About this file

This is an Employee Rights Notice under the Davis-Bacon Act issued by the Department of Veterans Affairs, National Cemetery Administration, for laborers and mechanics employed on federal or federally assisted construction projects.

The notice informs workers of their entitlements and protections under prevailing wage requirements. Employees must receive no less than the wage rate specified in the Davis-Bacon Wage Decision posted with the solicitation for their work performed. Overtime compensation must be paid at a rate of not less than one and one-half times the basic rate of pay for all hours worked over 40 in a work week, with few exceptions. Apprentice rates apply only to apprentices properly registered under approved Federal or State apprenticeship programs. The notice details enforcement mechanisms, including contract payment withholding, liquidated damages for overtime violations, contract termination rights, and contractor debarment from future federal contracts for up to three years. Contractors who falsify certified payroll records or induce wage kickbacks face potential civil or criminal prosecution, fines, and imprisonment. For wage inquiries or complaints, workers should contact the Contracting Officer, Daniel P. Kinney (daniel.kinney@va.gov, 402-830-4683), or the U.S. Department of Labor's Wage and Hour Division (1-866-487-9243, TTY: 1-877-889-5627, www.dol.gov/whd).
