About this file
This is a Request for Response (RFR) issued by the Massachusetts Executive Office of Technology Services and Security (EOTSS) Purchasing Department for legal services related to work authorization counsel support. The RFR seeks outside counsel with demonstrated expertise in employment-based immigration law to assess whether EOTSS can sponsor a prospective or current employee for work authorization in the United States. The scope of work includes reviewing relevant facts concerning work positions and immigration status, evaluating applicable immigration pathways such as H-1B visas, identifying employer obligations and constraints, providing a written recommendation comparing viable options with estimated timelines and costs, meeting with agency staff for consultation, and potentially assisting with application preparation if the agency decides to proceed. The contract is designated for a single contractor and will be restricted to use by the issuing entity only. The initial contract duration is eight months with services to be completed during 2026 and into FY27, with no renewal options. The deadline for submission of questions is October 21, 2026, at 3:00 PM ET, with responses posted by October 26, 2026. The bid response deadline is November 9, 2026, at 3:00 PM ET, with an estimated contract start date of December 7, 2026.
This procurement is restricted to Massachusetts Small Business Purchasing Program (SBPP) participants, who will be awarded the contract if they meet best value criteria; non-SBPP participants will only be evaluated if no SBPP bidder meets the evaluation standards. Eligible SBPP participants must have their principal place of business in Massachusetts, have been in business for at least one year, employ 50 or fewer full-time equivalent employees, and have gross revenues of $15 million or less based on a three-year average. Bidders must submit responses electronically via COMMBUYS, including a cover letter with statement of interest, firm profile with attorney biographies, and detailed pricing proposal with line-item breakdown, hourly rates, estimated hours, flat fee rate, and filing fee estimates. Evaluation criteria include specialized immigration and government experience (minimum five years), timeline alignment, transparent cost structure, active Massachusetts law license, professional liability insurance, clean bar association standing, and conflict of interest review. Submission requirements also include Professional Liability Insurance Certificate, Commonwealth Terms and Conditions acceptance, W-9 form, and Contractor Authorized Signatory Listing.
