PERFORMANCE WORK STATEMENT
PERFORMANCE WORK STATEMENT (PWS)
(CERTIFIED MARINE CHEMIST PROFESSIONAL SERVICES)
1.0 BACKGROUND: Norfolk Naval Shipyard (NNSY), a naval industrial facility located in Portsmouth Virginia, maintains, overhauls, and repairs various vessels for the US Navy. NNSY is seeking a contract for Certified Marine Chemist services as a back-up for the in-house Gas Free Engineer (GFE).
2.0 OBJECTIVE/SCOPE: NNSY seeks services from a Contractor to provide Certified Marine Chemist services for approximately 40 jobs throughout the year for all ships and submarines undergoing maintenance work. The services shall include performing an inspection of confined spaces or piping for the purpose of certifying the area is safe to perform subsequent work operations. Services would be sought on an as-needed basis, and payment provided on a per-job and hourly basis when applicable for standby time or overtime. Acceptance of contract does not guarantee that services for 40 jobs will be necessary.
3.0 REFERENCE:

4.0 PERFORMANCE REQUIREMENTS: Services shall be performed in strict compliance with references (a) and (b). The Contractor shall provide all material, equipment and tools needed to perform the Marine Chemist/Gas Free services. The Contractor shall perform inspections for the purpose of Marine Chemist certification or re-certification (whenever conditions change that affect the initial certification) for the following:
(a) Entry into confined or poorly ventilated enclosed spaces that contain toxic materials above or equal to the OSHA limits;
(b) Hot work within, on, or immediately adjacent (through heat transfer or spark/hot slag contact) to spaces or items that contain or have last contained combustible or flammable liquids or gases;
(c) Hot work on pipelines, heating coils, pump fittings, or other accessories connected to spaces that contain or have last contained fuel.
(d) Services would include provision for Marine Chemist Certificate. This would include site visit to the vessel plus one space.
(e) Services could include additional certificates / additional spaces within the same visit.
(f) Services could include toxicity testing
(g) Services could include pipeline setup/certification.
4.1 Certification/Inspection Report: If the inspection is satisfactory, contractor shall post the certification of the confined or poorly ventilated enclosed space being inspected on the outside of the space (before leaving the worksite) and provide a copy to one of the designated Technical Point of Contacts (TPOCs). If the contractor identifies issues that prevent certifying the space, the contractor shall inform the TPOC of all deficiencies so corrections can be made to complete the inspection. Re-inspection after correction of deficiencies will be considered to be charged as another service.
4.2 Definitions and Conditions:
4.2.1 Confined or poorly ventilated enclosed spaces – this includes but is not limited to the following areas: fuel oil tanks; ballast tanks; auxiliary tanks, sanitary tanks, crawl spaces;
voids; etc. found on naval vessels, submarines, and surface craft.
4.3 Location of Services: Work will be conducted onboard naval vessels, submarines and surface craft, at the Norfolk Naval Shipyard (NNSY) in Portsmouth, Virginia.
4.3.1 Work may require entry into areas under increased security controls. Appropriate security credentials as specified in the contract may be required for entry to shipyard areas as well as onboard naval vessels, submarines and surface craft.
4.3.2 Work may require entry into radiation areas. In the unlikely event that inspection requires entry into a radiation area, radiation dosimetry will be provided. Instructions will be provided on proper dosimetry use prior to entry into the radiation area. Dosimetry will be turned in to the shipyard upon completion of the job. A report of radiation exposure accumulated during the job will be available upon request.
4.4 Estimated Work Hours: NNSY regular work hours are 0720 - 1550 hours, Monday through Friday.
Anything outside of these working hours would be considered overtime, and subject to overtime rates.
The hourly overtime rate would be added to the standard inspection/job rate outside of the regular work hours (0720-1550, M-F). Request for services may rarely include Saturday or Sunday work, or backshift hours, which would also be subject to overtime rates. Additionally, while usually not an issue, there could be standby time that is incurred if a jobsite is not deemed ready for certification.
4.4.1 Typically, only one job is scheduled per day. As such, the actual inspection duration will vary depending on the scope and complexity of the work. For example, a job to repair a tank may require inspection of the tank as well as adjacent tanks.
4.4.2 Start time for the service may not coincide with the 0720-start time for a regular workday. Start time for the service may include time spent preparing for gaining access to an area (e.g., security or dosimetry briefings, etc.), as well as a pre-job brief by those involved (e.g., engineering briefing the scope of upcoming hot work, status of adjacent spaces, etc.).
4.4.3 Completion of the service will depend on the scope and complexity of the job and may not coincide with the 1550-end time for a regular day. If a job requires more time to complete than the typical workday has allowed, then the TPOC will decide if the vendor should stay and receive overtime pay.
4.4.4 If more than an 8-hour day or if the end of the daytime has elapsed is needed to complete the job, the job can be completed the next day at the discretion of the Contractor with agreement from the TPOC. The initial visit on this following day would be considered a new job.
4.4.5 Standby and Overtime. This would be at the discretion of the Project/Vessel POC or the TPOC whether standby time is accrued or call back at later date/time is enacted. Standby time would be applicable for any barrier related to an inspection that is not the fault of the contractor. Overtime would include any hours worked after the standard workday M-F (0720-1550). Overtime must be requested and approved by the Project/Vessel POC or the TPOC.
4.5 Scheduled Visits: The contractor shall usually be given forty-eight (48) hours advanced notice prior to a service visit. If available, the contractor may schedule the visit in any lesser amount of time with the TPOC. For situations where the contractor is unavailable within the 48-hour window, the scheduled visit will be coordinated with the TPOC. The Technical Points of Contact (TPOCs) designated by this PWS shall authorize a scheduled service visit. Other designated Safety and Health Division personnel may facilitate communication and coordination of effort with the contractor. A list of designated Safety and Health Division personnel may be provided upon request.
4.5.1 While not anticipated, there may be unplanned or urgent/emergency requests, including a re-inspection of a confined or poorly ventilated enclosed space, due to changed conditions. The contractor shall provide an emergency contact number so that the Government may contact the Contractor in such situations. The Contractor may provide the number of an answering machine or mobile phone to receive such calls. The expectation of this award would be for the contractor to communicate with the TPOC or project representative concerning the contractor’s availability to provide the inspection.
4.5.2 After being contacted, the Contractor may request rescheduling of the job if it conflicts with other previously made commitments. In these cases, the TPOC shall be informed and decide on the request to reschedule and if necessary, obtaining other means to get the service.
5.0 SERVICE DELIVERY SUMMARY – TABLE A

6.0 NNSY RESPONSIBILITIES:
6.1. Provide all required Submarine Orientation / Training to all personnel who will be conducting work onboard a submarine at NNSY, or information needed for entry onboard surface craft.
6.1.1. Deck plate spot checks for comprehension may be conducted by the government.
6.1.2. The government may require Contractor personnel to carry proof of training in the form of a card, sticker on security badge, or other readily recognizable form.
6.2. Security clearances and access for all contractor personnel will be managed by the Project Engineering &
Planning Manager (PEPM).
6.3. Code 246 shall coordinate isolations as required to allow Contractor to perform marine chemist/gas free services.
6.4. Provide all required Submarine Orientation / Training to all personnel who will be conducting work onboard a submarine at NNSY.
6.5. Provide hot work and fire watch services
6.6. Provide the following temporary services:
6.6.1. 110/120 VAC in workspace. 40 Amp service
6.6.2. Lighting
6.6.3. Ventilation
7. SHIP’S FORCE RESPONSIBILITIES:
7.1. Provide work controls to allow contractor to perform work.
7.2. Remove interferences in way of work as required, including structure, mechanical and electrical components.
7.3. Perform a walk-through inspection of contract areas with the contractor prior to executing work if needed
8.0 GOVERNMENT FURNISHED PROPERTY AND SERVICES:
8.1 The Government will not provide any equipment, facilities, utilities or service other than what is covered in 4.3.2 regarding use of dosimetry.
9.0 CONTRACTOR QUALIFICATIONS/REQUIREMENTS/RESPONSIBILITIES:
9.1 A Marine Chemist that is currently board certified by the National Fire Protection Association (NFPA).
9.2 In accordance with current Department of Defense and Homeland Security requirements, performance of all work under this contract is restricted to US citizens and US nationals only. All work performed shall be in accordance with Federal, Navy and local laws, regulations and procedures.
9.3 Contractor will comply with environmental guidelines IAW state and federal requirements.
9.4 Contractor will comply with OSHA standards.
9.5 Security Requirements: Contractor personnel shall have the required security clearances to work areas of Norfolk Naval Shipyard, Naval Vessels, and onboard a US Navy Submarine.
9.5.1 At a minimum, all personnel providing services related to this order shall be United States citizens and shall possess a Department of Defense final-adjudicated Personal Security Clearance at the secret level, in accordance with DD Form 254 for performance on this Task Order. Failure of ability of a worker or supervisor to obtain a NNSY badge (i.e. minimum final secret clearance) will be cause for NNSY to refuse acceptance of individual.
9.5.2 Contractors shall have DBIDS credentials for access to Norfolk Naval Shipyard.
Contractors and any subcontractors shall submit contract DD-254 to Norfolk Naval Shipyard Security Department Code 1120 for access requirement verification prior to arrival.
9.5.3 Contractors/subcontractors shall submit Visit Requests via the Joint Personnel
Adjudication System (JPAS) to SMO 39040 for visitor clearance verification. Visit requests submitted by other means will not be accepted without Facility Security Officer signed verification as to the level of security clearance granted to each employee on the visit request
9.5.4 Contractor shall attend project provided orientation / training brief that will discuss expected actions of all contractors in the event of a casualty or other emergency situation.
Additionally, the Contractor will follow direction of NNSY Project Team and Ship’s Force in the event of drills or actual emergencies. This orientation is required for each awarded Task Order. Submit a report to the WIL listing all personnel who have attended the orientation. The report shall be submitted prior to personnel coming to the work site.
It is Contractor’s responsibility to ensure all personnel that will be working at the job site attend this orientation / training.
8. SAFETY:
Per FAR 22.102-1(a) entitled "Safety", Contractors are hereby informed that their employees or representatives present on property under Norfolk Naval Shipyard cognizance must follow Federal and State OSHA requirements and Norfolk Naval Shipyard OSHE Program Manual, NAVSHIPYDNORINST P5090.2 requirements or safety requirements for site specific location of the contract.
Contractors and Non-NNSY Government Agencies (NNGAs) are hereby informed that their employees or representatives present on property under Norfolk Naval Shipyard (NNSY) cognizance must adhere to Federal OSHA requirements for hazardous energy control IAW 29 CFR 1915.89 and must follow Hazardous Energy Control (HEC) procedures as identified in NAVSEA’s Occupational Safety, Health, and Environment Corporate Manual (OSHECM) Chapter 250 (latest revision), when performing work under NNSY contract. All HEC work to be performed by Contractors and NNGAs requires that NNSY Technical Points of Contact (TPOCs) be notified of the HEC scope of work prior to starting work. Any changes or deviations in the initial scope of HEC work requires the NNSY TPOCs be informed of the change/deviation. Appendix 250.B-1 through B-3 of OSHECM Chapter 250 for multiple employer work identifies when Contractors and NNGAs are required to assign their Lockout/Tags-Plus Coordinator (LOTC) to coordinate HEC work with the cognizant NNSY LOTC. HEC locks shall be provided by the contractor or NNGA for their employees use. The HEC locks shall have red bodies with name labels or name tags affixed, identifying who installed the HEC lock(s) and a point of contact telephone number. HEC lock name labels and tags must be made of materials that will hold up to the environment to which they are exposed. HEC tags used for Tags-Plus HEC work shall be provided by the cognizant NNSY LOTC to the contractor or NNGA for their use if machinery, equipment, or systems (MES) cannot be locked out. OSHECM Chapter 250 Tags-Plus procedures will be strictly followed.

Contractor shall coordinate Marine Chemist Certification with NNSY Navy Competent Person prior to leaving the jobsite.
9. PERSONNEL: The Contractor shall furnish sufficient personnel to perform all work specified within this contract. Services shall be provided except during Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings.
The Contractor must at all times maintain an adequate work force for the performance of all tasks defined within this PWS when the Government facility is not closed. 9.1. When performing work associated with this PWS, Contractor employees shall clearly identify themselves as a Contractor (i.e. company shirt, badge, company identification) in a visible location on the front of exterior clothing, above the waist, (except when safety or health reasons prevent such placement) to avoid creating an impression that they are government personnel. Identification badges shall be worn at all times when performing work.
9.1.1. Contractor personnel shall not manage, supervise, direct, or task US military, DOD civilians or other personnel not associated with the Contractor while performing the tasks within this PWS.
9.1.2. Contractor personnel shall not make any commitment which commits the expenditure of US Government resources.
9.1.3. The Contractor performing services shall be required to comply with all US Navy rules, regulations, and training that is applicable to conduct, safety, security, and procedures governing site entry and exit.
9.1.4. Contractor personnel shall not establish an employee-employer relationship with Navy Commands under this PWS.
9.1.5. The Contractor shall not provide personal services to US Navy commands. 12. DEFENSE BIOMETRIC IDENTIFICATION SYSTEMS (DBIDS) FOR INSTALLATION ACCESS:
Any new contractor, vendor or supplier requesting base access AFTER 31 May 2017 will be required to obtain a DBIDS credential. NCACS credentials will no longer be issued. Only DBIDS credentials will be issued to ALL contractors, vendors and suppliers seeking base access AFTER 14 August 2017.
Defense Biometric Identification System (DBIDS) increases installation security and communications by receiving frequent database updates on changes to personnel/credential status, law enforcement warrants, lost/stolen cards, and force protection conditions. The system provides a continuous vetting anytime the DBIDS card is scanned at an installation entry point.
If you currently have a Navy Commercial Access Control System (NCACS) card, the following is required to get a DBIDS credential:
• Present your NCACS Card and a completed copy of the SECNAV FORM 5512/1 to the base Visitor Control Center representative.
• The VCC will pull up your information in the computer, ensuring all information is current and correct.
• Once your information is validated, a temporary DBIDS credential is provided.
• Your temporary credential will have an expiration date, prior to which you will need to obtain your permanent DBIDS credential (~ 90 days).
• For each additional U.S. Navy installation to which you need access, the first time you visit you only need to bring your DBIDS credential and statement of purpose for base access when arriving at the Visitor Control Center.
• The representative will enter base access authorization and then you may proceed to work.
If you do NOT have an NCACS Card, the following is required to obtain a DBIDS credential:
• Present a letter or official document from my government sponsoring organization that provides the purpose for your access.
• Present valid identification, such as a passport or Real ID Act-compliant state driver's license.
• Present a completed copy of the SECNAV 5512/1 form to obtain your background check.
• Upon completion of the background check, the Visitor Control Center representative will complete the DBIDS enrollment process, which includes your photo, finger prints, base restrictions, and several other assessments;
after all this is done, you will be provided with your new DBIDS credential.
• You may now proceed to work.

Contractors and Non-NNSY Government Agencies (NNGAs) are hereby informed that their employees or representatives present on property under Norfolk Naval Shipyard (NNSY) cognizance must adhere to Federal OSHA requirements for hazardous energy control IAW 29 CFR 1915.89 and must follow Hazardous Energy Control (HEC) procedures as identified in NAVSEA’s Occupational Safety, Health, and Environment Corporate Manual (OSHECM) Chapter 250 (latest revision), when performing work under NNSY contract. All HEC work to be performed by Contractors and NNGAs requires that NNSY Technical Points of Contact (TPOCs) and/or Contracting Officer’s Representatives (CORs) be notified of the HEC scope of work prior to starting work. Any changes or deviations in the initial scope of HEC work requires the NNSY TPOCs and/or CORs be informed of the change/deviation. Appendix 250.B-1 through B-3 of OSHECM Chapter 250 for multiple employer work identifies when Contractors and NNGAs are required to assign their Lockout/Tags-Plus Coordinator (LOTC) to coordinate HEC work with the cognizant NNSY LOTC. HEC locks shall be provided by the contractor or NNGA for their employees use. The HEC locks shall have red bodies with name labels or name tags affixed, identifying who installed the HEC lock(s) and a point of contact telephone number. HEC lock name lables and tags must be made of materials that will hold up to the environment to which they are exposed. HEC tags used for Tags-Plus HEC work shall be provided by the cognizant NNSY LOTC to the contractor or NNGA for their use if machinery, equipment, or systems (MES) cannot be locked out. OSHECM Chapter 250 Tags-Plus procedures will be strictly followed.

ACCESS TO NNSY
REQUIREMENTS FOR ACCESS TO NNSY
Commander, Navy Installations Command (CNIC), has established the Defense Biometric Identification System, (DBIDS), a standardized process for granting unescorted access privileges to vendors, contractors, suppliers and service providers not otherwise entitled to the issuance of a Common Access Card (CAC) who seek access to and can provide justification to enter Navy installations and facilities. Participation in the DBIDS is not mandatory, and if the Contractor chooses to not participate, the Contractor's personnel will have to obtain daily passes, be subject to daily mandatory vehicle inspection, and will have limited access to the installation. The Government will not be responsible for any cost or lost time associated with obtaining daily passes or added vehicle inspections incurred by non-participants in the DBIDS. Alternatively, if the vendor so chooses, it may voluntarily elect to obtain long-term credentials through enrollment, registration, background vetting, screening, issuance of credentials, and electronic validation of credentials. SURVEILLANCE SERVICES OR EQUIPMENT (NOV 2021)
The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products and Commercial Services. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or https://www.sam.gov/
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
