1 RFQ Letter 424006 5.0 BASIS OF AWARD, Qualifiers:

1. On page 3 of 4

RFP states “Offeror shall have ten (10) years or more providing professional nuclear safety systems and regulatory compliance support to national laboratory accelerator and nuclear research programs.

The offeror shall provide reference documentation demonstrating 10 years or more of support services provided to the Department of Energy’s National Laboratory nuclear facilities. The references shall include the name of the organizations, services provided, contacts, phone numbers, and e‐mail addresses.

Please consider modifying this qualifier to be consistent with qualifiers 2 through 4 and allow inclusions of Department of Energy non‐reactor nuclear facilities.

MANNER OF SUBMISSION

Due to the request for a fixed price quote and the associated level of detail and assumptions needed to be generated, we request extension of the due date to April 21, 2023.

Agreed. Due date extended.

3 Statement of Work Scope: 5. On page 2 of 2 RRPL has been categorized as an accelerator facility for more than 10 years in accordance with DOE Order 420.2C, Safety of Accelerators. The facility has an approved Safety

Assessment Document (SAD) and a DOE‐approved Accelerator Safety Envelope (ASE). Will the

RRPL operate with an approved SAD and a DSA/TSR, or is the intent to integrate the SAD into the developed DSA?

RRPL will operate under an approved transition plan from

DOE O 420.2C to 10CFR830. Safety Basis Documents will require review and update to meet 830 and invoked standard requirements. There is no intention to retain the

SAD after the DSA/TSR is developed, so the SAD should be integrated into the DSA.

4 Statement of Work Scope: 6. On page 2 of 2 The Clinical Alpha radionuclide Producer (CARP) facility is in the pre‐conceptual design phase.

Is this project being developed as a DOE Order 413.3B/DOE‐STD‐1189 project?

Yes.

5 Statement of Work Scope: 5 and 6 . On page 2 of 2 Will a transportation safety basis (DSA) need to be developed to move radioactive material between the CARP and RRPL?

Yes.

6 Statement of Work Scope: 5 and 6 . On page 2 of 2 Please provide us with the summary of the envisioned facility operations . Can you provide a flow chart of the movement of material amoung the facilities?

The BNL isotope program utilizes the Brookhaven Linac

Isotope Producer (BLIP) irradiation facility and is working towards commisioning of the low energy cyclotron in the current FY. Targets are only irradiated at these facilities and are transported elsewhere (on BNL site) for processing.

The irradiated targets are currently transported to the

Radionuclide Research and Production Laoratory (RRPL) and once the Clinical Alpha Radionuclide Producer (CARP) comes online will be transported to CARP. The waste from these facilities will be transported to waste management.

Currently, do not envision a transportation need between the RRPL and CARP facilities.

7 Statement of Work Scope: 9. On page 2 of 2 What are the anticipated schedules for the internal readiness reviews and the level of support required by the Offeror?

Not clear we have dates for the internal readiness reviews but the transition of the RRPL is expected to be complete in roughly 2 years. The CARP is looking more like 4‐5 years.

Support is being sought to aid in the devleopment of the

DSA/TSR's as well as devleoping the cognizant engineering, program, nuclear training program and maintenance program.

8 Statement of Work Scope: 10. On page 2 of 2 Item 10 has us performing assessments of the SMPs that we just revised. This is acceptable provided these are characterized as management assessments. If the intent is independent assessments, then there is a conflict of interest since we would lack the required independence to perform the assessments (i.e., can’t independently assess work you just performed)

Concur. Accept as Management Assessments.

Are lower‐tier independent subcontractors allowed under procurement?

Yes, insofar as they comply with all requirements of the resultant contract.

This RFQ is asking for an overall Firm Fixed Price . Based on our evaluation it would be in the

BNL's and the supplier's best interest to amend the RFQ to a Time & Materials contract. This would be a cost savings. Although the SOW is detailed, there are unknowns which make it very hard to determine an overall level of effort/quantity of hours including determining the

"occasional travel" onsite quantities. Will BNL accept and/or change the RFQ to a T&M price?

Time and Materials is available however it is the least preferred. We would need to see how this definitively provides a cost savings, as T&M requires heavy oversight from the customer in evaluating hours performed to ensure the ceiling costs are not surpassed. We just anticipate a FFP but a T&M is not out of the question.

Additionally occasional travel is estimated to quarterly, if that changes, then a modification will be issued to allow for those additional costs, as with any increase in scope.

a. If not willing to change to T&M, can you please provide more details to determine number of hours for each element of the SOW?

The number of man‐hours cannot be estimated by our staff at this time as this is outside our expertise.

b. If not willing to change to T&M, can you please provide more details on the number of travel days onsite?

Number of travel days per visit is estimated at 5 business days per visit. Travel will be reimbursed at cost and will need to adhere to GSA travel costs for Government rates https://www.gsa.gov/travel/plan‐book/per‐diem‐rates

c. Can you provide a BNL travel policy and elaborate as to if expenses will be reimbursable?

See answer above. Rates are assessed based on GSA per diem rates and are only allowable to that level.
