1. This is a combined synopsis/solicitation for commercial products or commercial services prepared in accordance with the format in subpart 12.6, as supplemented with additional information included in this notice.

This announcement constitutes the only solicitation and is being issued using simplified acquisition procedures.

2. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2024-05 effective 22 May 2024, DFARS Change effective 15 August 2024, DFARS PGI effective 15 August 2024, and DAFAC 2024-0612 effective 12 June 2024.

6. Interchanges: The government intends to award a purchase order without Discussions with respective offerors.

However, the Government may conduct Clarifications with one, some, none, or all offerors at its discretion.

7. FAR 52.212-1, Instructions to Offerors--Commercial Products and Commercial Services applies to this acquisition.

a. Provide pricing and any discount terms utilizing the CLIN breakout under Paragraph 3 of this combined synopsis/solicitation.

b. Provide vendor information specified under Paragraph 4 of this combined synopsis/solicitation.

c. Provide a technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, catalog cuts, or other documents necessary.

8. FAR 52.212-2, Evaluation—Commercial Products and Commercial Services applies to this acquisition.

a. The Government will award a contract from this solicitation to the responsible offeror whose offer conforming to the solicitation is most advantageous to the Government based on the best overall offer that is determined to be the best value to the Government. The following factors shall be used to evaluate offers and are listed in descending order of importance:

i. Acceptability in accordance with (IAW) this solicitation.

Rating Description

Acceptable Offer clearly meets the minimum requirements of the solicitation and specifications provided in Attachment 1 – Salient Characteristics.

Unacceptable Offer does not clearly meet the minimum requirements of the solicitation and specifications provided in Attachment 1 – Salient Characteristics.

ii. Price

The Contracting Officer shall conduct a determination of price reasonableness in accordance with FAR

12.209. Offerors are cautioned that the award may not necessarily be made to the lowest price offered.

The Government is more concerned with obtaining the best value than with making an award at the lowest overall price to the Government. However, the Government will not make an award at a significantly higher overall price to obtain an offer that exceeds the minimum requirements of the solicitation and/or specifications.

b. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

c. BASIS FOR AWARD / EVALUATION PROCEDURES:

i. The Government will first evaluate offers for acceptability. Offers will then be evaluated based on price. Award will then be made to the technically acceptable offer determined to represent the best value to the Government. If only one “Acceptable” offer is received, the Government will attempt to determine price to be fair and reasonable through means other than competition.

ii. Award will be made on the initial evaluation of quotes received in response to this RFQ.

Therefore, offerors are cautioned to ensure that initial quotes contain your best terms from a technical and price standpoint. Offerors are further advised that any affirmative response in regard to FAR 52.204-24(d) will be reviewed to determine if award is in the best interest of the government. If award is not in the best interest of the government, the government reserves the right to determine the quote ineligible for award.

9. FAR 52.212-3, Offeror Representations and Certifications – Commercial Items is included in this solicitation.

The contractor must have a valid Representations and Certifications filed in the System for Award Management (SAM) and/or furnish the government a completed copy of the record with its offer.

10. FAR 52.212-4, Contract Terms and Conditions-Commercial Items applies to this acquisition. No addenda to this clause.

13. All firms must be registered and active in the System for Award Management (SAM) database at https://www.sam.gov/SAM/ to be considered for award. Quote must be directly submitted by the firm registered in SAM that is intended to be the successful awardee. Quotes submitted by another firm on behalf of a SAM registered company with the intention of being award “care of” will not be accepted. All quotes must include registered Unique Entity Identity, CAGE code, Tax ID, and small business status.

15. A Response to this RFQ must be received via e-mail no later than 11:00 A.M. Chamorro Standard Time (ChST) on 3 September 2024. Oral quotes will not be accepted. Emailed quotes must be received at the stated addressees email inbox on time and the addressees must be able to open the email and all attachments. No other email receipt will be acceptable. The Government does not accept responsibility for non-receipt of offers. It is the vendor’s responsibility to request and receive confirmation of quote receipt.
