I. Contracting Activity.

AFLCMC/HIK

490 East Moore Drive, Bldg. 892 MAFB-Gunter Annex, AL 36114

II. Nature and/or description of the action being processed.

Request the purchase of the RSMeans data for a 12 month Base Period and four 12 month Options for 1000 user licenses. The current license will expire on 20 Jul 2021. This data in the past has been purchased via NexGen IT sustainment/development contract using the ODC/TOOLS CLIN. The need for the data was determined when Air Staff purchased NexGen/TRIRIGA many years ago, they also purchased RSMeans data to work the cost estimating data within TRIRIGA. Without these data licenses, TRIRIGA will not be able to perform the required cost estimating needed for NexGen IT because the RSMeans data will not be available.

RSMeans data forms the basis for the cost estimations in NexGen/TRIRIGA.

Period of Performance Base: 20 July 2021 - 19 July 2022 OY 1: 20 July 2022 - 19 July 2023 OY 2: 20 July 2023 - 19 July 2024 OY 3: 20 July 2024 - 19 July 2025 OY 4: 20 July 2025 - 19 July 2026 The estimated total cost of this requirement is:

Funding will be from AFCEC Estimated cost per year is

On the previous acquisition, NexGen purchased the requested data for a 12 month period of performance from 21 July 2020 - 20 July 2021 through Serco Inc., which was the current contractor. The order was certified as priority DO-A1 for national defense, emergency preparedness, and energy program use under the Defense Priorities and Allocations Systems (DPAS) (15 CFR 700).

We will be using firm fixed price, sole source for the current requirement as well.

III. Description of supplies/services required to meet agency needs.

RSMeans Facilities Maintenance and Repair (FMR) data is used by construction professionals to create budgets, estimate projects, validate cost data and plan for ongoing facilities maintenance; such as maintenance and repair, preventive maintenance, general maintenance and complete details about the cost and repair frequencies of thousands of work items.

NOTE: This is 'DATA' only, not executable software.

We are requesting the purchase of 1,000 user licenses of the Preventative Maintenance data. This is a subset of the overall RSMeans Data.

IV. Statutory authority permitting other than full and open competition.

This acquisition is completed IAW FAR 13 Simplified Acquisition procedures, AFFARS 5313.502 - 10 U.S.C. 2302(b)

Implementation of Simplified Acquisition Procedures (41 U.S.C. 1901).

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

Gordian is the owner and sole reseller the RS Means Data Preventive Maintenance (PM) data set used by NexGen to compute related PM tasks and estimated costs. AF civil engineering personnel require this data to meet their mission needs. There are no other known data sets of this type. RSMeans Data has been used since the inception of NexGen and terminating the use (license) of this data would require the total removal of all PM data within the system. This is not a tool, software program, or other executable code it is only a data set that is required for NexGen to perform calculations. NexGen IT (more specifically, the TRIRIGA COTS component) must use RSMeans data to enable calculations for construction professionals to create budgets, estimate projects, validate their own cost data and plan for ongoing facilities maintenance. The data that RSMeans provide with these licenses uses current commercial rates to allow the Air Force to calculate cost and is updated quarterly. When the decision was made in 2013 to use COTS software TRIRIGA and RSMeans data to meet requirements, the government was locked into the long-term use of this data and therefore the annual licensing. A replacement is not financially viable. Gordian is the owner of the RSMeans data set and is the sole seller of this data. Gordian does not offer RSMeans through third-party resellers.

RSMeans has been the foundation for past cost calculations and will be for future cost calculations.

RSMeans 'informs' AF calculations and actions. No AF data flows back into the RSMeans data set.

Further, any data produced using RSMeans data would have to be purged from the system if the licenses are not maintained. To be clear, RSMeans produces AF data, AF data does not feed into or produce RSMeans data.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

Market Research for alternative vendors and products included Internet searches and a search of the GSA E Library. Per Air Force Manual 17-1203 para. 3.2.1, software shall be procured in the following order of precedence: AF Enterprise License Agreements (ELA), DoD/Joint Enterprise License Agreements (JELA), DoD Enterprise Software Initiative (ESI) blanket purchase agreements, General Services Administration (GSA) schedules, Other vendor-authorized sources. Market research report stated research and information was also gathered by going to the individual companies websites…. Researched the GSA, FAPIIS, and NITAAC database for current contract information to complete this Market Research. Email discussion with the AFCEC FMO, Serco, and Gordian.

These searches revealed a single potential alternative to a direct purchase from Gordian Group; an entity known as 4 Clicks Solutions LLC. Further research shows that 4 Clicks is now also owned by Gordian and is a project estimation group that does not provide data only, they provide services as project estimators and is not an alternative source for this need. In 2013, the Gordian Group acquired RSMeans and is now the sole owner and seller of RSMeans data and has since purchased 4 Clicks; making them the sole source for fulfilling this acquisition request.

A Request for Information (RFI) was posted to SAM.gov on 1 July 2021. Two responses were received.

However, one response indicated that the vendor intended to provide support services, rather than the DATA

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

Market research indicated that the proposed costs would be largely identical to the historical prices paid for these data licenses, and are consistent with the prices offered commercially and the IGCE. The prices will be determined to be reasonable utilizing the procedures at FAR 15.404-1(b)(ii), (iv), (v), and (vi).

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

Internet searches conducted, consultations with PMO subject matter experts conducted, comparisons made to other Government contracts, and contact with known source of RSMeans software and services have been made.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

None

X. List of any sources that expressed, in writing, an interest in the acquisition.

N/A

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

The Government's unique requirements for access to RSMeans data cannot currently be satisfied by any other licenses.

Gordian is the sole reseller and owner of RS Means Data. NexGen IT needs this data to calculate cost data for NexGen IT with the TRIRIGA COTS software. RSMeans data is required for the NexGen IT program to do the cost estimations for the TRIRIGA application that the government has been using since 2013. The data needs to work with the TRIRIGA software to calculate these costs construction professionals use to create budgets, estimate projects, and validate their own cost data and plan for ongoing facilities maintenance. Without this data, we will not have an accurate cost estimate for products and services.

XII. Certification by the Contracting Officer.

As evidenced by my signature above, I have determined this document to be both accurate and complete to the best of my knowledge and belief.

XIII. Certification by the technical/requirements personnel.

As evidenced by my (our) signature(s) above, I (we) certify that any supporting data contained herein, which is my (our) responsibility, is both accurate and complete.
