About this file
This is a Statewide Contract Waiver Request document issued by the Pennsylvania Department of General Services, Bureau of Procurement, establishing compliance procedures for Pennsylvania Act 57 of 2023 regarding Russia and Belarus certification. The document applies to the Low-Income Tax Clinic NorthEast contract opportunity with the Pennsylvania Department of Revenue and establishes the mandatory verification process that contracting officers must complete prior to contract award. The procedure requires the contracting officer to access the Pennsylvania Treasury Department's published list of persons associated with Russia or Belarus, search for the supplier name as it appears on the bid or proposal submission, and complete an attestation confirming that the supplier does not appear on either the Act 57 Russia or Act 57 Belarus list. This attestation must be attached to the contract file as evidence of compliance.
Any supplier appearing on the Treasury-published list of individuals doing business with Russia or Belarus is automatically deemed not responsible and is ineligible to receive a contract award. The attestation form requires the attesting individual to provide their signature, the date of verification, and the name of the supplier being verified. This compliance requirement applies to all Commonwealth agency contracts and represents a mandatory responsibility determination step in the procurement process for supplies and services over $50,000.

Russia Belarus Certification
Background
Pennsylvania Act 57 of 2023 states that persons associated with Russia or Belarus may not bid on, submit a proposal for, enter into, be a party to or renew a contract with a Commonwealth agency for the provision of goods or services. Per Act 57, the Pennsylvania Treasury Department will publish a list of such persons.
To be compliant with this Act, the contracting officer will review the list published by Treasury as part of the determination of contractor responsibility prior to contract award. This process is outlined below. This completed document should be attached to the contract.
Instructions
1. Access the Pennsylvania Treasury’s Divestment Page and review both the Act 57 – Russia and Act 57 – Belarus posted lists.
2. Search for the supplier on the lists. Use the name as listed on the supplier’s proposal/bid submission.
3. Complete the attestation below and attach to the contract. Suppliers appearing on the Treasury-published list are deemed not responsible and may not be issued a contract.
Attestation
