordination. In addition, the CS confirmed on the ASHE/AHA website that Comsearch, now OWN DBA Comsearch, is the only technical partner that can provide the required WMTS frequency coordination, registration, and allocation services. In addition, OWN confirmed that it was currently the only company authorized to provide WMTS coordination, registration, and allocation services ASHE/AHA. OWN also provided a copy of the company’s W9 form confirming that OWN is BDA Comsearch. A copy of the ASHE/AHA website and C.F.R. confirming Comsearch (now OWN) as the only listed source has been placed in the contract file, as well as the email and W9 from OWN.
Based on the market research, it was determined that only OWN can meet all of the Government’s requirements. OWN is a large business, and, therefore, this action cannot be set-aside for service-disabled Veteran-owned small business, Veteran-owned small business, or any other socioeconomic group.
