U.S. DEPARTMENT OF
HOUSING AND URBAN DEVELOPMENT
OFFICE OF INSPECTOR GENERAL
Contracting Officer’s Determination To Conduct Sole Source Acquisition Above the Micro-Purchase Threshold and Under the Simplified Acquisition Threshold
In accordance with Federal Acquisition Regulation (FAR) Section 13.106-3 and based upon the following information, I hereby determine that the acquisition pursuant to Requisition Number HUD-OMP-17-0046, will be conducted without competition for the following reasons:
☐ Urgency
☐ Exclusive Licensing Agreements
☐ Industrial Mobilization
☐ Brand Name
☒ Only One Source / Only One Responsible Offeror
Housing and Urban Development Office of Inspector General (HUD OIG) has a requirement for the provision and installation of electronic door locks, security and camera system at its 451 7th Street Location (HUD HQ), which is a GSA owned facility. Housing and Urban Development (HUD) leases the HQ location. HUD OIG occupies rooms on multiple floors, effectively as a sub-lessor from HUD.
Under the above set up, facilities work on HUD HQ must be approved by HUD, and work has been historically handled either by HUD directly or by HUD’s permitted contractors. Under the current arrangements, only Pan American Alarm has been permitted to work on door lock systems at the HUD HQ location via HUD’s established contracts. As HUD OIG’s door locks must integrate with the existent HUD System, and as HUD OIG must comply with HUD’s facilities policy, only Panhandle Alarm & Telephone is capable of meeting the requirement.
As Contract Specialist, I have conducted the necessary research and analysis and determined; as a result of that research, analysis and the foregoing circumstances; that, for this acquisition, competition is not in the best interest of the government.
