About this file

This specification document outlines the requirements for Road Salt and Brine Generator Salt for the South Dakota Department of Transportation (SDDOT). The procurement includes two primary product categories: Road Salt (ASTM D632 Type 1, Grade 1 Sodium Chloride) for items 1-25 and Brine Generator Salt (ASTM D632 Type 1, Grade 2 Brining Salt) for items 26-27. Road salt must meet strict gradation standards, contain a minimum of 95% sodium chloride content, and include anti-caking agents such as Ferric Ferrocyanide or Sodium Ferrocyanide. Brine generator salt requires a minimum of 98% sodium chloride content and must be listed on the current Clear Roads Qualified Product List (QPL) Category 8A-B. All products must be free-flowing, free of lumps and foreign material, and comply with comprehensive testing requirements using ASTM standards. The contract covers a two-year period for the 2026-2027 winter seasons, with deliveries required Monday through Friday between 7:00 a.m. and 4:00 p.m. local time, with a minimum of 24 hours advance notice. All deliveries must be completed within 25 calendar days from the order date, with late deliveries assessed liquidated damages of $250 per undelivered load during the November 1 through April period.

Suppliers are responsible for all costs associated with contamination or environmental damage caused by their products and assume liability for extraordinary damage to storage or distribution equipment caused by product defects. Award will be made to the lowest responsive and responsible bidder, with past performance considered. Payment is contingent upon satisfactory laboratory test results, with SDDOT retaining the right to accept, reject, or adjust pricing based on test results. Liquidated damages apply for non-conforming shipments, with deductions ranging from 1% to 50% of contract price depending on the deficiency in sodium chloride content, gradation, moisture content, or condition. Two non-compliant shipments per contract year may result in contract termination. A fuel cost adjustment mechanism is included, based on the Energy Information Administration's Weekly Retail On Highway Diesel Prices for the Midwest region, with adjustments applied when fuel prices fluctuate more than 10% from the June 3, 2026 base price of $5.392 per gallon. Suppliers must provide certified test reports at the contract's beginning and certificates of compliance with each delivered load, along with detailed delivery documentation including bills of lading, safety data sheets, and certified weight tickets.

1. Deduction Schedule

a. Chemical Composition. For each 0.1 percentage point deficiency in sodium chloride content below the specified minimum, a deduction of one percent (1%) of the Contract price per ton will be applied. Material with sodium chloride content less than 85% may be rejected at the discretion of the SDDOT.

b. Gradation. For each one (1) percentage point outside the limits permitted by the specification for each sieve size, a deduction of one percent (1%) will be made from the Contract price.

c. Condition. Material delivered in a condition that requires reprocessing by SDDOT to make it usable (including but not limited to caking or lumping) will be subject to a deduction equal to the actual cost incurred by SDDOT to reprocess the material. All costs will be documented and provided to the supplier.

VII. FUEL COST ADJUSTMENTS

Compensation adjustments for the costs of motor fuels will be determined by the Purchaser in accordance with the following provisions:

For Salt Deliveries - The Purchaser will base the price change on a four- or five-week average, to the nearest hundredth of a dollar ($0.01) using the rounding procedures from the DOT Materials Manual, located on the Purchaser’s website. The Purchaser will use the “Weekly Retail On Highway Diesel Prices” for “All Types” using Midwest Prices as reported in the Energy Information Administration (EIA) of the US Department of Energy weekly publication. A 4-week average will be used for months having 4 Mondays and a 5-week average will be used for months having 5 Mondays. The amended contract price will be reviewed monthly during the last week of the month by the Operations Support Office of the SDDOT;

therefore, initiating a new contract price effective for deliveries made the following month through the Office of Procurement Management. Should fuel prices increase or decrease beyond 10% from the base price of $5.392 as determined from the EIA publication – Midwest Div. on June 3, 2026, the contract price will be amended as follows:

Calculations have shown that fuel consumption is approximately 50% of the total transportation costs for the delivered loads. Therefore, when a fuel cost adjustment is needed according to the terms of this contract, the following procedure will be used. A base price of $35.00/ton has been assumed for salt materials being delivered to the sites. The total transportation costs are then determined by subtracting the base price for salt, $35/per ton, from the Supplier’s bid price for that delivery location. Then 50% of that amount will be used for the calculated fuel cost.

Example: The bid price of salt is $75.00/ton. Then the transportation cost would be ($75.00-$35.00) or $40.00/ton. Then 50% of that amount, or $20.00/ton, would be used for the calculated fuel cost.

The percentage applied to the calculated fuel cost would be the amount over 10% to the nearest 0.1%.

Example: The current four- or five-week average fuel price, rounded to the nearest hundredth of a dollar, is $4.30/gal, and the published price on June 2nd, 2025, was $3.439/gal. The total percentage increase in fuel price is $4.300 - $3.439 = $0.861/$3.439 or 25.04%. Therefore, the amount applied to the calculated fuel cost would be 25.04% - 10% or 15.0%.

Therefore, the cost increase applied to the contract price would be 15.0% times the calculated fuel cost.

Example: $20.00 x 15.0% = $3.000/ton; therefore, use $3.000/ton increase. So, $75.00/ton plus $3.000/ton for an amended contract price of $78.000/ton.

The same calculations would hold true if the cost of fuel were to fall more than 10% below the published price.
