About this file

This is a Request for Quote for Information Technology Services (RFQ-ITS 26-0044) issued by the California Department of Forestry and Fire Protection (CAL FIRE) for the design, development, testing, and deployment of an HR Grievance Tracking System. The project seeks to build a configurable, secure, and data-driven software solution that manages public employee grievances and complaints across multiple levels of review—including local, regional, departmental, and California Department of Human Resources levels—with capabilities for intake, tracking, reporting, and analysis. The system must support multi-level workflows, custom data fields, role-based access controls, audit logs, and version tracking. The RFQ was released on August 31, 2026, with a bid submission deadline of October 2, 2026, by 2:00 PM Pacific Time. Written questions must be submitted by September 8, 2026, with CAL FIRE responses due by September 18, 2026. The contract term is one year from execution with two optional one-year renewal periods. Work is performed on a time-and-materials basis with contractor personnel working remotely within the continental United States and all electronic data stored in continental U.S. cloud data centers.

Pricing is based on actual hours worked at rates specified in the Cost Worksheet (Exhibit C), with invoices submitted monthly in arrears and payment due within 45 days of receipt. All line items in the cost worksheet must be completed; incomplete or indeterminate costs may disqualify offers. The evaluation comprises 60 points for technical requirements (based on references, resumes, and proposed solutions) and 40 points for cost. Small Business (SB) preference of 5 percent is available, along with a Disabled Veteran Business Enterprise (DVBE) incentive of up to 5 percent based on confirmed participation. Non-small businesses subcontracting at least 25 percent to certified California SBs receive a 5 percent preference. The contractor must comply with security requirements including SOC 2 Type II attestation or equivalent authorizations (FedRAMP or StateRAMP), California Code requirements, and confidentiality agreements. Contractors must maintain an Information Security Program, Risk Assessment Program, and Incident Response Program meeting or exceeding CAL FIRE standards. Travel costs are not reimbursable. The contract is subject to termination within 30 days' written notice and standard California procurement regulations including non-discrimination, tax compliance, and public records act provisions.

A. General Information

1. Background and Purpose

Public unions and employees may file grievances against an employer of alleged bargaining unit (BU) contract violations and may file complaints for other alleged violations. Grievances and complaints can go through multiple “levels” of filing and appeal and multiple levels of response. These levels may include the local (Program or Unit), Region, Director/Department, and California Department of Human Resources (CalHR) levels. Additionally, a grievance may be appealed to arbitration and/or other dispute resolution processes.

The CAL FIRE Labor Relations Office (LRO) needs a software program where grievances/complaints at all levels can be uploaded, accessed, viewed, and edited for every level of review. We also need the ability to run various reports on all data entered into the system, e.g., how many grievances are currently at the Department level, how many grievances were filed on the BU 8 Vacation provision, which grievances are being held in abeyance, are we receiving more or less grievances than last year, etc.

We need control over who has access to the software, and we need various levels of access within the software. For example, some users may only enter, read and access grievances to which they’ve responded to, and/or up to a certain level of review. Some users will need master access, and the ability to enter, read, edit and access all information in the software. We also have very specific fields/information we need to be able to enter in this software at each level, and generally within the software.

The purpose of this Agreement is to obtain professional services on a time-and-materials basis for the design, development, testing, and deployment of a software solution that manages public employee grievances and complaints across multiple levels of review. The Contractor will work collaboratively with the LRO to build a configurable, secure, and data-driven system that supports intake, tracking, reporting, and analysis.

Each listed California certified SB must perform a ”Commercially Useful Function” (Attachment 6) in performance of the contract as defined in Government Code, Section 14837(d)(4).

n. Small Business Nonprofit Veteran Service Agencies (SB/NVSA)

Nonprofit veteran service agencies (NVSA) that have been CA certified as a SB nonprofit veteran service agency are eligible to claim the 5% SB preference when responding to competitive solicitations in accordance with California Military and Veterans Code Section 999.50 et seq. This preference must be claimed by completing the Bidder Declaration form GSPD-05-105, Attachment 5.

o. DVBE Participation Requirement

The State has established a 3% goal for Disabled Veteran Business Enterprises (DVBE) participating in State contracts. If claiming DVBE status the bidder must document their commitment to full DVBE participation or a percentage of the work. This applies to all contracts regardless of the solicitation format used. For the purpose of this solicitation, the DVBE participation requirement may be waived.

p. DVBE Incentive

In accordance with Section 999.5(a) of the Military and Veterans Code (MVC) an incentive will be given to respondents who provide DVBE participation. For evaluation purposes only, CAL FIRE will apply an incentive based on the amount of DVBE participation obtained above three percent (3%) as identified on the Bidder Declaration GSPD-05-105, Attachment 5 and confirmed by the

CAL FIRE.

If the Contractor is claiming a DVBE incentive, the Bidder must complete Attachment 5 – Bidder Declaration (GSPD-05-105), Attachment 6 – Commercial Useful Function (CUF) Evaluation Form, and Attachment 7 – Disabled Veteran Business Enterprise Declaration (STD. 843).

The DVBE incentive percentage will be applied to the total possible points that can be earned by the bidder, excluding points for socioeconomic incentives or preferences. The following illustrates the incentive percentage available based on the Bidder’s confirmed percent of DVBE participation.

G. Rejection of Offers

Deviations may cause a bid to be deemed non-responsive and not to be considered for award. CAL FIRE may reject any or all bids and/or may waive any immaterial deviation or defect in a bid. CAL FIRE's waiver of any immaterial deviation or defect shall in no way modify the RFQ-ITS documents or requirements and shall not excuse the Contractor from full compliance with the RFQ-ITS specifications if awarded a contract.

Final bids not received by the date and time specified in key action dates, will remain unopened and will be maintained separately from bids that have been timely received. Bids received after expiration of the deadline may only be opened and considered upon written approval of CAL FIRE’s management or their designee specifying the reason(s) for acceptance and consideration of the untimely bid.

Issuance of this RFQ-ITS in no way constitutes a commitment by CAL FIRE to award a contract. CAL FIRE reserves the right to reject any or all bids, or portions of bids, received in response to this RFQ-ITS, or to amend or cancel this RFQ-ITS at any time. In the event of such cancellation, CAL FIRE may reissue the RFQ-ITS at a later date.

CAL FIRE reserves the right to consider Bidder’s past performance with CAL FIRE in its selection of a Contractor pursuant to this RFQ-ITS.

1. Non-Responsive Offers

A bid may be deemed non-responsive and subsequently rejected if any of the following occur:

a. A submission is received after the exact time and date set forth in the Key Action Dates for receipt of each submission.

b. The Bidder fails to submit or fails to complete and sign any required Attachments as instructed in this RFQ-ITS.

c. The submission contains false, inaccurate, or misleading statements or references.

d. The Bidder is unwilling or unable to fully comply with the proposed contract provisions.

e. The Bidder supplies conditional cost information, incomplete cost information, or cost information containing unsigned/uninitiated alterations or irregularities.

f. The Bidder proposes pricing so low it suggests that the vendor cannot realistically perform the work.

2. Business In Good Standing

Bidder acknowledges that when agreements are to be performed in the State of California by corporations or vendors, CAL FIRE will verify, prior to awarding any State contract, the following information in order to ensure that all obligations due to the State are fulfilled.

3. Corporation in Good Standing

CAL FIRE will verify with the California Secretary of State (SOS) that the Bidder is a corporation currently qualified to do business in California.

The bid may be considered non-responsive if the Bidder is not listed with

SOS.

“Doing business” is defined in California Revenue and Taxation Code section 23101 as actively engaging in any transaction for the purpose of financial or pecuniary gain or profit. Although there are some statutory exceptions to taxation, rarely will a corporate contractor performing within the State not be subject to the franchise tax.

Both domestic and foreign (those incorporated outside of California) corporations must be in good standing in order to be qualified to do business in California.

4. State Tax Delinquency

CAL FIRE will verify with the California Franchise Tax Board (FTB) and California Department of Tax and Fee Administration (CDTFA) that the Bidder is not on a prohibited list due to tax delinquencies. The bid will be considered non-responsive if the Contractor is on any of these lists.

The list established by FTB can be found at:

Top 500 past due balances | FTB.ca.gov

The list established by CDTFA can be found at:

Top 500 Sales & Use Tax Delinquencies in California

H. Evaluation Criteria

The overall responsiveness of each RFQ-ITS response is based on the complete response from the Bidder to the RFQ-ITS requirements, including the scope of work for the project. The following sub-sections and criteria will be reviewed by CAL FIRE’s evaluation team.

1. Administrative Requirements Evaluation Criteria (Pass/Fail) https://www.ftb.ca.gov/about-ftb/newsroom/top-500-past-due-balances/corporate-income-tax-list.html https://www.cdtfa.ca.gov/taxes-and-fees/top500.htm

b. Payee Data Record (Attachment 2)

c. Customer Reference Forms (Attachment 3)

d. Confidentiality Statement (Attachment 4)

e. Bidder Declaration (Attachment 5)

f. CUF Evaluation Form (Attachment 6)

g. DVBE Declaration (Attachment 7)

h. Civil Rights Laws Certification (Attachment 8)

i. Iran Contracting Act Verification Form (Attachment 9)

j. Resumes (Attachment 10)

2. Technical Requirements Evaluation Criteria (60 points)

The technical evaluation criteria will be scored on a scale of 0 through 60 based on references, resumes, and proposed solution outlined in the Bidder’s response to Exhibit A - Scope of Work.

3. Cost (Exhibit C) (40 points)

Cost will be evaluated at 40 points of the total available points. Bid submittals responsive to all requirements will have their cost evaluated. The required Cost Worksheet will be checked for mathematical accuracy and CAL FIRE reserves the right to make mathematical corrections and/or ask clarifying questions. The Bidders will be evaluated on the total extended cost for both the contracted term and including any optional extension years. All cost lines must be completed.

Each bidder cost score will be calculated based on the ratio of the lowest cost proposal to the bidders cost, multiplied by the maximum number of cost points available (40), as shown in the calculation below:

Lowest Total Cost Bid X Total cost points available Bidder Total Cost

Example: To help illustrate this process, refer to table below, for an example of the cost score calculation process. Cost figures in the example below explain the calculations and have no other significance.

Cost Evaluation and Scoring Methodology Example

Bidder Grand Total Cost

Calculation Cost Points Awarded

A $400,000 $300,000 X 40 $400,000

B $350,000 $300,000 X 40 $350,000

C $300,000 $300,000 X 40 $300,000

4. Final Scoring Example

Example:

BIDDER A BIDDER B BIDDER C

Responsive & responsible Yes Yes Yes

Eligible preference DVBE SB None

Technical Score 53 58 56

Score based on price bid 30 34 40

Total Score 83 92 96

Rank 3 2 1

Preference Amount 5 4.8

Final Score 88 96.8 96

Final Rank 3 1 2

The preference calculation is performed as follows:

1. Identify the total score of the #1 ranked bidder before applying the preference amounts:

a. Bidder C at 96

2. Determine the preference amounts:

a. Bidder B (SB Preference):

96 (#1 ranked bidder) X .05 (SB preference %) = 4.8

b. Bidder A (DVBE Incentive):

100 (total possible points) X .05 (DVBE incentive %) = 5

3. Add the preference amount to the total score of bids eligible to receive the preference:

a. Bidder B: 92 + 4.8 = 96.8

b. Bidder A: 83 + 5 = 88

4. The award is to Bidder B in this example.

I. Award of Contract

Award of contract, if made, will be in accordance with the RFQ information on Evaluation to a responsible Bidder whose bid complies with all the requirements of the RFQ documents and an addenda thereto, except for such immaterial defects as may be waived by the State. Award, if made, will be made within forty-five (45) days after the scheduled date for Contract Award or Bid Submission Date as specified in the RFQ; however, a bidder may extend the offer beyond 45 days in the event of a delay of contract award.

The State reserves the right to determine the successful bidder(s) either on the basis of individual items or on the basis of all items included in its RFQ, unless otherwise expressly provided in the State’s RFQ. Unless the bidder specifies otherwise in its bid, the State may accept any item or group of items of any bid. The State reserves the right to modify or cancel in whole or in part its RFQ.

Written notification of the State’s intent to award will be made to all bidders. If a bidder, having submitted a bid, can show that its bid, instead of the bid selected by the State, should be selected for contract award, the bidder will be allowed five (5) working days to submit a Notice of Intent to Protest, according to the instructions contained in the section titled “Protest” of this RFQ.

J. Protest

Any Bidder issues regarding solicitation requirements must be resolved (or attempts to resolve them must have been made) before a protest may be submitted according to the procedure below. These issues will first be resolved by the contact for the solicitation or if they result in a protest, the protest will be submitted to DGS Procurement Division Deputy Director to hear and resolve issues and whose decision will be final.

If a Bidder has submitted a bid which it believes to be totally responsive to the requirements of the RFQ and to be the bid that should have been selected according to the evaluation procedure in the solicitation section on Evaluation and the Bidder believes the State has incorrectly selected another Bidder for award, the Bidder may submit a protest of the selection as described below. The Director of the Department of General Services, or a person designated by the director, may consider and decide on initial protests of all other information technology acquisitions and non-it goods.

All protests of award must be made in writing, signed by an individual authorized to bind the Bidder contractually and financially, and contain a statement of the reason(s) for protest; citing the law, rule, regulation, or procedure on which the protest is based. The protester must provide facts and evidence to support the claim. The protester must submit their protest to the CAL FIRE Procurement Official listed for this RFQ and PDProtest@dgs.ca.gov within five (5) business days of receipt of the Notice of Intent to Award. For more information on the bid protest process, please see SCM Vol 2 Section 1702 and Protest of Awards and Contract Disputes.

EXHIBIT A - SCOPE OF WORK

1.0 Background and Purpose
