M-1 RFQ EVALUATIONS:
1. The Government will evaluate the quote response and make a determination of award based on the evaluation of both the non-price and price factors. The evaluation will determine whether the objectives and requirements specified in the RFQ SOW were considered and can be satisfied to meet the governments requirement based on the quoter’s submission package. All non-price evaluation factors are of approximately equal importance to each other and when combined are more important than price.
Evaluations will be conducted based on a determination made for each evaluation criteria defined as follows:
B. Method for Evaluation of Non-Price Factors
The Government will evaluate the su iciency of the proposed technical approach and their likely success in accomplishing the RFQ requirements in a satisfactory manner. Specifically, the government will evaluate whether the Quoter’s proposed Technical Approach su iciently describes meeting the objectives and requirements as outlined in the SOW and whether the corresponding draft quality control plan (QCP) supports quality control measures and procedures to identify, detect and deter performance risks. The Department will evaluate the degree to which the Quoter meets or exceeds the requirements outlined in SOW of this RFQ. Quoters who demonstrate that their unique competencies could provide the DEA with additional benefit will be evaluated more favorably.
The Quoter will be evaluated on their performance under existing and prior contracts for similar services within the last three years based on information obtained from references provided by the Quoter's Past performance based on the level of confidence using Table M-1 above by assessing the strengths, weaknesses and deficiencies.
The Government will evaluate two (2) contracts or task orders, performed during the past three (3) years that are representative of the Quoter’s capability to provide services with similar scope, magnitude/size, and complexity of past performance, similar to that stated in the SOW. The
Non-Price Factor Rating Definitions (Table M1)
CONFIDENCE RATING DEFINITION
HIGH The Government has high confidence that the Quoter understands the requirement, proposes a sound approach, and will be successful in performing the contract with little or no Government intervention.
SOME The Government has some confidence that the Quoter understands the requirement, proposes a sound approach, and will be successful in performing the contract with some Government intervention.
LOW The Government has low confidence that the Quoter understands the requirement, proposes a sound approach, or will be successful in performing the contract even with Government intervention.
Government will supplement the information provided by the Quoter with information the Government obtains through reference checks, contacting the point of contact of the reference checks, its own knowledge/experience, and/or from other sources. These sources may include, but are not necessarily limited to, other Government contracting o ices, the Contractor Performance Assessment Reporting System (CPARS), and the Past Performance Information Retrieval System
(PPIRS).
C. Price Quote Evaluation
The Quoter’s price quotation will be reviewed to determine price fair and reasonableness. A determination will be made as to whether the price quotes submitted by Quoters are complete in all aspects and whether amounts submitted are calculated accurately. The quotation will also be reviewed for consistency to ensure that all performance, scope, and assumptions proposed in other sections of the proposal are captured in the price proposal section.
D. Basis of Award
The basis of award utilized the best value trade-off approach. All Non- Price evaluation factors when combined are significantly more important than cost. In the event quotes are evaluated as technically equal in quality, price will become a major consideration in selecting the successful quoter. The Government may or may not award to the lowest priced Quoter and/or the highest technically rated offer. An award will be made to the Quoter whom proposes the best value to the government.
The government intends to award a firm fixed Price, single award Blanket Purchase Agreement (BPA) under FAR Part 8 or FAR Part 13. The Government may reject any quote that is evaluated to be unrealistic in terms of program commitments, including contract terms and conditions, or unrealistically high or low cost/price, unbalanced quotes, such that the quote is deemed to reflect an inherent lack of competence or failure to comprehend the technical requirements.
E. Discussions:
The Government reserves the right to hold discussions and will make an award without discussions based on initial o er received. Therefore, all submitted Quotations should be best and final. The government’s objective is to obtain the highest technical quality proposal at reasonable price.
F. Assumptions, Deviations, and Exceptions (ADEs):
By submission of its o er/quote, the Contractor accepts all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. The Contractor shall state all assumptions, deviations, and exceptions (ADEs) taken to the terms and conditions of the RFQ. ADEs to the terms and conditions taken shall contain su icient justification to permit evaluation. Posing ADEs will not automatically cause a Contractor to be deemed unacceptable.
G. Brief Explanations: Post award notices will be issued in accordance with FAR Part 15.503(b).

This summary applies to the purchase of new iSTAR G2 Series Panels and replacement of old iSTAR Pro Panels to enhance access control.
General requirements, specifications and system components.
C-1 INTRODUCTION
1.1 Description
The Drug Enforcement Administration (DEA), Office of Security Programs, Physical Security Section (ISP), System Security Unit (ISPA) has a responsibility to provide physical security solutions for DEA facilities domestically and in United States (U.S.) Territories using an integration of people, procedures, and equipment to protect personnel, assets and facilities against theft, sabotage, or other malevolent human attacks. As such, ISPA must research, recommend and maintain mission essential physical security work functions which include hardware and software installation and maintenance, for several security mitigations; specifically, the access control systems (ACS). ISPA must ensure all safety measures currently in place and those required in the future are maintained and/or repaired or replaced expeditiously, seamlessly and in accordance with national policies.
1.2 Scope
DEA requires a blanket purchase agreement (BPA) to replace the end of line iSTAR Pro panels and install the iSTAR Ultra G2 panels in all of the DEA offices that currently have the iSTAR Pro panels installed. It is a necessity to execute the modernization of these panels due to the iSTAR Pro panel being end of line. The iSTAR Pro panels support the ACS side of the Castle System. The Castle System consists of two application, C-Cure 9000 for ACS and Milestone XProtect Corporate for VSS. The iSTAR G2 Series panels will enhance the ACS capabilities by increasing the number of card readers at a location, thus providing better control of entry to areas containing secure documentation, weapons, evidence, detention cells, and provide safer work environment for the staff occupying that facility.
o The iSTAR Ultra G2 is a powerful, cyber-hardened and network door controller that supports up to 32 readers. It uses a Trusted Execution Environment (TEE) with advanced network security features, and answers the most demanding access control requirements of government applications. Rack mount and wall-mount options provide installation flexibility, while iSTAR Ultra G2’s unique lock power management eliminates the need for separate lock power interface boards. iSTAR Ultra G2 features a hardened Linux kernel for its operating system, improving the security and scalability of the system.
o The iSTAR Ultra G2 combines support for traditional hard-wired access control doors with support for wireless lock sets, all in the same controller. Up to 32 readers are supported by the iSTAR Ultra G2, which can be comprised of readers from Access Control Modules (ACMs), IP-ACM Ethernet door modules, and/or wireless locksets. iSTAR Ultra G2 is ideal for areas that require many readers in close proximity to the panel. For more distributed installations, iSTAR Ultra G2 includes up to 32 RS-485 ports, allowing the installer to run longer distances to each door.
o The iSTAR Ultra G2 panel is the most current panel in distribution and will allow DEA to

DOJ-06 NATIONAL SECURITY RISK ASSESSMENT (APR 2014)
(a) Any offeror responding to this solicitation acknowledges that before acquiring information technology equipment or software, the U.S. Department of Justice and its component entities will assess the supply chain risk of cyber-espionage or sabotage associated with the acquisition of such equipment or software, including any risk associated with such equipment or software being produced, manufactured, or assembled by one or more entities identified as posing a cyber-threat, including but not limited to, those that may be owned, directed, or subsidized by the People’s Republic of China.
(b) By submitting an offer to this solicitation, the Offeror understands and agrees that the Government retains the right to reject any offer or response to this solicitation made by the Offeror, without any further recourse by, or explanation to, the Offeror, if the Government determines the Offeror or the equipment or software offered by the Offeror, in whole or in part, presents an unacceptable risk to national security.

JAR 2852.233-70 PROTESTS FILED DIRECTLY WITH THE DEPARTMENT OF JUSTICE (NOV 2020)
(a) The following definitions apply in this provision:
(1) ‘‘Agency Protest Official’’ (APO) means the Deciding Official for a procurement protest filed with a contracting activity of DOJ when the contracting officer will not be the Deciding Official because of the protestor’s election under JAR 2833.103(b).
(2) ‘‘Deciding Official’’ means the official who will review and decide a procurement protest filed with the agency. The Deciding Official will be the contracting officer unless the protestor requests pursuant to JAR 2833.103(b) that the protest be decided by an individual above the level of the contracting officer, in which case the HCA will designate an APO to serve as the Deciding Official.
(3) ‘‘Interested Party’’ means an actual or prospective offeror whose direct economic interest would be affected by the award of a contract or by the failure to award a contract.
(b) Only interested parties may file a protest.
(c) An interested party filing a protest with the DOJ has the choice of requesting either that the Contracting Officer or the APO decide the protest.
(d) A protest filed directly with the DOJ shall:
(1) Indicate that it is a protest to DOJ.
(2) Be filed with the Contracting Officer.
(3) State whether the protestor chooses to have the Contracting Officer or the Agency Protest Official decide the protest. If the protestor is silent on this matter, the Contracting Officer will decide the protest.
(4) Indicate whether the protestor prefers to make an oral or written presentation of arguments in support of the protest to the deciding official.
(5) Include the information required by FAR 33.103(d)(2):
(i) Name, address, facsimile number and telephone number of the protestor.
(ii) Solicitation or contract number.
(iii) Detailed statement of the legal and factual grounds for the protest, to include a description of resulting prejudice to the protestor.
(iv) Copies of relevant documents.
(v) Request for a ruling by the agency.
(vi) Statement as to the form of relief requested.
(vii) All information establishing that the protestor is an interested party for the purpose of filing a protest.
(viii) All information establishing the timeliness of the protest.
(e) The decision by the APO is an alternative to a decision by the Contracting Officer. The APO will not consider appeals from the Contracting Officer’s decision on an agency protest and a decision by the APO is final and not appealable.
(f) The Deciding Official may conduct a scheduling conference. The scheduling conference, if conducted, will establish deadlines for oral or written arguments in support of the agency protest and for agency officials to present information in response to the protest issues. The deciding official may hear oral arguments in support of the agency protest at the same time as the scheduling conference, depending on availability of the necessary parties.
(g) Oral conferences may take place either by telephone or in person.
(h) The protestor has only one opportunity to support or explain the substance of its protest. DOJ procedures do not provide for any discovery. The deciding official may request additional information from the agency or the protestor. The deciding official will resolve the protest through informal presentations or meetings to the maximum extent practicable.
MAR 2024 Page 2 of 27
(i) A protestor may represent itself or be represented by legal counsel. The DOJ will not reimburse the protester for any legal fees related to the agency protest.
(j) The DOJ will stay award or suspend contract performance in accordance with FAR 33.103(f), unless the contract award is justified, in writing, for urgent and compelling reasons or is determined, in writing, to be in the best interest of the Government. The justification or determination shall be approved at a level above the Contracting Officer. The stay or suspension, unless over-ridden, remains in effect until the protest is decided, dismissed, or withdrawn.
(k) The deciding official will make a best effort to issue a decision on the protest within thirty-five (35) days after the filing date. The decision shall be written, and provided to the protestor using a method that provides for evidence of receipt.
(l) The DOJ may dismiss or stay proceedings on an agency protest if a protest on the same or similar basis is filed with a forum outside DOJ.
