About this file

This is a Request for Special Procurement (S-DASOBO-00000261) submitted by the Department of Administrative Services, Procurement Services (DAS PS) on behalf of DAS and the Office of Emergency Management (OEM). The request seeks approval to extend Price Agreement No. 5776 with BOLDplanning, Inc. for the continuation of Continuity of Operations (COOP) software enterprise licensing. The COOP software is essential for emergency planning and preparedness across state and local government agencies, enabling detailed advance planning for continued operation of critical functions and public services during emergency incidents and natural disaster events. The original Price Agreement resulted from a competitive Request for Proposals (RFP No. DASPS-1110-15) issued on July 2, 2015, and has been in place since December 23, 2015, with no protests received. The requested extension period runs from October 31, 2021, to December 31, 2022, providing time to either obtain a replacement software solution from an existing source or complete a competitive solicitation.

The total estimated cost for the requested extension is $150,000, consistent with annual expenditures maintained since 2016 under the hybrid agreement structure funded through OEM's Work Order Contract. The special procurement is justified based on the detrimental impact to the state's emergency preparedness that would result from losing COOP plans within the current system without a replacement in place to transfer plan data. The State Chief Procurement Officer approved the special procurement on September 17, 2021, subject to conditions including a seven-day public notice period on OregonBuys, compliance with protest procedures, and adherence to Enterprise Information Services requirements and Department of Justice legal sufficiency review. No set-asides for disadvantaged businesses were noted, and BOLDplanning, Inc. remains the incumbent vendor under the extended agreement.

10. Request, Background, Current Need, and Proposed Contracting Procedure:

a. Request:

DAS PS, on behalf of DAS and OEM, requests approval of this Special Procurement (SP) No. S- DASOBO-00000261 to extend Price Agreement (PA) No. 5776 with BOLDplanning, Inc., until December 31, 2022, allowing time to obtain a replacement software solution either from an existing source, state price agreement or to complete a competitive solicitation.

b. Background:

Continuity of operations (COOP) planning is a basic program element of emergency management at all levels of government. In order to effectively protect people, property, and the environment during emergency incidents and natural disaster events, emergency management agencies must ensure continued operation of critical functions and public services during those events. This requires detailed advance planning to be conducted both within the agency and in cooperation with many partner entities.

Oregon law makes the Office of Emergency Management (OEM) responsible for coordinating planning, preparedness, and response activities with state and local emergency services agencies and organizations.

Further, cities and counties are required to coordinate emergency management planning activities with OEM. Additionally, state agencies are required by policy to develop, implement, test, and maintain continuity plans (Oregon Revised Statutes 401.052 and 401.305, Department of Administrative Services Policy 107-001-010). The State currently obtains COOP software through the current price agreement with BOLDplanning, Inc. This PA was the result of a competitive Request for Proposals (RFP) No.

DASPS-1110-15, issued July 2, 2015. The PA has been in place since December 23, 2015. There were no protests to the RFP or the award. Due to a restatement of the PA, the software license funded by OEM and purchased via their Work Order Contract (WOC) includes an enterprise wide level access to the basic COOP planning software and is paid for under that WOC. This is a hybrid agreement, with DAS and OEM collaborating to provide an enterprise-wide access to the software.
