REQUEST FOR QUOTATION
RFQ NO. RFQ0004887 – HANDHELD TACTICAL FLASHLIGHT
Date: June 8, 2020 To: Interested Vendors From: Federal Bureau of Investigation/ Finance Division Subject: Request for Quotation (RFQ) for Handheld Tactical Flashlights
Solicitation Number: RFQ0004887
The Federal Bureau of Investigation (FBI) Procurement Section is issuing this Request for Quotation (RFQ) to solicit authorized dealers of handheld tactical flashlights for the purpose of establishing a single award, firm-fixed price, Blanket Purchase Agreement (BPA) to acquire handheld tactical flashlights for the FBI’s Training Division (TD).
The BPA requires compliance with the Trade Agreements Act of 1979 (TAA) (19 U.S.C. § 2501-2581).
The Government’s intent is to establish a firm-fixed price BPA with a 60-month ordering period from the date of award.
Contractors interested in competing for this effort may participate by submitting quotes and one
(1) product sample in accordance with the procedures set forth in this RFQ.
Questions or Requests for Additional Information Are Due: July 6, 2020 1:00pm CST

RFQ NO. RFQ0004887– HANDHELD TACTICAL FLASHLIGHT
1.0 General Information
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulations (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. Interested parties are responsible for monitoring this site to ensure they have the most up to date information about this acquisition. No partial quotes will be considered. No partial awards will be made.
The North American Industrial Classification System (NAICS) code for this requirement is 335129 – Other Lighting Equipment Manufacturer; the size standard is 500 employees. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2020-04. This requirement will be awarded on an all or none basis as a commercial item under the procedures at FAR Parts 12 and 13.
This RFQ is being conducted as a total set-aside for small business concerns. Only quotes submitted by small business concerns will be accepted by the Government. Any quote that is submitted by a contractor that is not a small business concern will not be considered for award.
2.0 Description/ Specifications
2.1 Purpose/Type of Contract
The purpose of this BPA is to provide handheld tactical flashlights for the FBI’s Training Division. The Government intends to establish a firm fixed price, single award, BPA. The BPA shall have an ordering period from the effective date of the agreement through 12 months; with four (4) possible one-year options. Call Orders will be made for specific requirements by authorized Government Personnel.
2.2 Description of Supplies or Service
The offeror shall provide firm-fixed pricing for handheld tactical flashlights meeting the salient characteristics and specifications listed below:

Tail Switch activation Tail Switch Activation: Tail switch must have two settings, one allowing the light to come on while pressure is applied and to shut off when the pressure is released. The other would allow it to lock on if the button is depressed all the way and turns off with a second full depression of the button.
De-activatable De- activate: The light must be able to be completely de-activated (whether by twisting the end cap or by some other means) to prevent the light from accidentally being turned on and left on.
Modifiable shaft Modifiable Shaft: The light should have the ability to accept minor modifications along the grip or shaft in order to accommodate various techniques when being used in conjunction with firearms. Such modifications may include a sleeve with modest ridges or rings to allow a shooter to grip the light like a syringe while holding a pistol in their other hand.

Purchases shall be made in bulk and not a singular quantity. The FBI may order any quantity or combination of the items above as long as the cost of those items does not exceed the available funding.
As items become obsolete, the FBI reserves the right to replace the item(s) at any time with technically acceptable items. Any alteration/change to contractual obligations shall be issued by the Contracting Officer.
If the vendor/manufacturer offers a promotion at a price that is lower than the price established in the BPA, the FBI shall receive the lower promotional price as long as the order is placed during the promotional period.
The contractor shall extend to the Government full coverage under a normal commercial warranty. Acceptance of the warranty does not waive the Government’s rights with regard to the other terms and conditions of this contract. The warranty period shall begin upon final acceptance of all items provided to the Government by the contractor.
2.3 Extent of Obligation
The Government is not obligated to order any supplies or services under this agreement. The FBI is obligated only to the extent of authorized call orders placed against the BPA. The Government reserves the right to award contracts to other vendors for like supplies or services during the same performance period as this agreement.
2.4 Purchase Limitations
The total amount of all calls placed against this Agreement shall not exceed $4,000,000.00 for the life of the BPA.
2.5 Shipping & Delivery Requirements
All deliveries under this order shall be FOB destination.
Items shall be delivered to:

Delivery must be made within 30 days or less after Receipt of Order (ARO).
Delivery may be made to other CONUS locations. All items requested under this
Agreement shall be delivered to the address as specified by each individual call order.
Delivery of all items under this Agreement shall be accompanied by a signed delivery ticket or sales slip.
All deliveries shall be made within the time agreed upon by the vendor and the BPA caller when the call is placed.
3.0 Quotation Requirements
New products only shall be accepted for this procurement. No grey market products shall be accepted.
If vendor is not the OEM, vendor must provide evidence that they are authorized resellers of the requested equipment (i.e. certificate, authorization letter). If documentation is not included in submitted bid, quote shall be considered “unresponsive”.
Vendor must provide firm-fixed pricing for the Base Year and all option years listed in the Attachment A – Pricing Template in order to be considered.
Trade Agreement Act (TAA) compliant: The Contractor shall provide a written statement declaring assurances that the item(s) are TAA compliant. If a written statement is not included in submitted bid, quote shall be considered “unresponsive”.
Offers shall be valid for 90 calendar days from closing of posting.
Please include in your quote: pricing, product description and salient characteristics for each line item listed above. Quote may be sent via your company’s standard quotation form but must include the following information: Tax ID #, DUNS #, Point of Contact with email and telephone information.
4.0 Process Schedule
4.1 Submission of Questions
Interested offerors must submit any questions concerning the solicitation at the earliest time possible to enable the Buyer to respond. Questions may be submitted to the attention of Christina Wheeless at CMWheeless@fbi.gov, no later than Monday, July 6, 2020 at 1:00pm
CST.
4.2 Submission of Quotations
Quotations/offers and any accompanying information shall be submitted via email to the attention of Christina Wheeless, Contract Specialist, at CMWheeless@fbi.gov, no later than Friday, July 10, 2020 at 1:00pm CST. Quotations/offers sent via other means (i.e. via telephone call, facsimile transmission, etc.) will not be considered. Offers must be valid for 90 calendar days after submission.
4.3 Submission of Sample Product
All offerors are required to submit one (1) sample of the product being offered at no expense to the Government for the purpose of confirming that the product complies with the salient characteristics and specifications listed above. Bids will be rejected as nonresponsive if the sample fails to conform to each of the characteristics listed in the
RFQ.
The sample product must be received no later than Friday, July 10, 2020.

5.0 Provisions and Clauses

Corporate Representation Regarding Felony Conviction Under Any Federal Law Or Unpaid Delinquent Tax Liability – Solicitation (Deviation 2015-02)(March 2015)
a) None of the funds made available by the Department’s current Appropriations Act may be used to enter into a contract, memorandum of understanding, or cooperative agreement with a corporation—
1) Convicted of a felony criminal violation under any Federal law within the preceding 24 (twenty-four) months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this further action is not necessary to protect the interests of the Government, or
2) That has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that this further action is not necessary to protect the interests of the Government.
b) By submitting a response to this solicitation, the offeror represents that, as of the date of this offer—
1) The offeror is not a corporation convicted of a felony criminal violation under any Federal or State law within the preceding 24 (twenty-four) months; and
2) The offeror is not a corporation that has any unpaid Federal or State tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability.
Contractor Internal Confidentiality Agreements Or Statements Prohibiting Or Restricting Reporting Of Waste, Fraud, And Abuse – Solicitation (Deviation 2015-02)(March 2015)
None of the funds appropriated to the Department under its current Appropriations Act may be used to enter into a contract, grant, or cooperative agreement with any entity that requires employees or contractors of such entity seeking to report fraud, waste, and abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or contractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information. By submitting a response to this solicitation, the contractor certifies that it does not require employees or contractors of the contractor seeking to report fraud, waste, and abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or contractors from lawfully reporting waste, fraud, and abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information.
6.0 System for Award Management (SAM) Requirement
Please ensure your firm is registered in System for Award Management (SAM) - All vendors must be registered in SAM, effective July 29, 2012, to receive government contracts.
The FBI utilizes a financial system that has a direct interface with the SAM. If any current FBI vendor data conflicts with SAM Data, the information contained in SAM may override our current information. Please ensure that your company’s SAM information is updated and accurate. This includes: TIN, EFT, DUNs, addresses and contact information. The EFT banking information on file in SAM will be what the FBI uses to process payment to your organization.
7.0 Evaluation Factors
Award shall be made to the offeror whose quotation, conforming to this solicitation, is determined to be Lowest Price Technically Acceptable.
