About this file

This is a Questions and Answers (Q&A) document issued by the Oregon Department of Transportation (ODOT) Procurement Office regarding solicitation S-73000-00011357 for a Hydraulics Manual Chapter Rewrite project. ODOT is seeking a consultant to provide recommendations on language and methodologies for two chapters of a hydraulics manual through collaborative meetings and literature review summary documents. The consultant will deliver a literature review, table of contents, and executive summary of information needed for ODOT to draft the chapters, rather than editing or marking up draft versions directly. The proposal submission deadline is April 3, 2025, and ODOT declined to extend this date despite a requestor's inquiry for additional time to develop pricing. No pre-bid conference or site visit information is included in this Q&A document.

ODOT has indicated willingness to negotiate certain contract provisions, including Representations and Warranties, Ownership of Work Product, the Statement of Work (Exhibit A), and Compensation Provisions (Exhibit F). However, the agency will not negotiate provisions regarding Indemnity by Contractor, Limitation of Liabilities, or Compliance with Law. Subconsultant firms are not required to register in Oregon Buys, though ODOT advises they do so. The document does not provide information regarding pricing terms, set-asides, funding sources, or contract term and renewal options.

Re: S-73000-00011357: Hydraulics Manual Chapter Rewrite

Q1: As this proposal includes a price component, would ODOT consider extending the due date to 4/11/25 to allow for time to develop a proper price proposal?

Response:

Unfortunately, due to time constraints and the project schedule, ODOT is unable to extend the due date. As such, all proposals must be submitted by the original bid opening date of April 3, 2025. We appreciate your understanding and encourage you to submit your proposal by the established deadline.

Q2. It appears the consultant is not being asked to edit or markup draft versions of the two chapters. Instead, we interpret that the consultant will be providing recommendations regarding language and methodologies that should be considered by ODOT for inclusion in the two chapters. These recommendations will be provided to ODOT through collaborative meetings and literature review summary documents. Is our understanding correct?

Yes that is correct. The consultant will be responsible for providing a literature review, table of contents, and an executive summary of the information that is needed for ODOT to draft the chapters.

Q3. Are subconsultant firms required to be registered in Oregon Buys in addition to the prime consultant firm?

No, but we do advise that they do so.

Q4. Is the agency willing to negotiate the following provisions 8 Representations and Warranties, 9 Ownership of Work Product, 11 Indemnity by Contractor, 12 Limitation of Liabilities, 15 Compliance with Law, and Exhibit F, Compensation Provisions

8 Representations and Warranties- Yes 9 Ownership of Work Product - Yes 11 Indemnity by Contractor- No 12 Limitation of Liabilities- No 15 Compliance with Law- No Exhibit A Statement of Work- Yes Exhibit F, Compensation Provisions- Yes image1.png
