STATEMENT OF WORK

US DEPARTMENT OF AGRICULTURE (USDA)

FARM SERVICE AGENCY (FSA)

Little Rock, Arkansas

1. Introduction

The USDA, FSA requires ONE TIME Document Shredding services for the State FSA Office currently located at 700 West Capitol Ave, Little Rock, AR, 72201.

2. Background

Shredding services of a National Association for Information Destruction (NAID) certified contractor are required to eliminate a backlog of over 40 years of maintained Farm Service Agency records, now deemed disposable, from taking up significant space in the United States Federal Building in Little Rock, Arkansas.

Many of these records are sensitive in nature, due to them containing Personal Identifiable Information (PII), as well as personal financial information. There is also the possibility of encountering Health Insurance Portability and Accountability Act (HIPAA) data.

3. Scope of Work

The Contractor shall provide all supplies including labor, carts, vehicles, equipment etc., necessary to transport and destroy Personally Identifiable Information (PII) documents, at the FSA Office located at 700 West Capitol Ave, Little Rock, AR, 72201. The Contractor shall physically move all documents, from their current storage location to the government facility loading dock, and transport the documents to the contractor’s facility, where the contractor shall destroy the documents.

4. Requirements

4.1 The contractor shall provide all necessary labor, equipment, and supplies to facilitate the retrieval, transport, storage, and destruction of Personally Identifiable Information (PII) documents. This shall include:

1. Receptacles for bags or boxes of records.

2. Carts or other movement devices needed.

3. Trucks capable of loading at a loading dock, as well as the capacity to move all documents away from the facility within two working days’ time.

4. Suitable personnel to retrieve records from inside the building to loading dock, and onto truck.

5. Secure space to store documents waiting for destruction.

6. The Contractor must be able to destroy documents to a standard acceptable of HIPAA compliance and Payment Card Industry (PCI) Compliance.

4.2 The Contractor shall coordinate with the Government Technical Representative to coordinate document pick up. All arrival times must be coordinated with the on-site Government Technical Representative.

4.2.1 The Contractor shall coordinate with the On-Site POC to schedule document retrieval dates at least 14 days prior to retrieval.

4.2.2 The Contractor shall report any delays or date changes to the Government Technical Representative.

4.3 The Contractor shall provide all necessary labor, equipment, and supplies to facilitate the retrieval, transport, storage, and destruction of documents.

4.3.1 The Contractor shall verify and ensure the physical safeguarding measures for all stages of the destruction process, including, as applicable: transportation, storage, transportation to final destruction site, and storage at final destruction site while awaiting destruction.

4.3.2 The contractor shall provide a secure storage location for documents prior to destruction.

The contractor shall lock documents waiting destruction in a secure location fitting to the status of the documents being considered potential PII. Documents may be stored no longer than 48 hours prior to destruction.

4.4 The contractor shall provide completion invoice and certification of destruction no later than 5 days after all documents have been destroyed.

4.5 The contractor must securely destroy paper documents and electronic media utilizing a method that meets or exceeds HIPAA and Payment Card Industry (PCI) document destruction compliance standards.

4.6 The Contractor shall notify the government of any security incident. The term “security incident” means an event that has, or could have, resulted in unauthorized access to, loss or damage to USDA/FSA assets, or sensitive information, or an action that breaches USDA/FSA security procedures.

The contractor shall immediately notify the COR and Contracting Officer, of any known or suspected security/privacy incidents, or any unauthorized disclosure of sensitive information. To the extent known by the contractor, the contractor’s notice to USDA/FSA shall identify the information involved, the circumstances surrounding the incident (including to whom, how, when, and where the USDA/FSA information or assets were placed at risk or compromised), and any other information that the contractor considers relevant.

4.7 The Contractor shall maintain an accurate count of the total number of boxes removed during document retrieval. The Contractor is not authorized to remove and shred beyond the 930-box limit.

Only the Contracting Officer can authorize the contractor to exceed this amount via a signed contract modification. If there are additional boxes exceeding the 930-box limit designated for shredding, the Contractor shall not remove them. The Contractor shall notify the on-site Government Technical Representative who shall contact the Contracting Officer.

NOTE: The moving of documents, clean-up of any contractor-caused waste and disorganization, and records disposal are the responsibility of the Contractor. Government personnel will only be available to assist with questions and the escorting of personnel within the building. Government personnel will not assist in the removing/loading of documents.

6.0 Contractor Qualifications

6.1 The Contractor shall be a National Association for Information Destruction (NAID) certified, bonded, and insured contractor (and its subcontractors or third parties) for paper/printed media destruction who can provide sufficient reasonable safeguards to protect the records until final destruction has been completed.

7.0 Contract Type

7.1 This contract will be a Firm Fixed-Price effort.

7.0 Location and Hours of Work

7.1 Document retrieval shall take place at 700 West Capitol Ave, Little Rock, AR, 72201. Destruction of documentation will be performed at the contractor's own facility.

7.2 Pickup of documents shall be performed during normal working hours, Monday through Friday (except Federal Holidays) from 8:00 AM to 4:00 PM (Central).

Recognized Federal Holidays:

New Year's Day, Martin Luther King Jr.'s Birthday, President's Day, Memorial Day, Juneteenth Day, Independence Day, Labor Day, Columbus Day, Veteran's Day, Thanksgiving Day, Christmas Day.

8.0 Safety and Security Requirements:

8.1 The Contractor shall adhere to all CDC local, State, and federal guidelines/restrictions supporting COVID-19 requirements.

8.2 All Contractor employees shall follow all official visitor procedures and will be escorted while in USDA facilities. Building access will be limited to the work area. Contractor staff will not be allowed building access without prior consent from the Government Technical Representative listed in the resultant order.

8.3 All Contractor personnel who require access to USDA facilities shall have current federal or state issued identification to enter the facility.

8.4 The Contractor shall adhere to the Occupational Safety and Health Administration’s (OSHA) guidelines and regulations as well as any state specific rules, guidelines and/or regulations.

8.5 The Contractor shall supply their own medical first aid kit, in case of minor accidents.

8.6 All Contractor staff shall wear shirt apparel with company logo.

9.0 Government-Furnished Services/Equipment

9.1 The government will not provide any labor or equipment. The contractor is responsible for all labor and equipment needed to secure, transport, and destroy the documents.

10.0 Inspection and acceptance

10.1 Inspection will be conducted by the Government Technical Representative and will be conducted upon completion of the pickup to ensure all documents were retrieved.

10.2 Any identified material that is deemed unretrievable by the contractor should be reported to the Government Technical Representative at the time of pickup.

11.0 Period of Performance

11.1 The period of performance for this contract will be 90 days ARO.

(a) Invoices must be submitted electronically through the U.S. Department of the Treasury’s Invoice Processing Platform System (IPP). The Contractor must use the IPP website (https://www.ipp.gov) for submitting invoices. Invoices submitted by means other than IPP will not be accepted unless the Contracting Officer authorizes alternate procedures in writing.

I.1 AGAR

I.1.1 452.204-70 Modification for Contract Closeout Upon contract closeout for contracts utilizing anything other than cost reimbursement (i.e., Simplified Acquisition Procedures (SAP), non-SAP, and/or not Firm Fixed Price): if unobligated funds in the amount of $1000 or less remain on the contract, the Contracting Officer (CO) shall issue a unilateral modification for de-obligation. The contractor will receive a copy of the modification but will not be required to provide a signature. The CO shall immediately proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.

Upon contract closeout for contracts utilizing SAP: if unobligated funds of more than $1000 remain on the contract, the CO shall issue a bilateral modification for de-obligation. The contractor will receive a copy of the modification and will be required to provide a signature. (The CO may also request a “Contractor Release of Claims” be completed by the contractor, although not required for contracts and orders using SAP procedures.) If the bilateral modification and Release of Claims are not returned to the CO within 60 days, the CO shall release the modification as unilateral and proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.

Upon contract closeout for contracts utilizing anything other than cost reimbursement (i.e.,non-SAP and/or not FFP): if unobligated funds of more than $1000 remain on the contract, the CO shall issue a bilateral modification for de-obligation. (d) Comptroller General Examination of Record. (i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for

Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to—

Technical Acceptable is defined as the quote meeting the requirements detailed in M.1 through M.4 of Section M of this RFQ.

Technical Requirements:

M.1 Vendor must be a small business

M.2 Vendor must be (NAID) certified.

M.3 Vendor must be registered in SAM (BetaSAM.gov) and be able to provide their unique EUI number.

M.4 Vendor must provide their Certificate of Liability Insurance and proof of bonding.

Price Evaluation:

Lowest Price: lowest price is determined by comparing the quoted prices of all quotes received. The lowest priced quote that is determined to be technically acceptable will be considered the LPTA quote.

The government will evaluate the lowest priced quote first. If the lowest priced quote is not technically acceptable or otherwise deficient, then the government will evaluate the next lowest priced quote. This will continue until a lowest price technically acceptable quote is determined. Once a lowest priced technically acceptable quote has been identified, no further quotes will be evaluated.

4.2.1 The Contractor shall coordinate with the On-Site POC to schedule document retrieval dates at least 14 days prior to retrieval.
4.2.2 The Contractor shall report any delays or date changes to the Government Technical Representative.
4.3 The Contractor shall provide all necessary labor, equipment, and supplies to facilitate the retrieval, transport, storage, and destruction of documents.
