STATEMENT OF WORK

Scope of Work

1.0 General Intent

1.1 The contractor must provide all personnel, equipment, tools, materials, supervision, and other items and services necessary to conduct replacement of 2-gauge THHN wire connecting

Bldg. 6 main distribution panel 208/230v power to B30 125 amp breaker located at 4951 Arroyo

RD. Livermore CA. 94550.

1.2 The contractor must perform to the standards in this contract. This project shall take no longer than 30 calendar days from the notice to proceed to complete.

1.3 This project shall be coordinated with the appointed COR to insure minimal impact to resident’s day to day activities and minimal noise. Scheduling of work shall be at the convenience of the VAPAHCS.

2.0 General Information and Requirements

2.1 The objective of this project is to provide to conduct replacement of 2-gauge THHN wire connecting Bldg. 6 main distribution panel 208/230v power to B30 125 amp breaker located at

4951 Arroyo RD. Livermore CA. 94550.

2.2 The contractor shall provide operation and maintenance instructions, and manufacturer documentation at the completion of the project. Manufacturer documentation and maintenance schedule to be provided in close out documents.

2.3 The contractor shall provide a one year full parts and labor warranty on the newly installed wire and parts in addition to the manufacturer’s warranty.

2.4 The contractor shall provide all tools, equipment, and personal protective equipment necessary to complete this project as deemed by industry standards, this SOW, all related specifications, applicable code requirements, and site policy.

2.5 The contractor shall provide daily cleanup and securing of work site, including securing tools and equipment. Disposal of all waste and debris is at the contractor’s own expense.

2.6 The contractor shall provide quality control of all work conducted and the individual appointed shall be competent and educated/experienced in the field of work this scope encompasses.

2.7 All work shall be coordinated with the COR assigned to this project and only commence once approved.

2.8 Badges: Contractor will obtain required ID badges for all employees used on project at start of each workday; Report the COR for escort to the station police service for sign in and badge issuance.

2.9 Security: The contractor and their personnel shall be subject to the same Federal laws, regulations, standards, and VA policies as VA personnel regarding information and information system security.

2.10 Schedule: Normal work hours will be 8:00am – 4:30 pm Monday-Friday excluding

Government holidays unless otherwise approved by the COR. It is the intent of the Palo Alto VA

Medical Center that the work is to be completed within 30 calendar days from the issuance of the Notice to Proceed (NTP). Any request to utility shutdowns must be requested in writing at a minimum of 21 days prior to the requested day of shutdown.

2.11 Codes and Standards: The Contractor shall follow all applicable codes and standards to this type of work including but not limited to Health Care System Memorandums (HCSM), OSHA

Guidelines, Lock-out-Tag-out, Rules of Station, NFPA, and etcetera. If any code/standard is found to be contradictory; the authority having jurisdiction (COR) shall make the final determination and work shall proceed at no additional cost to the Government.

3.0 Specific Tasks

3.1 The contractor shall provide all supervision, administrative and technical support, labor, subcontractors, tools, transportation, materials, supplies, and equipment. The contractor shall plan, schedule, and ensure effective completion of replacement of 2-gauge THHN wire

3.2 Contractor will verify that power is isolated and place LOTO (red lock) onto B30 125 amp breaker located in Building 6 at 4951 Arroyo RD. Livermore CA. 94550.

3.2 The contractor shall provide all supervision, administrative and technical support, labor, subcontractors, tools, transportation, materials, supplies and equipment. The contractor shall plan, schedule, and ensure effective completion of replacement of 2-gauge THHN wire

3.3 Contractor will carefully pull the 2-gauge THHN wire through the conduit, ensuring proper termination and grounding at both ends. Contractor will pull the wire underground using appropriate pulling techniques and equipment. If pulling existing wire and replacing it with new

2-gauge THHN wire is not feasible, the contractor will determine the safest and most aesthetically pleasing path for new underground conduit and wire.

3.4 If pulling existing wire is not feasible contactor will perform task described in sections

3.5, 3.6 and 3.7.

3.5 *Site Survey: Before digging for new underground conduits (s), the contractor will conduct a site survey of any existing underground utilities that impede the running of new conduits (s) between buildings. Avoiding any obstacles like trees, power lines, and buildings.

3.6 * Install conduit: Attach conduit to the building and any intermediate structures using appropriate brackets and clamps. *Note: Installation of conduit referenced in this section will be priced as a separate proposal or added to this agreement via a approved change order.

3.7 * Pull wire: Carefully pull the 2-gauge THHN wire through the conduit, ensuring proper termination and grounding at both ends. Contractor will pull the wire underground using appropriate pulling techniques and equipment. If pulling existing wire and replacing it with new

2-gauge THHN wire is not feasible, the contractor will determine the safest and most aesthetically pleasing path for new underground conduit and wire.

3.8 The contractor will remove (4) 2-guage THHN wire from 6-MDP and from building 30 Kristy

Box containing (3) THHN wires.

3.9 After wire pull contractor will reconnect wire to appropriate breakers and confirm no wires are grounded using a Megohmmeter.

3.10 The contractor performs point-2-point checkout and commissioning.

3.11 The contractor will remove LOTO, verify operation of breakers and perform voltage test.

INSTRUCTION TO OFFERORS

1) INTRODUCTION:

a) This requirement is being solicited utilizing the procedures outlined in FAR 12.203 – Procedures for solicitation, evaluation, and award. The Government intends to solicit to all Service-Disabled

Veteran Owned Small Business (SDVOSB) concerns. The selection will be on the basis of Price only. One firm-fixed price Construction Purchase Order/Contract will be awarded as a result of this solicitation.

b) This requirement is a 100% set-aside for SDVOSB concerns.

c) The Wage Determination General Decision Number: CA20250018 01/10/2025 is applicable for this solicitation.

An offer guarantee/bid bond is not required. Note: Performance and payment bonds or an

Irrevocable Letter of Credit (ILC) will be required by the successful offeror within ten (10) days of

Notice of Award.

d) Offeror shall be verified as SDVOSB to be eligible for an award under the Veteran Small

Business Certification (VetCert) database at: https://veterans.certify.sba.gov/ in accordance with

VAAR 819.7003 – Eligibility. A proposal will be rejected and will not be considered for an award if offeror’s SDVOSB/VOSB status cannot be verified at the time of submission of proposal and prior to award.

e) The Government intends to award without discussions the proposal offering the Best Value to the

Government. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.

f) In connection with this solicitation and any resultant Contract Award, any in-house personnel, subcontractors, and outside associates or consultants shall be limited to individuals or firms that were specifically identified in the Contractor's accepted offer / proposal. The Contractor shall obtain the Contracting Officer's written approval before making any substitution for these designated in-house personnel, subcontractors, associates, or consultants. If the Contractor proposes a substitution, it shall submit the same type of information that was submitted in the accepted offer / proposal to the Contracting Officer for evaluation and approval. The level of qualifications and experience submitted in the accepted offer / proposal or that required by the

Solicitation, whichever is greater, is the minimum standard for any substitution.

2) SUBMISSION INSTRUCTIONS/REQUIREMENTS:

a) All proposals shall be submitted in three (3) parts; Price Proposal, Limitations on Subcontracting

Certification, and EMR Submission. The three (3) parts shall include the following:

i) Price Proposal shall include completed SF1442, any amendments, and price breakdown (Encl

(5) Divisional Cost Breakout Sheet.)

ii) Limitations on Subcontracting Certification shall be completed and returned. (See pg. 45)

iii) EMR Submission shall be completed and returned. (Encl (6) EMR Rating Certification Form).

b) Offerors shall send one (1) electronic copy via (email shall be less than 10MB) of the price proposal to arrive on or before the due date/time. The subject line of the email shall read: “RFP

c) Faxed proposals are not permitted under any circumstances.

d) Offerors MUST include in the body of the email containing the proposals as follows:

e) Offerors may, at the discretion of the Government, be asked to provide information for clarification purposes regarding their proposals.

f) The offeror shall be held responsible for the validity of all information supplied in his/her proposal, including information provided by potential subcontractors. Should subsequent investigation disclose that the fact and conditions were not as stated, the proposal may be rejected and receive no further consideration.

g) All commitments made in the proposal may become a part of the resultant contract. The data submitted with each proposal should be complete and concise, but not overly elaborate.

3) INSTRUCTIONS FOR SUBMITTING REQUESTS FOR INFORMATION (RFI):

a) All Requests for Information (RFIs) regarding this RFP must be submitted in writing and received

NLT 2:00 P.M. PST on Thursday February 13, 2025, in order to allow replies to reach all prospective offerors in a timely manner. Questions/RFIs shall be sent via email to Corey R. Kline at corey.kline3@va.gov.

BASIS FOR AWARD

1) INTRODUCTION

a) The contract resulting from this solicitation will be awarded to that responsible offeror whose offer, conforming to the solicitation, is determined to be the most advantageous to the Government considering price only evaluation criteria with review of the offerors submitted technical proposal documentation.

2) EVALUATION CRITERIA

a) In accordance with Federal Acquisition Regulation (FAR) 12.203, Comparative evaluation of the price only criteria will be used to determine the proposal offering the best value to the Government.

b) Prior to an evaluation of any offer received, a recertification/verification of the Veteran Small

Business Certification (VetCert) and System for Award Management (SAM) will be completed to ensure every offeror is a certified Service-Disabled Veteran Owned Small Business (SDVOSB) and a small business under the NAICS code 238210 – Electrical Contractors and Other Wiring

Installation Contractors.

c) Definitions:

i) Size is defined as any project between $25,000.00 and $100,000.00.

ii) Complexity is defined as a project that includes several specialty trades and coordinating phases and work in several different locations on campus.

iii) Scope is defined as work or activities related, or closely related to that which is outlined in the

Statement of Work.

d) Evaluation Criteria 1 – Price:

i) Solicitation Submittal Requirements: All proposals shall include complete 1442, any amendments and a completed price breakdown sheet (Encl (5) Divisional Cost Breakout

Sheet.)

ii) Basis of Evaluation: The Government will evaluate the lowest price offer to determine if the price is fair and reasonable for the work to be performed. To be considered fair and reasonable for the work performed, the evaluators will also check for appearance of unbalanced line-item prices. If deemed necessary, the supplemental price breakdown information will be used to assist the Government in performing the price evaluation described above. Offers which are materially unbalanced as to prices for the basic requirement and the option quantities are not fair and reasonable. An Offer is unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated for other work.

2.2 52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS—

SECONDARY SITE OF THE WORK (MAY 2014)

(a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.

(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

2.3 52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO

ENSURE EQUAL EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION

(FEB 1999)

(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action

Compliance Requirements for Construction clause of this solicitation.

(b) The goals for minority and female participation, expressed in percentage terms for the

Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

Compliance Requirements for Construction," and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order

11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.

(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for

(1) Name, address, and telephone number of the subcontractor;

(2) Employer's identification number of the subcontractor;

(3) Estimated dollar amount of the subcontract;

(4) Estimated starting and completion dates of the subcontract; and

(5) Geographical area in which the subcontract is to be performed.

2.4 52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT—

CONSTRUCTION MATERIALS (MAY 2014)

(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material,"

"domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials"

(Federal Acquisition Regulation (FAR) clause 52.225-9).

(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the

Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.

(c) Evaluation of offers.

(1) The Government will evaluate an offer requesting exception to the requirements of the

Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.

(d) Alternate offers.

(1) When an offer includes foreign solicitation in paragraph (b)(2) of the clause at FAR

52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.

(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.

(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—

(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or

(ii) May be accepted if revised during negotiations.

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the

Offeror has represented that it ‘‘does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument’’ in paragraph (c)(1) in the provision at

52.204–26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v)(2)(i) of the provision at 52.212–3, Offeror Representations and Certifications–

Commercial Products and Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it ‘‘does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services’’ in paragraph (c)(2) of the provision at 52.204–26, or in paragraph (v)(2)(ii) of the provision at 52.212–3.

(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization

Act for Fiscal Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after

August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal

Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.

Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award

Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services.”

(d) Representations. The Offeror represents that—

(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(ii) For covered services—

(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or

(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded “does’’ in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:
