Pursuant to 44 U.S.C. § 3554, Executive Order (E.O.) 14028, “Improving the Nation’s Cybersecurity,” and OMB Memorandum M-22-18, “Enhancing the Security of the Software Supply Chain through Secure Software Development Practices,” as amended by OMB Memorandum M-23-16, “Update to Memorandum M-22-18, Enhancing the Security of the Software Supply Chain through Secure Software Development Practices,” and any subsequent updates thereafter, federal agencies must ensure that the software they use complies with Government-specified minimum secure software development practices.
Software includes firmware, operating systems, applications, and application services (e.g., cloud-based software), as well as products containing software.
Software requires self-attestation if any of the following conditions is met: 1) the software was developed after September 14, 2022; 2) the software was developed prior to September 14, 2022, but was modified by major version changes (e.g., using a semantic versioning schema of Major.Minor.Patch, the software version number goes from 2.5 to 3.0) after September 14, 2022;
or 3) the software producer delivers continuous changes to the software code (as is the case for software-as-a-service products or other products using continuous delivery/continuous deployment).
The Quoter shall provide one of the following with its quotation submission:
1. A copy of the software producer’s Secure Software Development Attestation Form that was previously submitted to the Cybersecurity and Infrastructure Security Agency’s (CISA) Repository for Software Attestations and Artifacts (RSAA) for the solicited product(s); or

If a Quoter fails to demonstrate, as described above, that it has accurately and appropriately completed the Secure Software Development Attestation Form for the offered product(s), it may be considered ineligible for award.
Volume I: Technical Quotation The Quoter’s technical submission should demonstrate the firm’s capability to perform the work requirements outlined in the Attachment A. Volume I shall include separate sections within the volume outlining the following items:
Item 1.0 Technical Capability and Approach
The Technical Capability and Approach must describe, in narrative form, the Quoter’s proposed overall capability and approach to fulfill the requirements in Attachment A, Statement of Work (SOW), especially those delineated in Section 4. Quoters must describe and demonstrate the soundness of their product, approach, methodology, technique, and/or plan to accomplish each task/requirement identified in Attachment A. Quoters must separately address each task/requirement in Section 4 of Attachment A and describe how it can complete and meet those tasks/requirements; the Quoter must not simply restate the requirements as written in Attachment A.
The Quoter must format its Item 1.0 submission such that it corresponds with the order of tasks/requirements delineated in Attachment A and makes reference to a specific section within Attachment A (e.g., Response to Section 4.2, Response to Section 4.3, etc.). The Government is seeking to determine if the Quoter can satisfy all of the Government’s requirements and how the vendor intends to satisfy those requirements.
Additionally, the Quoter must clearly document and describe when it is quoting solutions/methods/requirements that exceed the stated minimum requirements in Attachment A and how the quoted solution/method/requirement exceeds the stated minimum requirements in Attachment A.
Item 2.0 Conformance with Information and Communication Technology (ICT) Accessibility Requirements (Section 508)
Commercial off-the-shelf (COTS) and Cloud-Based Solutions including Software as a Service (SaaS) products (no development or customization): Provide an Accessibility Conformance Report (ACR) for each commercially available Information and Communication
Technology (ICT) item that will be developed, procured, maintained, or used under this contract.
1. Create the ACR using the Voluntary Product Accessibility Template (VPAT®) Version
2.1 or later, located at https://www.itic.org/policy/accessibility/vpat.
2. Complete each ACR in accordance with the instructions provided in the VPAT® template. Each ACR must address the applicable Section 508 requirements referenced in the Statement of Work/Performance Work Statement/Specifications.
3. Address each standard individually and with specificity, and clarify whether conformance is achieved throughout the entire ICT Item (for example - user functionality, administrator functionality, and reporting), or only in limited areas of the ICT Item. Each ACR shall state exactly how the ICT meets the applicable standards in the remarks/explanations column, or through additional narrative. All "Not Applicable" responses must be explained in the remarks/explanations column or through additional narrative.
4. Provide a description of the evaluation methods used to support Section 508 conformance claims. The Agency reserves the right, prior to making an award decision, to perform testing on some or all of the Vendor’s proposed ICT items to validate Section 508 conformance claims made in the ACR.
Page Limitation. Excluding cover page and Item 2.0 Conformance with ICT Accessibility Requirements (Section 508), the Volume I technical quote (including all non-price factors and other attachments) is limited to 20 pages. The font and format should be of readable quality.
Excessively small font may be rejected or not evaluated at the Contracting Officer’s discretion.
Quoters shall not include any price information in the technical quotation. For the overall technical quotation, a recitation or paraphrasing of the requirements already identified in the work requirements will not improve the quotation.
Volume II- Price Quotation Each Quoter shall submit a price quotation separate from the technical quotation (Volume I).
The price quotation shall include the following: Completion of all unit prices as stated in Attachment C, including any stated options.
The price quotation must include the following:
Item 1.0 Completed Pricing Worksheet and Other Documentation.
• Completion of all unit prices as stated in Attachment C, Pricing Worksheet, including any stated options. Please include any and all discounts in this pricing.
• If any further explanation of the price extended in Attachment C is needed, please include a Microsoft Word and/or Adobe PDF document within your Volume II https://www.itic.org/policy/accessibility/vpat submission that provides the necessary narrative. However, the Quoter’s officially extended and final pricing must be included in Attachment C.
• A separate document (whether in Microsoft Word, Adobe PDF, and/or Microsoft
Excel) that provides pricing extended to other government agencies (e.g., federal, state, local, etc.) and commercial entities for similar services/products. This pricing information is used by FHFA to help determine whether the quoted pricing to FHFA is fair and reasonable.
Item 2.0 License Agreement/Terms of Use Agreement.
Quoters must submit their EULA or Terms of Use Agreement for its data services, preferably a Federal government version, as part of Volume II (as a separate Microsoft Word document).
Quoters must adhere to Attachment A, Section 8.0 for specific guidance related to the license agreement. If the Quoter has a current or previous license agreement with FHFA that has already been reviewed and negotiated in the past, please provide that version; if there are any new terms introduced, please highlight that language.
This item is not evaluated and does not factor into an analysis of the Volume II, Price Quotation submission, but must be included by the Quoter in its Volume II submission.
Page Limitation. There is no page limitation on the price quotation submission.
Volume III- Representations and Certifications Quoters shall submit representations and certifications per FAR 52.212-3, Offeror Representations and Certifications—Commercial Products and Commercial Services (MAY 2024) (DEVIATION FEB 2025) (see FAR 52.212-3(b) for those representations and certifications that the quoter shall complete electronically). Please note sections (d) and (t) are considered “Reserved” for this solicitation.
Evaluation and Selection Process
FHFA’s Contracting Officer reserves the right to conduct a compliance review and reject any quotation as non-compliant if the quotation takes exception to any of the terms of the RFQ, includes assumptions, or does not conform to the RFQ’s submission instructions.
Since this award is made under the policies of FAR part 12 in conjunction with FAR part 13 procedures, the evaluation process is streamlined, and FHFA has considerable flexibility in its award decision. FHFA will evaluate the quotation considering positive attributes, negative attributes, and potential risk of the overall quotation.
During the evaluation process, FHFA may or may not conduct exchanges. If FHFA conducts exchanges, such exchanges may be with one, several, or all Quoters. Exchanges may vary based on FHFA’s need to understand or give Quoters an opportunity to improve their quotations, but all exchanges will be fair and equitable.
Only Quoters whose quotations receive an overall technical rating of acceptable or higher will be considered for award. Following an evaluation and, if necessary, tradeoff analysis, FHFA may make one or more than one award based on the quotations(s) that is (are) evaluated to be the best value and determined responsible.
FHFA reserves the right to make an award based on other than the lowest quoted price.
Technical (Volume I) is more important than price (Volume II); however, the importance of price as a factor could become greater if competing quotations are evaluated as technically equal.
