Question 1 – RFQ‐CTS‐018‐18
Question: I am an individual counseling practitioner in the state of Alabama (a licensed professional counselor), and I was writing to inquire if I, as an individual, require a facility license.
Response: Alabama requires a facility license for a collective business (i.e. several therapists working together under one name as a private corporation located in a facility). It does not require a facility license if the person operates as an individual clinician in a private practice.
If an individual does not have people working under them and they will be working as a (singular) private practice, they do not need a facility license. However, the individual practitioner will need to provide the State statute where this is explained. If an individual bids on the contract as a business entity with people working under them, they will need to obtain a facility license. For example, if an individual subcontracts a medical doctor, they will not need a facility license; but if an individual "hires" a doctor under their business name, then they would need a facility license.
