Although a bidder may submit an alternative, a response to the RFR’s original specifications is also required.
Vendor proposals should include a comprehensive description of how they will best address the scope of services required in the RFR, or any component herein. The Committee may request written clarification of prices, a further explanation of the contents of the Pricing Proposal, or a request for clarification of any aspect of the Proposal. |
5.4.2 Prompt Payment Discounts (PPD):
All bidders responding to this procurement must agree to offer discounts through participation in the Commonwealth Prompt Payment Discount (PPD) initiative for receiving early and/or on-time payments, unless the bidder can provide compelling proof that it would be unduly burdensome. PPD benefits both contractors and the Commonwealth. Contractors benefit by increased, usable cash flow as a result of fast and efficient payments for commodities or services rendered. Participation in the Electronic Funds Transfer initiative further maximizes the benefits with payments directed to designated accounts, thus eliminating the impact of check clearance policies and traditional mail lead time or delays. The Commonwealth benefits because contractors reduce the cost of products and services through the applied discount. Payments that are processed electronically can be tracked and verified through the Comptroller’s Vendor Web system. The PPD form can be found under the Forms and Terms tab of this solicitation.
Bidders must submit agreeable terms for Prompt Payment Discount using the PPD form within their proposal, unless otherwise specified by the OCM. The OCM will review, negotiate, or reject the offering as deemed in the best interest of the Massachusetts Trial Court.
The requirement to use PPD offerings may be waived by the PMT on a case-by-case basis if participation in the program would be unduly burdensome on the bidder. If a bidder is claiming that this requirement is a hardship or unduly burdensome, the specific reason must be documented in or attached to the PPD form.
Electronic Funds Transfer (EFT): All bidders responding to this RFP must agree to participate in the Commonwealth Electronic Funds Transfer (EFT) program for receiving payments, unless the bidder can provide compelling proof that it would be unduly burdensome. EFT is a benefit to both contractors and the Commonwealth because it ensures fast, safe and reliable payment directly to contractors and saves both parties the cost of processing checks. Contractors are able to track and verify payments made electronically through the Comptroller’s Vendor Web system. A link to the EFT application can be found on the OSD Forms page (www.mass.gov/osd). Additional Information about EFT is available on the VendorWeb site (www.mass.gov/osc). Click on MASSfinance.
Mark up % or Cost plus %: If this contract requires bidders/contractors to quote for materials, supplies and any other items on a “Mark up %” or “Cost Plus %”, the contractor (when requested by the department) is required to submit, to the requesting department, a copy of their original manufacturer’s invoice (or other documentation) to prove accuracy of their mark up or cost plus total. When requested by the department, the contractor shall submit this documentation within 5 working days upon the department’s request. The referencing invoice will not be processed for payment until satisfactory documentation is received; and will not be considered late payment. Any written credits shall be immediately issued to the department along with justification or error. This requirement may also be part of the contract performance evaluation. Failure to provide this documentation may result in immediate termination of contract. In addition, if the contractor is found non-compliance (not charging the department the contract rate), it may also result in immediate termination of contract.
Option to Purchase: Upon inspection, if the Vendor determines that the equipment (time clock, shredder etc.) requires replacing rather than repairs, the Vendor will notify OCM Procurement. OCM Procurement will determine if equipment will be replaced. If OCM Procurement determines that equipment should be replaced, Procurement will obtain quotes/estimates under this agreement from the awarded Vendor(s). Estimates must be submitted based on the pricing and pricing formula outlined in this bid. NO REPLACEMENTS WILL BE PERFORMED PRIOR TO RECEIVING PRIOR APPROVAL FROM THE OFFICE OF COURT MANAGEMENT.
5.5 Best and Final Offers (BAFO) Option
As part of its evaluation process, the OCM, at its sole discretion, may elect to enter into a Best and Final Offers (BAFO) process with vendors. If the BAFO process is used, the pricing considerations and overall value of the Pricing Proposals under review may be re-evaluated based on the results received from the Best and Final Offers(s).
5.6 Employee requirements
| Successful bidders and its employees are subject to criminal background/CORI check | |
| requirements. |

i.) Name and address of the client:
ii.) Contact information for client’s representative;
