About this file
This is a Justification for an Exception to Fair Opportunity document prepared in January 2025 for a task order modification under a Naval contract.
The Naval Station Guantanamo Bay, Cuba, through Naval Facilities Engineering Systems Command Southeast, is seeking a 12-month extension to an existing task order with Vectrus Systems LLC (V2X) under contract N62742-24-D-3506, task order N69450-25F1270. The modification covers continued operation, maintenance, and potable water production services for a deployed Reverse Osmosis Water Production Unit (ROWPU) at the facility. The initial six-month performance period runs from 26 August 2026 through 25 February 2027 with an estimated value of $4,870,830, with an optional additional six-month extension from 26 February 2027 through 25 August 2027 valued at $4,308,927, for a total estimated value of $9,179,757. Funding is provided through One Big Beautiful Bill Act (OBBA) appropriations for Navy Operations & Maintenance during fiscal years 2025–2029.
The exception to fair opportunity is justified under 10 U.S.C. 3406(c) based on urgent need, as the agency has determined that providing fair opportunity would result in unacceptable delays. The justification emphasizes that a lapse in water supply service would create immediate catastrophic mission failure, base closure risks, and health hazards. V2X is the incumbent contractor, fully operational with active permits, capable of seamless continuation of services. A competing source would require a 60–90 day phase-in period with substantial duplicative transition, mobilization, and demobilization costs that are fiscally unreasonable. The document notes that this temporary ROWPU service requirement will be eliminated upon completion of a permanent water infrastructure solution currently under separate contract, anticipated to be fully operational by 10 September 2027. Fair and reasonable cost determination will be established using certified cost and pricing data, competitive pricing benchmarks from the existing task order, independent government estimates, and historical data. Legal review confirms the justification is legally sufficient.
