INSTRUCTIONS TO OFFERORS
ADDENDUM TO FAR 52.212-1
INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS
1.1 The anticipated Firm-Fixed-Price (FFP) purchase award under this solicitation will be a total small business set-aside made in accordance with Federal Acquisition Regulations (FAR) Part
12, Acquisition of Commercial Products and Commercial Services. All responses to solicitation
N00244-26-Q-0068 identify the Quoter’s agreement with all terms, conditions, and provisions included in this solicitation. Offers that fail to furnish required representations or information or reject the terms and conditions of the solicitation will be excluded from consideration.
1.2 Only offers received from eligible small businesses under NAICS code 332510 will be considered for award.
1.3 Offerors’ quotes shall provide the unit price for each item number in the SOW.
1.4 Each attachment shall contain the following items in addition to the other information required by this solicitation:
Quote: The quote shall indicate the following:
• Title of the Quote
• RFQ Number
• Name and address of Quoter, Cage Code, and UEID
• Quote validity period for 30 days from solicitation closing
• FACTOR I – Technical Specification
• FACTOR II- Required Delivery Date
Quoters are advised to submit Quotes that are complete and clear in all respects without a need for additional explanation or information. Quoters are cautioned against general, vague, or insubstantial statements that prevent or render difficult the concise evaluation of the quote. The quote must be sufficient and complete to demonstrate how the Quoter proposes to comply with the contract requirements.
Brochure Manship is not desired; clarity and completeness are essential. Quoters are cautioned against restating SOW requirements in their quote, particularly with regard to technical requirements and must state how all RFQ and SOW requirements will be met. Statement such as
“the Quoter understands” and “the Quoter shall/can comply,” along with responses that paraphrase the RFQ, are inadequate. The use of phrases such as “standard practices” (with a specific Government reference or industry reference) does not indicate that a Quoter understands the requirements and will result in an unacceptable evaluation.
Submission of commercial product specification sheets or technical manuals that clearly map to the SOW requirements is highly encouraged.
EVALUATION FACTORS
ADDENDUM TO FAR 52.212-2 EVALUATION—COMMERCIAL PRODUCTS AND
COMMERCIAL SERVICES
(a) Basis for Contract Award
This is a competitive, best-value source selection conducted in accordance with FAR Part 12
(Acquisition of Commercial Products and Commercial Services) and FAR Part 13 (Simplified
Acquisition Procedures). The Government intends to award a single contract resulting from this solicitation to the responsible offeror whose offer, conforming to the solicitation, represents the overall Best Value to the Government, price and other factors considered.
The Government intends to award a contract to the offeror who represents the overall best value, where non-price factors (Technical Specification and Required Delivery Schedule), when combined, are significantly more important than Price.
Accordingly, the Government may elect to award to other than the lowest-priced offeror, or other than the highest technically rated offeror, where the perceived benefits of the stronger technical proposal justify the additional cost (price premium). The Government will not make an award at a price premium that is determined to be unreasonable or unaffordable.
The following factors shall be used to evaluate offers:
FACTOR I: TECHNICAL SPECIFICATION
• Evaluation Method: Qualitative Assessment (Technical Rating and Risk)
• Description: The Government will evaluate the offeror’s technical proposal to assess the capability of the proposed commercial products or services to meet or exceed the Government's minimum requirements outlined in the technical specifications, Statement of Work (SOW), or
Performance Work Statement (PWS).
• Specific Areas of Evaluation:
• Technical Approach: The extent to which the offeror’s technical narrative demonstrates a clear, comprehensive, feasible, and low-risk approach to fulfilling all requirements.
• Product/Service Capabilities: The degree to which the proposed commercial item meets, or provides innovative enhancements beyond, the minimum technical thresholds.
• Value-Added Features: The Government will evaluate any proposed features that exceed minimum requirements to determine if they provide a distinct operational benefit to the
Department of War (DoW).
FACTOR II: REQUIRED DELIVERY SCHEDULE
• Evaluation Method: Qualitative Assessment / Commitment Verification
• Requirement: REQUIRED DELIVERY DATE FIRM: 01 OCTOBER 2026.
• Description: The Government will evaluate the offeror's proposed schedule, milestones, and risk mitigation strategies to ensure guaranteed delivery on or before 01 October 2026.
• Specific Areas of Evaluation:
• Feasibility of Schedule: The realism and soundness of the offeror's production, shipping, or deployment timeline leading up to the firm 01 October 2026 deadline.
• Risk Management: The adequacy of the offeror's plan to mitigate supply chain disruptions, labor shortages, or transportation delays to guarantee execution on or before the firm deadline.
• Delivery Commitment: Proposals that propose a delivery date after 01 October 2026, or fail to explicitly commit to this firm date, will be considered unacceptable and ineligible for award.
FACTOR III: PRICE
• Evaluation Method: Price Analysis
• Description: Price will not be rated qualitatively. The Government will evaluate the proposed price for completeness, balance, and price reasonableness in accordance with FAR
13.106-3 and FAR 15.404-1.
RELATIVE IMPORTANCE OF EVALUATION FACTORS
Factor I (Technical Specification) and Factor II (Required Delivery Schedule), when combined, are significantly more important than Factor III (Price).
As Price is the least important factor, the qualitative advantages of your Technical and Delivery proposals will carry the heaviest weight in the selection process. Offerors are cautioned that the closer the technical and schedule ratings of the competitive proposals are to each other, the more important Price may become in the final tradeoff decision.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.
(End of provision)
