(3) All prices shall be submitted in USD with two (2) decimal places only. If there are more than two (2) decimal places entered, the quote may not be considered for award.
NOTE: Contract award and payment shall be made in US Dollars.
3. RFQ Evaluation – Commercial Products and Commercial Services (FAR 52.212-2):
a. This acquisition is being conducted under Federal Acquisition Regulation (FAR) Part 13, Simplified Acquisition Procedures, Subpart 13.5 and Part 12, Acquisition of Commercial Items of the Federal Acquisition Regulation. Quotes will be evaluated using the factors identified in
FAR 52.212-2, Evaluation – Commercial Products and Commercial Services (Nov 2021).
b. FAR 52.212-2 is tailored as follows:
(1) Paragraph (a): The Government will award a contract resulting from this solicitation to the responsible contractor whose quote, conforming to the solicitation, will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate quotes:
A. Technical Worksheet (RFQ Attachment 6) – (Acceptable/Unacceptable)
B. Price Quote/Schedule of Rates (RFQ Attachment 2) – (Fair and Reasonable/Not
Fair and Reasonable)
(2) Paragraph (b): Options. The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. The
Government may determine that a quote is unacceptable if the option prices are significantly unbalanced. For this contract, the only option is the six-month extension of services pursuant to FAR 52.217-8. Evaluation of options shall not obligate the
Government to exercise the option(s).
(3) Paragraph (c): A quotation is not an offer and, consequently, cannot be accepted by the Government to form a binding contract. Therefore, issuance by the Government of an order in response to a supplier’s quotation does not establish a contract. The order is an offer by the Government to the supplier to buy certain supplies or services upon specified terms and conditions. A contract is established when the supplier accepts the offer.
c. FAR 52.212-2 is supplemented as follows:
(1) Award will be made on the basis of lowest evaluated price of the quote whose
Technical Worksheet is rated “Acceptable.” The evaluation process shall proceed as follows:
(2) The Government will review each quote received for compliance IAW the instructions in paragraph 2 above. To be considered compliant, each quote shall include the required Contract Documentation (Part I), Technical Worksheet (Part II), and Price Quote (Part III). Only those quotes that are considered compliant shall be evaluated. Quotes received that are considered incomplete or non-compliant may be considered ineligible for award.
(3) Next, the Technical Worksheet (Attachment 6) of the quote with the lowest TEP will be evaluated first and will receive a rating of Acceptable (Technical Worksheet clearly meets the minimum requirements of the solicitation) or Unacceptable
(Technical Worksheet does not clearly meet the minimum requirements of the solicitation). If the quote with the lowest TEP is deemed Unacceptable, then the next lowest priced quote will then be evaluated. The Government will utilize the Excel
(.xlsx) spreadsheet to capture pricing and to calculate the TEP for evaluation and award purposes.
(4) Finally, the Government will evaluate the lowest priced TEP (as quoted in
Attachment 2, Schedule of Rates Excel (.xlsx) spreadsheet) whose Technical
Worksheet received an Acceptable rating to determine fair and reasonableness using one or more techniques set forth in FAR 13.106-3. In addition to the TEP, the quoter’s unit prices will be included in the evaluation of fair and reasonableness. If the lowest priced quote is deemed to have fair and reasonable prices, the Government will complete a responsibility determination IAW the criteria specified in FAR 9.104-
1. If found responsible, the evaluation process stops at this point as that quote represents the best value to the Government. Award shall be made to that quoter without further consideration of any other quotes.
(5) If the lowest priced quoter is found to be non-responsible, the next lowest priced quoter will be evaluated. This process will continue until a quote is evaluated to have an Acceptable Technical Worksheet, fair and reasonable prices, and the quoter is deemed responsible or until all quotes have been evaluated.
(6) The Government reserves the right to award no contract at all depending on the quality of the quotes submitted and availability of funds for the requirement. The
Government intends to award without exchanges with the quoter; however, the
Contracting Officer may inquire at any time about any quote if additional information or a revised quote is required. The Contracting Officer may inquire about all, none, or as many quotes as needed; however, the Contracting Officer shall treat all quoters fairly and impartially, in accordance with FAR 1.102-2(c)(3). Contractors are advised that their initial quote should contain the most favorable terms and reflect its best possible performance potential.
