About this file

This document is a Request for Quote (RFQ) from the U.S. Department of Navy Naval Research Laboratory's Small Purchase Branch for specific America Fujikura Ltd. (AFL) fiber optic products. The procurement includes eight specific items such as a Fusion Splicer Kit (S017521), CT50 Cleaver with AD-16B adapter plate, various fiber holders, an AC adapter, and an AC power cord. The required source is exclusively AFL, and the delivery is requested ASAP.

The justification for sole-source procurement is based on brand name requirements, with NRL Code 5651 citing the need for compatibility with existing hardware and splice recipes. Market research determined that alternative manufacturers would require extensive and costly recipe redevelopment, estimated at up to five times the splicer's procurement cost. The document emphasizes that using a different manufacturer would necessitate significant time and resource investment to refit the current laboratory setup, potentially causing delays and increased labor costs.

B. _X_ BRAND NAME. Item required must be a brand name product, or feature of a product, particular to one manufacturer.

(Discuss why you are precluding consideration of a product manufactured by another company. Describe how the particular brand name, product, or feature is essential to the Government's requirements and why a "brand name or equal" purchase description cannot be used (see FAR 11.104). Describe how market research indicates other companies' similar products or products lacking the particular feature do not meet, or cannot be modified to meet, the agency's needs.)

NRL Code 5651 requires the specific items detailed in the 'Description of Item or Service' section above, which are items proprietary to

AFL. NRL requires these brand name specific items to ensure compatibility with the large collection of current hardware and splice recipes within Code 5651 that are specific to AFL splicers. A "brand name or equal" purchase description cannot be used JAW FAR

11.104 because utilizing AFL's products supports NRL's current research set up. Attempting to utilize another manufacturer's product would require an extensive investment in time and money to alter the workspace. Obtaining a non-AFL splicer for this effort would severely inhibit the ability to perform on NRL's current research efforts.

Other splicers were considered during market research; however, the results of this consideration were that no current sponsor would be willing to pay for the splicer recipe redevelopment required to bring their system up to an acceptable performance level. These recipes are for various fiber types, both modern and legacy fibers, and are used for multiple programs. The estimated cost of redeveloping these recipes could be up to five times the cost of the splicer being procured.

Lastly, using a different brand manufacturer would be a significant time investment for the Government to refit the current laboratory setup to a non-AFL splicer, resulting in increased labor hours, added costs and potential delays/schedule slippage.

C. _UNUSUAL AND COMPELLING URGENCY. The supplies or services are of such unusual and compelling urgency that the

Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:

1. Date on which the requirement was first identified:

2. Required delivery date/period of performance:

3. Explanation of why delivery/commencement of services by the date mentioned above is required: (Explain the impact to the mission if the date above is not met, any special circumstances or conditions that exist which validate the requirement as "urgent," estimated production lead time for the item, etc.).

4. If appropriate, include any additional pertinent information.

ACQUISITION INITIATOR - Technical/ Requirements Certification: I certify that the facts and representation under my cognizance which are included in this justification are complete and accurate to the best of my knowledge and belief.
