To Whom It May Concern:
Please see the response to the following question:
Question 1: Our agency is an IRS 501(c3) tax exempt non‐profit community‐based organization. Absent of our non‐profit status, we would qualify as a small business. It is our understanding that as a community based non‐profit organization and meeting the basic requirements to be classified as a small business, with the only exception that we are non‐profit, we are not required to submit a subcontracting plan. Please confirm if our interpretation is correct or not.
Answer: This interpretation is incorrect. The Small Business Act stipulates that one of the qualifications of a small business is a concern organized for profit. An IRS 501(c3) tax exempt, non‐profit, community‐ based organization cannot be a small business. In the scenario presented in Question 1, a subcontracting plan is required.
Please be informed that the FBOP will not accept questions seven (7) days before the solicitation closing date.
