***INTENT TO SOLE SOURCE NOTICE-***

Estimated Date of Award: Jul 1, 2023

Synopsis:

The Department of Veterans Affairs, Atlanta VA Medical Center located at 1670 Clairmont

Road, Decatur, GA 30033 intends to award a sole source procurement for the Apex Online E-

Learning Content with Apex Innovations.

The contract will be for base year plus four renewable option years. The vendor is the owner of the intellectual property of Apex Online E-Learning Content and the only authorized distributor for this requirement. The applicable NAICS code for this procurement is 611430 –

Professional and Management Development Training, with a business size standard of

$13 million.

Furthermore, the Contracting Officer has determined that no opportunities exist for competition for either Service-Disabled Veteran Owned Small Businesses (SDVOSB) or Veteran Owned

Small Businesses (VOSB). The Contracting Officer has determined Apex Innovations is the only authorized vendor for this procurement.

Therefore, the Government intends to solicit and negotiate with only one source under the

Authority of FAR 13.106-1 which states that Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available. This is because market research efforts found that Apex

Innovations is the only vendor authorized to provide Apex Online E-Learning without voiding warranties associated with the previous procurement.

This notice of intent is not a request for competitive quotes. However, the Government will consider all quotes received no later than 1:00pm EST on May 31, 2023. A determination by the

Government not to compete with the proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.

STATEMENT OF WORK

APEX Innovations Courseware

A. General Guidance.

1. Title of Project: APEX Online E-Learning Content Program

2. Scope: The contractor will provide the Atlanta VAMC an online E-Learning Content program with unlimited access to provide online training for stroke and the care of the stroke patient from the ED to discharge. Training to provide for comprehensive levels of stroke care as well as the NIH Stroke Scale

Training and Certification. Courseware content to be updated with current with clinical practice guidelines and accountability measures. System to be able to be customized by the uploading of best practices, case studies, order sets and protocols unique to this facility.

Administrative reporting features to provide hospital administration with reports for tracking the progress of each user enrolled. ECG and Chest Pain Competency curriculum to meet each of the key annual education requirements of the Society of Cardiovascular Patient Care for Chest Pain Center accreditation, fulfill education requirements, and provide critical competencies. System must be accredited as a provider of continuing nursing education by the American Nurses Credentialing Center’s Commission on

Accreditation.

B. General Requirements:

1) Contractor employees and subcontractor employees do not requiring access to VA information and VA information systems. Sensitive data will not be accessed or provided.

C. SPECIFIC MANDATORY TASKS AND ASSOCIATED DELIVERABLES:

The Contractor shall be available for contact during normal business hours via telephone or e-mail in order to help in trouble shooting of problems with the purchased product.
