SECTION L: INSTRUCTIONS TO CONTRACTORS

Addendum to FAR 52.212-1(a): Submission of offer

L.1.0 GENERAL INSTRUCTIONS

The Government contemplates award of a firm-fixed-price (FFP) purchase order from this solicitation. The resultant purchase order will be awarded in accordance with the Statement of Work (SOW) provided as an attachment to this solicitation.

This requirement is set-aside for Small Businesses. At the time of contract award, the Contractor shall have an active Federal Government contracts registration in the System for Award Management (SAM), shall not have an active exclusion record in SAM, and shall be registered as a small business.

To be considered eligible for award, each Contractor must submit a single quote that contains a complete and accurate response to the requirements of this solicitation. The Government will not evaluate more than one quotation per quoter.

The Government reserves the right to award the contract without negotiations if the Contracting Officer determines that negotiations are not necessary. Accordingly, quoters are strongly encouraged to submit their best technical solutions and price in response to this solicitation.

THIS REQUIREMENT HAS ONE RESTRICTION ON COMPETITION:

• This is a Brand Name requirement for Advanced RF Technologies, Inc. (ADRF).

• This is a total small business set-aside, and only small businesses will be considered for award.

The following factors shall be used to evaluate quotes:

Factor I – Technical Acceptability Factor II – Price

Award shall be based on Lowest Price Technically Acceptable (LPTA) in accordance with the Federal Acquisition Regulation (FAR) Part 12 procedures, as implemented under the Revolutionary FAR Overhaul (RFO) class deviations, Acquisition of Commercial Products and Commercial Services, which meet the responsibility determination standards at

FAR 9.104-1.

L.2.0 FORMAT AND CONTENT: Evaluation Factors The written quote shall be submitted in Adobe PDF, Microsoft Word, or Excel format. ZIP files are not allowed. Any other formats may not be accessed and may be precluded from consideration of contract award.

The quote shall consist of the following:

• Title of the Quote

• RFQ Number

• Name and address of Quoter, Cage Code, and UEID

• Quote validity period for 30 days from solicitation closing

• Technical Specification

• Price

L.3.0 TECHNICAL SPECIFICATION

The Government will evaluate the extent to which the offer does not take exception to any terms, conditions, or requirements contained within the solicitation, demonstrates a clear understanding of the requirements and an effective approach for accomplishing the tasks identified in the Statement of Work.

To demonstrate Technical Capability, the technical section shall provide, in sufficient detail, an approach that will successfully demonstrate the offeror’s understanding and plan to complete the requirements for the accomplishment of the effort set forth in the solicitation. The quotation must describe how the offeror plans to approach the Statement of Work (SOW) tasks and meet or exceed the standards for the requirement. Technical Specification that merely states they will perform in accordance with the SOW, or that paraphrase the SOW without providing the required information and documentation, may be evaluated as Unacceptable.

L.4.0 PRICE QUOTE

The offeror shall submit a complete quote that includes sufficient detail to determine price reasonableness. There is no page limit for the price quote.

L.5.0 QUOTE SUBMISSION AND DEADLINE

Quotes shall be submitted electronically via email in accordance with the solicitation instructions.

The Government may award without negotiations. Therefore, the initial quote should contain the offeror's best terms from a technical and price perspective.

Note: Offerors should not submit any additional information with their quote.

DEADLINE to submit Quote and Technical Approach:

The written portion and quote must be emailed and received no later than 11:00 AM Pacific Daylight Time (PDT) on 18 August 2026.

• The subject of the email must state “RFQ N00244-26-Q-0083”.

• Submit quotes to the Contract Specialist, Elisa Allison, at elisa.r.allison.civ@us.navy.mil.

• Failure to submit by this date and time may result in the Contractor’s quote being deemed non-responsive and removed from further consideration in accordance with FAR 52.212-1(c) to protect the Government's timeline.

Questions must be received no later than 11:00 AM (PDT) 14 August 2026.

Submission of Questions: All questions must be submitted ONLY via email to the Contract Specialist, Elisa Allison, elisa.r.allison.civ@us.navy.mil.

• The subject line must state “Questions for Solicitation N00244-26-Q-0083”.

L.6.0 RESPONSIBILITY DETERMINATION & SUPPLIER PERFORMANCE RISK SYSTEM (SPRS)

No actions are needed to be submitted with the offer.

However, after the solicitation closing date, the Contracting Officer may require an offeror to submit information promptly to demonstrate the offeror is responsible. (See responsibility determination below under M.5.0 Pre-Award Assessments).

In addition, the Government will conduct an independent review to include Supplier Performance Risk System (SPRS) and/or other Governmental databases that provide information relevant to Offeror's past performance.

Supplier Performance Risk System (SPRS) scores are available at www.piee.eb.mil. A poor rating could put you at risk during the pre-award assessment.

SECTION M: METHOD OF EVALUATION

Addendum to FAR 52.212-2(a): Evaluation Factors

M.1.0 BASIS FOR AWARD

The Government intends to award a single Firm-Fixed-Price (FFP) purchase order from this solicitation. Award will be made based on the LPTA source selection process to the offeror whose offer is determined to be technically acceptable, whose offer conforms to all contract requirements, is determined to be fair and reasonable, and who is deemed responsible in accordance with FAR Part 9 Contractor Qualifications.

The Contractor must submit ONE quotation in accordance with the directions set forth in Section L of this solicitation.

The Government will not evaluate more than one quotation per Contractor. Furthermore, the Government reserves the right to award a contract without negotiations if the Contracting Officer determines that negotiations are not necessary.

M.2.0 EVALUATION FACTORS

The Government will evaluate the offers using the following factors:

• Technical Approach

• Price

M.3.0 FACTOR 1 - TECHNICAL APPROACH

The Government will evaluate the Technical Specification on an Acceptable/Unacceptable basis. The technical specifications must demonstrate a clear understanding of the requirements and provide all requested documentation.

Award will be made to that offeror whose quote contains the lowest price technically acceptable offer that meets the responsibility determination standards at FAR 9.104-1. However, the Government reserves the right to not award to an offeror whose price is significantly below the next lowest offeror, or is unable to determine fair and reasonable pricing.

Technical Evaluation Ratings: The Technical Factor will be evaluated on an Acceptable or Unacceptable basis using this rating table:

Table M.3: Evaluation Standards Rating Table

Element Evaluation Standard (Acceptable Criteria) Standard for "Unacceptable" Rating

Technical Approach

The quote meets all of the requirements in the SOW and demonstrates the capacity to perform all tasks.

The quote does not conform to the SOW. The vendor failed to provide the mandatory technical specifications as required by the SOW.

Only those Contractors who score a rating of “Acceptable” in this Factor (1) Technical Approach will proceed for evaluation under Factor (2) Price.

M.4.0 FACTOR 2 - PRICE

The Government will evaluate offers for award purposes by the total price for this requirement.

The Contracting Officer must determine that the total price is fair and reasonable before proceeding to the award phase.

The Government may use various price analysis techniques, including comparison of proposed prices received in response to the solicitation and comparison to the Independent Government Cost Estimate (IGCE).

M.5.0 PRE-AWARD ASSESSMENTS: RESPONSIBILITY & SPRS

Prior to contract award, the Contracting Officer will review the following of the prospective awardee:

• Verify the performance rating in the Supplier Performance Risk System (SPRS).

• Conduct a responsibility determination in accordance with FAR 9.104-1.

Supplier Performance Risk System (SPRS):

The Contracting Officer will use the Supplier Performance Risk System (SPRS) in the evaluation of the Offeror's performance. SPRS retrieves item, price, quality, delivery, and Contractor information on contracts from Government reporting systems to develop risk assessments. SPRS is available at https://piee.eb.mil/.

Responsibility Determination:

An award will only be made to an offeror satisfying the general responsibility standards of FAR 9.104-1. The Contracting Officer may either make a responsibility determination without requesting any information from an offeror or require the offeror to provide information to substantiate that it satisfies the general responsibility standards of FAR 9.104-1. The information requested from an offeror will be specific to that offeror. For example, an offeror that the Contracting Officer is less familiar with may be required to provide information not required from another offeror. The Contracting Officer may consider an offeror's inability to promptly respond to a request for information as an indication the offeror is non-responsible since FAR 9.103(c) obligates prospective Contractors to affirmatively demonstrate their responsibility.

When the Contracting Officer requests responsibility information, the Contracting Officer's request, the offeror's response, and all related communications between the Government and offeror are solely for the purpose of determining whether the offeror is responsible. These communications will not constitute negotiations within the meaning of FAR RFO 15.204-2 since the offeror will not be given an opportunity to revise its quote.

While the Contracting Officer may require the offeror to provide any information related to the standards at FAR 9.104- 1, the following are examples of information that may be required:

1. A demonstration, through information such as bank references and financial information (e.g., most current annual balance sheet), that the offeror has adequate financial resources to perform the contract.

2. A demonstration the offeror’s price is not so low as to call into question the offeror’s capability to successfully perform the contract.

3. Past performance information on recent contracts for items similar to this requirement, including a point of contact for the Government activity or commercial entity customer.

4. A demonstration the offeror can comply with the required performance schedule, including a transition plan.

5. A demonstration the offeror has, or can obtain, the organizational, management and technical skills to successfully perform. This demonstration may involve the particular personnel and approaches available to the offeror.

6. The offeror’s quality assurance procedures.

7. The equipment and facilities the Contractor will use.

8. Information demonstrating a proposed subcontractor satisfies the FAR 9.104-1 general standards of responsibility.

9. Completion of the Section K Certifications and Representations contained in this solicitation.

10. A demonstration the offeror isn’t an inverted domestic corporation.

11. Certificate of registration of the company.

12. A demonstration the offeror has all registrations, permits and licenses required to perform the contract in the locations for which the offeror is proposing.

13. In the event the offeror is a joint venture, a Memorandum of Association which indicates who has the authority to bind the company.

Nothing in this provision limits the Contracting Officer's discretion to rely on information available from other sources (e.g., past performance databases, discussions with other entities familiar with the offeror) or to use any other technique described in FAR Subpart 9.1 when determining whether the offeror satisfies the FAR 9.104-1 general responsibility standards.
