About this file
This is a Sole-Source Determination and Justification document prepared by the Oregon Department of Fish and Wildlife (ODFW) for the purchase of vertical incubation equipment for Wallowa Hatchery. The procurement involves the acquisition of 23 twelve-tray vertical stack incubators and 5 drip trays from Legend Brands-Marisource, the sole identified supplier capable of meeting the hatchery's specific technical requirements. The justification document, dated May 20, 2026, and approved on June 8, 2026, supports the determination to proceed with a sole-source contract rather than a competitive procurement process. The document references Oregon Revised Statute (ORS) 279B.075 and Oregon Administrative Rule (OAR) 125-247-0275 as the legal authority for this procurement method.
The estimated total contract value is $112,355.52. The sole-source determination is based on compatibility findings, as the Marisource vertical incubator system is uniquely compatible with Wallowa Hatchery's existing infrastructure and equipment currently in use at the facility. Market research, including online research and aquaculture industry publications, confirmed that no alternative manufacturers can provide the required vertical incubator system with the same design specifications and compatibility with existing trays and baskets. The document notes that many other hatcheries utilize the same Marisource system and recommend it based on proven reliability, performance, and equipment compatibility. The manufacturer provided a letter confirming they are the sole manufacturers and suppliers of this specific incubator system.
