However, the following: RFR provisions must appear in all Commonwealth competitive procurements conducted under 801 CMR 21.00: RFR Required Specifications; Affirmative Market Program AMP, Affirmative Market Program Subcontracting Policies, Best Value Selection and Negotiation, Bidder Communication, Comm-PASS, Contract Expansion, Costs, Debriefing, Debriefing/Appeals: Administrative Appeals to Departments, Debriefing/Appeals: Administrative Appeals to OSD Electronic Funds Transfer (EFT), Filing Requirements, Identifiable Health Information: HIPAA and Protected Health Information, Information Technology, Information Technology - Clarification of Language in Section 11, Indemnification of the Commonwealth Terms and Conditions, Northern Ireland Notice and Certification, Federal Government Services Administration (GSA) or Veteran’s Administration Supply, Pricing: Price Limitation, Public Records, Reasonable Accommodation, and Subcontracting Policies. These provisions appear in this RFR as attachment entitled RFR Required Specifications and Optional Specifications.
The following RFR provisions may appear in Commonwealth competitive procurements conducted under 801 CMR 21.00: Alternatives, Brand Name or Equal, Debriefing Optional specification for non-POS RFRs, Emergency Standby Commodities and/or Services, Environmentally Preferable Products and Services, Estimated Provisions, Prompt Payment Discounts (PPD), Use of a Procurement by a Single or Multiple Departments: Multiple Department Procurement/Limited User Contracts, and Use of a Procurement by a Single or Multiple Departments: Single Department Procurement/Multiple Department User Contracts These provisions appear in this RFR as attachment entitled RFR Required Specifications and Optional Specifications.
Prevailing Wage Requirements: The Department of Labor and Workforce Development administers M.G.L.c.149, s.26 which covers contractor wages under state contracts. When contracting with certain “licensed professionals and trade persons” departments must require contractors to pay “prevailing wage rates”.
Some covered services include, but may not be limited to: new construction, demolition, repair and maintenance, carpentry, electrical, plumbing, painting, moving, trash removal, janitorial and cleaning services, lock smiths, printing, and clothing.
Departments can obtain additional information about whether a procurement must require prevailing wages by contacting:
The terms of 801 CMR 21.00: Procurement of Commodities and Services (and 808 CMR 1.00: Compliance, Reporting and Auditing for Human and Social Services, if applicable) are incorporated by reference into this RFR. Words used in this RFR shall have the meanings defined in 801 CMR 21.00 (and 808 CMR 1.00, if applicable). Additional definitions may also be identified in this RFR. Unless otherwise specified in this RFR, all communications, responses, and documentation must be in English, all measurements must be provided in feet, inches, and pounds and all cost proposals or figures in U.S. currency. All responses must be submitted in accordance with the specific terms of this RFR. No electronic responses may be submitted in response to this RFR. If prevailing wage requirements apply to the procurement being conducted, the RFR must require bidders to submit responses based upon the payment of prevailing wages. The wage rate schedule must be included in the RFR, otherwise non-complying bidders will be able to substantially undercut complying bidders in violation of M.G.L.c.149 and the selection process will not be fair.
If for any reason a bidder submits a response that was not based upon the payment of prevailing wages, the bidder will be held to its original response and may not seek additional compensation from the department when required to verify the payment of prevailing wages.
