Note 2: Do not submit the SF-1442 or the Bid Bond during Phase-One. A cover page and acknowledgement of any issued amendments shall be used instead. No cost/pricing information shall be submitted during Phase-One of the selection process.

1.7 SELECTION PROCEDURES:

In accordance with Federal Acquisition Regulation (FAR) 36.3, this acquisition is based upon two-phase design-build selection procedures. The term “technical factors” refers to any non-price factor other than past performance. Four (4) factors will be evaluated in Phase-One and two (2) factors will be evaluated in Phase-Two. In making the best value award decision after Phase-Two, the Government will consider the all factors from both Phase-One and Phase-Two. The Government will award a firm fixed-price contract resulting from this solicitation to the offeror whose offer provides the best value to the Government.

In Phase-One, the Government intends to select a maximum of (5) most highly qualified offerors to submit proposals for Phase-Two without conducting discussions with any offeror; therefore, the initial Phase-One proposal shall conform to the solicitation requirements and shall contain the best offer. The Government intends to evaluate Phase-Two proposals and award a contract without conducting discussions; therefore, the initial Phase-Two proposal shall conform to the solicitation requirements and shall contain the best offer from a non-price and price standpoint.

The Government reserves the right to conduct discussions during Phase-One and/or Phase-Two if the Contracting Officer later determines them to be necessary. If the Contracting Officer determines discussions are necessary, the Contracting Officer may conduct discussions with offerors determined to be in the competitive range. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

IAW FAR 36.3, the contract resulting from this solicitation will be awarded to the offeror whose offer, conforming to the solicitation, is determined to be the most advantageous to the Government considering price and non-price evaluation criteria. Award may be made to other than the lowest priced offeror or other than the highest non-price rated offeror. In determining the best value to the Government, the Government need not quantify the tradeoffs that led to the best value decision.

All proposals shall be subject to evaluation by a team of Government personnel. The proposals will be evaluated in accordance with the content provided in the solicitation. The Government intends to award a firm fixed price (FFP) contract, as required by the procedures pursuant to FAR Part 15.101-1, tradeoff process, and FAR Part 6.401(b)(1), sealed bidding and competitive proposals. The tradeoff process will be IAW FAR 15.3, Sources Selection, and the contract resulting from this solicitation will be awarded to that responsible offeror, pursuant to FAR 9.104, whose offer, conforming to the solicitation, is determined to be the most advantageous to the Government considering price and non-price evaluation factors. Award may be made to other than the lowest priced offeror or other than the highest non-price rated offeror. Business judgments and tradeoffs will be used to determine the proposal offering the best value to the Government.

All offers will be evaluated individually on their own merit and in accordance with the following evaluation factors:

Phase-One Factor 1: Prime Contractor Project Experience Factor 2: Technical/Management Approach Factor 3: SDVOSB/VOSB Status Factor 4: Past Performance

Phase-Two Factor 1: Key Personnel Qualifications Factor 2: Price (This requirement has only one price factor)

Following a determination of Technical Acceptability of Factor 2 – Technical/Management Approach, a best value tradeoff process will be performed among Factor 1 – Prime Contractor Project Experience, Factor 3 – SDVOSB/VOSB Status, and Factor 4 – Past Performance. The evaluation will begin with a decision of Technical Acceptability for Factor 2. Among the offers that are rated as Technically Acceptable for Factor 2, a Phase One tradeoff evaluation will be conducted among Factors 1, 3, and 4. For the determination of Technical Acceptability, Factor 2 must be satisfied for non-price Factors 1, 3 and 4 to be evaluated. Phase-One Factors 1, 2, 3, and 4, and Phase-Two factor 1, when combined, are significantly more important than Phase-Two Factor 2 - Price.

The Government intends to award a contract without conducting discussions with offerors; however, the Government reserves the right to conduct discussions if later determined to be necessary by the Contracting Officer. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer provides the best value to the Government utilizing the Best Value Tradeoff process, pursuant to FAR 15.308, source selection decision, after determination of responsibility by the Contracting Officer.

Offeror shall include technical and qualitative descriptions of proposed methodology, deliverables, and delivery schedules. Offerors shall discuss proposed personnel or staffing assumptions with respect to this effort that shows a direct relationship between the approach and meeting the identified requirements and schedule. Offerors shall also discuss their quality control standards for accomplishing the requirements contained in the Statement of Work, Specifications and Drawings.

The high-level milestone plan of project execution shall include:

1. Sequencing and phasing of all the major work items (critical path), from Notice to Proceed to Contract Closeout, demonstrating continuity of hospital operations. Estimate Notice to Proceed date of March 15, 2022.

2. Key submittals for mobilization, such as acquisition of mobile trailer or to begin key features of work. Submittals shall include time for preparation and Government reviews/approvals.

3. Procurement times for long lead items.

Basis of Evaluation:

This evaluation factor will be evaluated on a Pass / Fail basis The Government will evaluate whether or not the overall high-level milestone plan is concise, comprehensive, reasonable and demonstrates the offeror’s thorough understanding of all aspects of the project contained in the Statement of Work, Specifications and Drawings.

Factor 3 – Past Performance:

Evaluation criteria:

An Offeror’s past performance is important in determining the firm’s ability to successfully perform the required services. The distinction between experience and past performance is that experience pertains to the types and amounts of projects previously completed by a contractor that are comparable to the types of work described under the definition of recent, relevant projects, in terms of size, scope, and complexity. Past performance pertains to both the relevance of recent efforts to the solicitation requirement and to how well a contractor has performed on those contracts. The information provided in response to this factor will be evaluated to determine the quality and usefulness as it applies to performance confidence assessment.

The Government is only interested in completed (100%) past performance experience that is recent (within the past 3 years of the proposal issue date of the RFP) and relevant (repair, alteration, installation and related demolition of existing infrastructure to an existing healthcare facility), and are similar in size ($2M or greater), scope and complexity, as it relates very closely to the requirements set forth in the Statement of Work and the degree of responsiveness to customer requirements.

If a completed Contractor Performance Assessment Report System (CPARS) evaluation is available, it shall be submitted with the proposal for each project included for P1 Factor 1 - Prime Contractor Project Experience. If there is not a completed CPARS evaluation, offeror’s should request (on behalf of) that a P1 Factor 4 - Past Performance (Questionnaire) be submitted for applicable projects included in P1 Factor 1 - Prime Contractor Project Experience.

NOTES:

1. A P1 Factor 4 - Past Performance (Questionnaire) will not be accepted directly from the offeror. The questionnaire shall be completed and signed by the construction contract administrator of the entity (Government or civilian) for which the construction was completed.

2. A P1 Factor 4 - Past Performance (Questionnaire) will not be accepted for an offeror that performed the work as a subcontractor.

Basis of Evaluation:

This evaluation factor will be evaluated on how well the offeror performed on the relevant projects submitted under P1 Factor 1 - Prime Contractor Project Experience, AND past performance on other relevant projects currently documented in known sources. In addition to the above, the Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources including sources outside of the Government. Other sources may include, but are not limited to, past performance information retrieved through the electronic means, using all CAGE/DUNS numbers of Contractors who are part of a partnership or joint venture identified in the offeror’s proposal, inquiries of owner representative(s), SAM.gov, and any other known sources not provided by the offeror.

The Government will consider the currency and relevance of the information, the source of the information, context of the data, and general trends in the Contractor’s performance. This evaluation is separate and distinct from the Contracting Officer’s responsibility determination. The assessment of the offeror’s past performance will be used as a means of evaluating the offeror’s probability to successfully meet the requirements of the solicitation. If an Offeror’s contract history is more relevant, the greater ability the VA will have to measure whether the Offeror will satisfy this requirement. Therefore, if an Offeror’s contract performance record is more recent and relevant, the higher the confidence level the VA will have in the Offeror’s ability to successfully perform the required effort.

Factor 4 – SDVOSB/VOSB STATUS Evaluation criteria:

This factor will be used to assess the Offeror’s status as a Service-Disabled Veteran-Owned Small Business (SDVOSB) or Veteran-Owned Small Business (VOSB) concern, or the Offeror’s proposed use of eligible SDVOSB/VOSB concerns as subcontractors.

General statements claiming that an Offeror will use eligible SDVOSB/VOSB subcontractors to perform work under this procurement that do not include the information required for this factor are not acceptable. Failure to submit the information required for this factor, including the Small Business Certifications and the Letter of intent, signed by both parties, may be viewed by the Government as evidence that the Offeror should receive no credit when evaluating proposals for the SDVOSB/VOSB STATUS evaluation factor.

To receive Full Credit as an SDVOSB/VOSB concerns, Offerors must:

Title 38, USC Section 4212(d), codified at 41 CFR Section 61-300, requires that federal contractors report, at least annually, the number and category of veterans who are within their workforce. Submission of the VETS-4212 reporting information can be done electronically at: http://www.dol.gov/vets/vets4212.htm. Award cannot be made unless the awardee has filed their VETS-4212 report. Therefore, all offerors are encouraged to file every year. The Contracting Officer may request a copy of the email confirmation of receipt notification, prior to awarding the project.

1.11 SYSTEM FOR AWARD MANAGEMENT (SAM):

The FAR requires that the contractor be provided an opportunity to comment on past performance evaluations prior to each report closing. To fulfill this requirement VA uses an online database, CPARS, which is maintained by the Naval Seal Logistics Center in Portsmouth, Virginia.

Each contractor whose contract award is estimated to exceed $750,000 is required to register with CPARS database at the following web address: http://www.cpars.gov/. Help in registering can be obtained by contacting Customer Support Desk @ DSN: 684-1690 or COMM: 207- 438-1690. Registration should occur no later than thirty days after contract award and must be kept current should there be any change to the contractor’s registered representative.

For contracts with a period of one year or less, the contracting officer will perform a single evaluation when the contract is complete. For contracts exceeding one year, the contracting officer will evaluate the contractor’s performance annually. Interim reports will be filed each year until the last year of the contract, when the final report will be completed. The report shall be assigned in CPARS to the contractor’s designated representative for comment. The contractor representative will have thirty days to submit any comments and re-assign the report to the VA contracting officer.

Failure to have a current registration in the CPARS database, or to re-assign the report to the VA contracting officer within those thirty days, will result in the Government’s evaluation being placed on file in the database with a statement that the contractor failed to respond.

1.13 BACKGROUND INVESTIGATIONS AND SPECIAL AGREEMENT CHECKS:

All contractor employees are subject to the same level of investigation as VA employees who have access to VA Sensitive Information. The level of background investigation commensurate with the level of access needed to perform the statement of work is: Low Risk.
