About this file

This file contains two key sections from a VA solicitation: safety/environmental requirements and subcontracting limitations for a Service-Disabled Veteran-Owned Small Business (SDVOSB) set-aside contract.

The safety and environmental section requires bidders to certify they have no more than three serious, or one repeat/willful OSHA or EPA violation in the past three years. Bidders must submit their Experience Modification Rate (EMR) of 1.0 or less on insurance carrier letterhead, or obtain it from NCCI or state workers' compensation bureaus for specific states. The subcontracting section outlines that VA may use support contractors to monitor compliance with SDVOSB work performance requirements, requiring contractors to allow access to business records and sign non-disclosure agreements. The support contractors must protect proprietary information in accordance with FAR requirements, and the primary contractor must cooperate fully with compliance assessments.
