About this file
This is a magnesium chloride product specification document for the South Dakota Department of Transportation (SDDOT) for the 2026-2027 contract period. The specifications establish requirements for magnesium chloride deicer products that must be listed on the current Clear Roads Qualified Product List. Products must contain between 28% and 32% magnesium chloride by weight and must include a corrosion inhibitor that is fully incorporated at the manufacturing facility prior to shipment. All products are subject to inspection, sampling, and testing upon delivery, with samples collected in three equal portions during unloading. Suppliers must provide 24-hour delivery notice and complete required documentation including bills of lading, certified weight tickets, product identification with lot traceability, test data, and Safety Data Sheets. Orders will be confirmed within two business hours and deliveries must occur within seven calendar days, Monday through Friday between 7:00 a.m. and 4:00 p.m. local time, with late deliveries incurring liquidated damages of 5% per day starting on day 8. Emergency orders designated for November 1 through April 1 must be delivered within 48 hours and qualify for a 10% premium on the awarded contract unit price.
Pricing is structured with a base product price of $0.40 per gallon, with suppliers submitting bid prices for their applicable delivery locations. The contract includes a fuel cost adjustment mechanism based on weekly retail on-highway diesel prices from the U.S. Department of Energy's Energy Information Administration, with adjustments applied when diesel prices fluctuate more than 10% from the base price of $5.392 per gallon established June 3, 2026. Fuel consumption is estimated to represent 50% of total transportation costs. Split load deliveries incur a maximum drop fee of $100.00 per location following the first delivery. Non-compliant product is subject to liquidated damages ranging from 10% to 100% of product price depending on the specific deficiency, including concentration, metal content, corrosion effectiveness, settleable solids, and pH levels. Two non-compliant shipments per contract year may result in contract termination. All laboratory testing must be conducted by an independent laboratory using approved test methods, and test results are considered final. Payment is not issued until satisfactory test results are received.

VIII. FUEL COST ADJUSTMENTS
A. The Purchaser will base any diesel fuel price adjustment on a four-week or five-week average, rounded to the nearest one cent ($0.01), using the rounding procedures in the DOT Materials Manual located on the Purchaser’s website.
The Purchaser will use the Weekly Retail On-Highway Diesel Prices – All Types – Midwest as reported by the U.S. Department of Energy, Energy Information Administration (EIA). A four-week average will be used for months with four Mondays. A five-week average will be used for months with five Mondays.
The Operations Support Office of the SDDOT will review the amended contract price monthly during the last week of each month. Any revised contract price will be effective for deliveries made the following month through the Office of Procurement Management.
If diesel fuel prices increase or decrease by more than 10 percent from the base diesel price of $5.392 per gallon, as established from the EIA Midwest publication dated June 3, 2026, the contract price will be amended.
For purposes of this adjustment, fuel consumption is estimated to represent approximately 50 percent of the total transportation cost for delivered loads. The fuel cost adjustment will be calculated as follows:
1. The base product price for alternative chemical deicers and magnesium chloride is established at $0.40 per gallon.
2. Total transportation cost will be determined by subtracting $0.40 per gallon from the Supplier’s bid price for the applicable delivery location.
3. Fifty percent of the total transportation cost will be used as the calculated fuel cost component.
4. The fuel cost component will be adjusted according to the percentage increase or decrease in the EIA Midwest diesel price average when the change exceeds the 10 percent threshold.
Example: The bid price of magnesium chloride is $1.60/gal. Then the transportation cost would be ($1.60-$.40) or $1.20/gal. Then 50% of that amount or $.60/gal will be used for the calculated fuel cost.
The percentage applied to the calculated fuel cost would be the amount over 10% to the nearest 0.1%.
Example: The current four- or five-week average fuel price, rounded to the nearest hundredth of a dollar, is $4.30/gal, and the published price on June 3, 2025, was $3.439/gal. The total percentage increase in fuel price is $4.300 - $3.439 = $0.861/$3.439 or 25.04%. Therefore, the amount applied to the calculated fuel cost would be 25.04% - 10% or 15.04%.
Therefore, the cost increase applied to the contract price would be 15.04% times the calculated fuel cost.
Example: $.60 x 15.04% = $.090/gal, therefore, use $.090/gal increase. So, $1.60/gal plus $.090/gal for an amended contract price of $1.690/gal.
1. The same calculations would hold true if the cost of fuel were to fall more than 10% below the published price on June 3rd, 2025.
B. Split Loads: Any time a Purchase Order directs that a load be split between more than one delivery location, Supplier will charge no more than $100.00 as a drop fee charged to each location following the first delivery. Supplier will confirm any drop shipment fees in its order confirmation.
