About this file

This is a Justification and Approval (J&A) document for use of other than full and open competition in federal contracting.

The Naval Facilities Engineering Systems Command (NAVFAC) Washington seeks authority to extend the period of performance for Indefinite Delivery Indefinite Quantity (IDIQ) Contract N4008021D0015, an 8(a) Regional Roofing JOC awarded to Sustainable Building Solutions, LLC on 29 July 2021. The contract provides Design-Bid-Build construction services for roofing requirements at Naval Air Station Patuxent River, Naval Support Facility Indian Head (Maryland), and Naval Support Facility Dahlgren (Virginia). The modification extends the period of performance for twelve months from 30 July 2026 through 28 January 2027, with two optional three-month extensions running through 1 June 2027. The modification does not change the total contract value. The extension is justified under 10 U.S.C. §3204(a)(2) using the Unusual and Compelling Urgency authority, as a competitive follow-on contract will not be awarded until FY27/Q1 due to an ongoing GAO bid protest. The document emphasizes that interruption of roofing services would negatively impact critical mission operations across multiple installations (Dahlgren, Indian Head, Bethesda, and Washington Navy Yard) and pose risks to life, health, safety, and National Security. The Contracting Officer has determined the anticipated costs to be fair and reasonable, and NAVFAC commits to preventing future bridge actions by ensuring competitive procurement of the follow-on contract. The J&A will be posted on SAM.GOV within 30 days after award.

NAVAL FACILITIES ENGINEERING SYSTEMS COMMAND WASHINGTON

WASHINGTON NAVY YARD DC 20374-5018

J&A No. N40080-26-J&A-010

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

The requiring activity is Naval Facilities Engineering Systems Command (NAVFAC), Washington, District of Columbia (DC).

2. Description of the Action being Approved.

This justification and approval (J&A) seek authority to award a modification to extend the period of performance for Indefinite Delivery Indefinite Quantity (IDIQ) Contract, N4008021D0015 8(a) Regional Roofing JOC for Naval Research & Development Establishment (NRDE) supported Commands at the Naval Air Station Patuxent River, Naval Support Facility Indian Head, Maryland and Naval Support Facility Dahlgreen, Virginia. This modification seeks to extend the period of performance twelve (12) months, from 30 July 2026 28 January 2027 with two three-month optional extensions 29 January 2027-1 April 2027 and 2 April 2027-1 June 2027.

This modification will not change the total contract value.

3. Description of Supplies/Services.

Contract N40080-20-D-0015 was awarded to Sustainable Building Solutions, LLC. by NAVFAC Washington on 29 July 2021. The award was made to provide Design-Bid-Build construction services that will support Patuxent River and South Potomac (Site-Indian Head & Site-Dahlgren). No other contract vehicle exists that could be used to meet the roofing service requirements. The contract included a 1-year base period and (4) 1-year Option periods. The contracts final option period expired 29 July 2026.

4. Statutory Authority Permitting Other Than Full and Open Competition.

The statutory authority permitting other than full and open competition is 10 U.S.C. §3204(a)(2), as implemented by FAR 6.302-2 Unusual and Compelling Urgency.

5. Rationale Justifying Use of Cited Statutory Authority.

The impact of not providing roofing services to these facilities will impact operations of various locations within the AOR to include Dahlgren, Indian Head, Bethesda, and the Washington Navy Yard and potentially result in mission failure. Even a short gap in services could negatively impact life, health, safety, and mission.

A competitive follow-on contract is in process but will not be awarded until FY27/Q1.

The follow-on procurement is delayed due to an ongoing GAO bid protest. The projects within the NAVFAC Washington AOR have critical executive and tactical mission requirements that must be supported. Failure to provide support to these projects in a timely fashion would result in severe impediment, or mission stoppage to these installations' operations and subsequently will result in risk to overall National Security as our shore infrastructure is the foundation for warfighter support. If this additional time is not granted, then work for existing projects and future projects will have to be procured through other means, namely standalone awards, or wait until the replacement contract is established. Competing individual projects on a standalone basis is not in the best interest of the Government. The administrative effort required to award new individual contracts is not cost effective and cannot be completed timely on individual projects, which impacts on the Governments ability to meet essential mission requirements.

The most practicable option available to complete efforts associated with mission critical projects is under the current IDIQ contract. As described throughout this J&A, procuring requirements outlined herein on a standalone basis outside of the existing IDIQ is neither practical nor achievable since it will result in financial harm and otherwise, including potentially meaningful delays of more than 12 months and substantial project cost increases.

Procuring requirements outside of this IDIQ will also expose Department of Navy (DON) installations to unnecessary risk and potentially negatively affect the DONs mission objectives within the NAVFAC Washington AOR.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

As explained herein, this IDIQ is the only vehicle that enables NAVFAC to meet these urgent and compelling requirements. This period of performance extension is required to execute modifications to existing and ongoing task orders. In accordance with FAR 6.305, the approved J&A will be posted on SAM.GOV within 30 days after award of the contract modification informing industry of the Governments intent to extend the period of performance.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A to be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

NAVFAC Washington ensured the requirements for the follow-on contract were solicited using competitive procurement and will take all reasonable measures to prevent the future use of bridge actions.
