About this file
This document is a federal contract provision template (FAR 52.225-4) titled "Buy American—Free Trade Agreements—Israeli Trade Act Certificate," effective November 2023.
The provision requires offerors to certify the origin and domestic content of end products supplied under federal contracts. Offerors must certify that each end product is a domestic end product, except those qualifying as Free Trade Agreement country end products, Israeli end products, or other foreign end products. For domestic end products, offerors must identify any that contain critical components as defined in FAR 25.105. Offerors must separately list Free Trade Agreement country end products (excluding Bahraini, Moroccan, Omani, Panamanian, or Peruvian products) and Israeli end products by line item number and country of origin. Additionally, offerors must identify all other foreign end products by line item number and country of origin, and indicate whether non-iron/steel foreign products exceed 55 percent domestic content, except for commercially available off-the-shelf items. The provision directs that government evaluation of offers will follow Federal Acquisition Regulation Part 25 policies and procedures. All referenced terms—including "domestic end product," "foreign end product," "critical component," "COTS item," and "Free Trade Agreement country"—are defined in the associated "Buy American—Free Trade Agreements—Israeli Trade Act" clause included elsewhere in the solicitation.
