FAR 52.212-1 Instructions to Offerors -- Commercial Items (Mar 2023) is hereby incorporated by reference, with the same force and effect as if it were given in full text. In addition to the following addendum, all terms and conditions of FAR 52.212-1 remain in effect. The following is tailored to this acquisition and is hereby added via addendum:
1. To assure timely and equitable evaluation of the offer, the offerors must follow the instructions contained herein. The offer must be complete, self-sufficient, and respond directly to the requirements of this solicitation.
2. Specific Instructions: The response shall consist of three (3) separate parts:
Part 1 - Cover Letter – The Cover Letter shall include the Offeror’s points of contact with e-mail address and phone number who are authorized to contractually obligate the company, CAGE Code, DUNS Number, small business status/categories (if applicable), a statement the company understands the requirements specified and will meet the performance standards and requirements therein, and a statement the company does or does not take exception to any of the requirements of this solicitation.
Part 2 – Price – (Evaluation Factor 1) – This requirement is being evaluated on a Lowest Priced Technically Acceptable basis. As a result, the Initial Total Evaluated Price (I-TEP) will be calculated as the sum of the Offeror’s proposed prices for the base period, four 12-month periods, and the six-month Extension of Services (EOS) (calculated using the monthly cost of year five multiplied by six).
The offeror is not to provide pricing for the six-month EOS - this will be calculated by the Government. Evaluation of options in the task order(s) and the EOS shall not obligate the Government to exercise such options. The six-month EOS is IAW FAR 52.217-8, “Option to Extend Services” and will be utilized if necessary. The six-month EOS is not to be considered part of period five and will be a separate option exercised if it is utilized. After any interchanges or quote revisions, if necessary, the Government will evaluate the Final TEP (FTEP).
Under this factor, the Government will evaluate the Offeror’s TEP based on the following:
i. Completeness. The offeror's price and other supporting information will be evaluated (but not rated) to ensure continuity and traceability of prices to the proposed technical proposal and between initial proposals and any revisions thereto. The review will determine the adequacy of the offeror's proposal in addressing and fulfilling the solicitation requirements.
ii. Reasonableness. The proposal will be reviewed to determine the reasonableness of price and the offeror's understanding of and ability to perform the requirement.
iii. Balance. IAW FAR 15.404 unbalanced pricing may increase performance risk and could result in payment of unreasonably high prices. All separately priced line items will be analyzed to determine if the prices are unbalanced. The offer may be rejected if the CO determines the lack of balance poses an unacceptable risk to the Government.
Part 3 - Technical – (Evaluation Factor 2) – Technically acceptable for this service requirement will be defined as being able to meet the requirements of this service contract IAW Unified Facilities Criteria (UCF) 3-601-02, UCF 4-021-01, National Fire Protection Agency (NFPA), Air Force Occupational Safety Handbook (AFOSH) Standards, and manufacturer’s instructions as spelled out in the Performance Work Statement dated 24 August 2023. Additionally, contractor must provide a current and valid National Institute for Certification in Engineering Technologies (NICET) Level III certification in Fire Alarm/Mass Notification Systems Level III on staff. Contractor technicians and, as applicable, subcontractors working on site with fire alarm systems shall/have maintain a current NICET Level II certification in Fire Alarm Systems. The certificate will be evaluated on a pass/fail basis.
Adjectival Rating Description Acceptable Offer meets the requirements of the PWS Unacceptable Offer does not meet the requirements of the
PWS
If the quote with the lowest price is determined technically acceptable, the Government will evaluate the offeror’s total aggregate price for completeness, reasonableness, and unbalanced pricing. In order to determine price fair and reasonable, the evaluation process may continue until reaching two technically acceptable quotes (to establish adequate price competition). If the lowest priced quote is technically acceptable and the price is complete and reasonable, that offeror’s quote represents the best value to the Government and award will be made to that offeror and the government reserves the right to communicate with only that Offeror to address any issues, if necessary, and finalize an order with that offeror. If the lowest priced quote is not technically acceptable, the Government will consider the correction potential and may enter into interchanges with that offeror. If, after interchanges with that offeror, their quote is technically acceptable and remains the lowest priced, the delivery order will be awarded to that offeror. If the Government deems the quote not easily correctable, or if at any time it becomes other than the lowest priced quote, the next lowest priced quote will be evaluated for technical acceptability, followed by an analysis of their price to verify reasonableness and completeness. If the Government begins communications with the next lowest-priced technically acceptable offeror, no further communications with the previous offeror will be entertained until after award. That said, interchanges will take place as necessary or deemed appropriate by the Government. This evaluation process will be repeated until reaching a technically acceptable quote, or until all quotes are evaluated.
