About this file

This is a sample personal/professional services contract issued by the State of Oregon Department of Human Services (ODHS) for the provision of Behavioral Rehabilitation Services (BRS) to children ages 10 to 18 through a Qualified Residential Treatment Program (QRTP). The contract establishes the framework for service delivery to ODHS-referred children in the child welfare system, with services to be negotiated between ODHS and successful applicants based on licensing, certification, and ability to perform. The contract becomes effective upon the later of signature or a specified begin date, provided all required approvals from the Oregon Department of Justice and Department of Administrative Services are obtained. The contract term extends to a specified end date, with ODHS retaining the right to extend the contract for additional periods up to a total of five years. Services include residential behavioral rehabilitation care, one-on-one supervision services (subject to pre-authorization and 30-day renewal periods), and related placement support activities. Contractors must comply with mandatory reporting requirements for suspected abuse, participate in background checks, maintain specific insurance coverage, and allow ODHS site visits on a frequency determined by ODHS but no less than quarterly unless addressing identified concerns.

Compensation is structured on a fee-for-service basis with a maximum not-to-exceed amount determined during negotiation. Payment is calculated by multiplying the number of allotted beds by the total days in each contract year, with reimbursement at QRTP service rates as specified in Oregon Administrative Rules for each type of BRS care. One-on-one supervision services are paid at $30.00 per hour with a 5 percent increase to the overall not-to-exceed amount to account for usage and invoicing. ODHS will not reimburse travel or other expenses. The contract utilizes federal funds, with Assistance Listing numbers 93.558 and 93.778 referenced. Payments are made by Electronic Funds Transfer once correct banking information and EFT designation are provided. ODHS reserves the right to amend payment rates periodically to reflect Portland Metropolitan Consumer Price Index changes and Cost of Living Adjustments as directed by the Oregon State Legislature, or to meet current market conditions. The contract requires contractors to obtain and maintain comprehensive insurance including workers' compensation, commercial general liability ($1,000,000 per occurrence/$3,000,000 aggregate), professional liability ($1,000,000 per claim/$2,000,000 aggregate), and physical abuse and molestation coverage ($1,000,000 per occurrence/$3,000,000 aggregate), with all Certificates of Insurance due within 30 days of contract execution.
