About this file
This document is a Request for Response (RFR) issued by the Massachusetts Division of Capital Asset Management and Maintenance (DCAMM) for Specification Writer Services. DCAMM is seeking proposals from experienced specification writer/consultants to revise and update DCAMM's existing Standard Specifications for its building construction, repair, renovation, and energy management and facilities maintenance projects. The selected contractor will also develop new model specifications for DCAMM's energy management services and facilities maintenance contracts. The RFR sets forth three main categories of specification writers/consultants for which proposals may be submitted: 1) Construction contracts, 2) Energy Management Services Contracts, and 3) Facilities Maintenance repair projects and contracts. The proposal submission deadline is April 22, 2016 at 2:00 PM DST, and the contract duration is 3 years.
Pricing for the services will be based on an hourly rate, which DCAMM asks respondents to consider offering at a government discount. DCAMM also requires participation in the Commonwealth's Prompt Payment Discount initiative. This is a small procurement targeted to verified small businesses participating in the Commonwealth's Small Business Purchasing Program, but if there is inadequate capacity, DCAMM may award the contract to non-participating vendors.

1.5 Background Information for this RFR
The DCAMM Standard Specifications, Version 7.1, (see Attachments 1A and 1B for Table of Contents) are intended for use by Designers as the basis of construction specifications for DCAMM's standard construction, renovation and repair projects on its public projects in the Commonwealth of Massachusetts. DCAMM Standard Specifications Version 7.1 is intended for construction projects only, and not for Energy or Maintenance projects. Sample of specifications are provided in Attachment 1C.
The specifications include MGL Chapter 149 filed sub-bid requirements, and language intended to assist projects in achieving USGBC LEED 2009 certification at the Silver Level.
The DCAMM Standard Specifications are organized according to CSI Masterformat 2011. Specifications use the term ‘Designer’ for the architect-of-record and their engineers, and the term ‘DCAMM Project Manager’ for the owner’s representative.
All sections require editing by an Architect or Engineer registered in the Commonwealth of Massachusetts before issue. Individual sections contain choices which must be made before issue. Each section contains ‘Notes to the Designer’ and ‘Resources’ which must be deleted before issue.
Permission to use the DCAMM Standard Specifications is granted by DCAMM only for the limited purpose of preparing construction specification documents for DCAMM projects in the Commonwealth of Massachusetts. Permission is not given to use the DCAMM Standard Specifications to create content for third parties or on other projects.
Neither DCAMM nor its consultants warrant that the DCAMM Standard Specifications are without error or that websites or servers that make this information available are free of viruses or other harmful components. No endorsement or warranty of suitability for use of any product named in the DCAMM Standard Specifications is intended. The Designer is responsible for editing each section before issue and verifying suitability of individual products and systems for project requirements.
The User of the DCAMM Standard Specifications agrees that by using the website and/or the specifications that the user has read, understood and agrees to be bound by these terms and conditions and those of the DCAMM Designer Agreements.
DCAMM at this time does not have standard specifications specifically for Energy and Facilities Management projects, however they have sample and model specs they have developed and utilized and customized on a project by project basis.

This contract is limited to use by the Division of Capital Asset Management and Maintenance.
1.7 Number of Awards
This procurement will result in a single contract with the selected Contractor. The Strategic Sourcing Team (SST) may award more or no contracts at all if it is in the best interest of the Commonwealth to do so.
1.8 Adding Consultants after Initial Contract Award
If, over the life of the Contract, the SST determines that additional Consultants should be added, these shall first be drawn from qualified companies which responded to this Solicitation but were not awarded Contracts. Alternatively, if necessary to meet the requirements of the Commonwealth, the Solicitation may be reopened to obtain additional bids.
1.9 Use of Subcontractors

No such agreements for services may be executed after the contract has expired. Any contract termination or suspension pursuant to this section shall not automatically terminate such agreements for services already in place unless DCAMM also terminates said agreements for service, which were executed pursuant to the main contract.
1.12 Contract Duration
The contract duration is for 3 years, based on DCAMM’s needs, and satisfactory performance in terms of quality, compliance with schedules, and budgetary controls.
Contract Duration Number of Options Number of Years/Months

Except as specified in any alternative billing proposal that may be accepted by DCAMM, and, except as noted below, all expenses to deliver services shall be included in the Contract hourly rate(s). DCAMM will not pay for parking or meals. Any other out-of-pocket expenses shall be paid only with DCAMM’s prior approval and only at cost without mark-up.
A Consultant may not begin services or incur any obligation in any form until a Standard Contract form with any supplements thereto has been approved by DCAMM, executed and delivered by the parties, all necessary approvals for specific work have been obtained by DCAMM, and DCAMM has given the Consultant a written Notice to Proceed with work. The Consultant must include any assigned reference numbers on all communications and payment voucher forms.
Invoices for services rendered during the previous month must be submitted to DCAMM according to the terms of the Statement of Work and approved pricing.
All invoices must be accompanied by the Commonwealth of Massachusetts Payment Voucher Input Form completed and signed by the Vendor. 5.1 Strategic Sourcing Team (SST)
https://massfinance.state.ma.us/VendorWeb/EFT_FORM.pdf http://www.mass.gov/osd
The SST appointed by the Commissioner of DCAMM will evaluate responses to this RFR and select Proposers that provide the best value to the Commonwealth based upon fulfillment of the specified RFR requirements and criteria.
The SST for this project will be composed of representatives from various departments involved in design and construction at DCAMM. The SST will review all responsive submissions that are submitted timely, and may interview and invite top Proposers to provide a demonstration of their system. The SST will then submit the results of its evaluation and identify the recommended Contractor to the Commissioner of DCAMM.
During the selection process, DCAMM reserves the right to take any or all of the following actions if it deems them to be in the interests of the Commonwealth of Massachusetts: a) reject any and all proposals; b) waive any minor informalities in proposals received or request Proposers to correct them; c) request additional information from Proposers through technical corrections or clarifications, allow modification of proposals, provide the opportunity for Proposers to submit best and final offers and negotiate with Proposers provided DCAMM determines it is not prejudicial to the interests of the Commonwealth or fair competition to do so.
The Commonwealth may award contract(s) based upon responses received without additional submissions from applicants or interviews. Accordingly, each Response shall be submitted on the most favorable terms to the Commonwealth without relying on clarifications, additional information, or interviews. However, the Commonwealth reserves the right to request additional data, or other presentations from a selected applicant in support of written Responses.
5.2 Minimum Qualifications
Proposers must have the qualifications specified in Section 3.2 above.
5.3 Evaluation Criteria
The criteria below will be used to evaluate the respective components of each Proposer’s proposal. Evaluation criteria are listed generally in order of precedence.
DCAMM will evaluate the capability and capacity of the Proposer to provide the specified services, including without limitation:
1. The quality of proposal and the thoroughness with which the Response addresses the RFR requirements, goals and needs of the Commonwealth as presented in the
RFR.
2. The quality and depth of previous experience with the scope of work described in this
RFR as evidenced by relevant project descriptions, customer references, and staff resumes. This includes the experience of the firm and the staff assigned to the project in effectively delivering the services specified in this RFR to a diverse clientele similar to DCAMM, and other state agencies that reflect a broad range of cultural, racial and educational backgrounds, and various age groups.
3. The explanation of time commitment to perform the requested services and the ability to complete the project within the time frame set forth in this RFR.
4. Pricing.
5. References.
6. Such other factors as DCAMM and SST deem relevant to the ability of the Proposer and its proposal to best meet the requirements of the agency.
A. RESPONSE TO SCOPE OF WORK
This criterion will be evaluated based on overall responsiveness to providing all responses to Exhibit E Proposer Response to Scope of Work.
B. PROPOSER QUALIFICATIONS
DCAMM will evaluate the capability and capacity of the Proposer to provide the specified services largely based on the materials submitted as evidence of expertise and experience. Due consideration will be given to client references as noted above.
C. COMPLIANCE WITH RFR REQUIREMENTS
This criterion will be evaluated based on overall responsiveness to providing all forms and requirements of the RFR including without limitation consideration of the number and type of exceptions taken to RFR requirements, if any; responsiveness to requests for information regarding legal or administrative proceedings currently pending or concluded which relate to the Contractor’s performance in providing services pursuant to any public or private contracts or agreements; and the clarity of and initiative in the preparation and presentation of the proposal submitted in response to this RFP.
Proposers are advised that no exceptions may be taken to the Commonwealth’s Terms and Conditions and Standard Contract Form. Vendors must include all appropriate documents, including a properly prepared cover sheet (see Exhibit A).
D. PRICING
The SOW for configuration, customization and implementation will be based on an all-inclusive fixed price. The flat per project hosting cost (inclusive of maintenance and support), the CD and hard copy duplication and distribution costs and the time and materials costs for any potential DCAMM requested future services outside of the scope of this RFR will be based on the rates set forth for each in the contract. Though price is one aspect of consideration in the award, DCAMM will not necessarily award the contract to the Proposer who proposes the lowest price. DCAMM may request clarification of pricing information after the proposals have been submitted in order to make fair comparisons between the proposals.
