(2) However, a late modification of an otherwise successful offer that makes its terms more favorable to the Government will be considered at any time it is received and may be accepted.

(g) Contract award is deleted in its entirety

(h) Multiple Awards is deleted in its entirety

4. 52.212-2 Evaluation Commercial Items Addendum The following addenda applies to the provision: For this procurement, the Best Value determination will be made based on the Lowest Priced, Technically Acceptable (LPTA) process.

The Government will award no more than three (3) blanket purchase agreements from this RFQ to the responsible offeror(s) whose quote conforming to the RFQ will be most advantageous to the Government. The following factors shall be used to evaluate quotes: technical acceptability and price. Only technically acceptable quotes are eligible for award and only quotes received from Offerors that provided unit pricing for ALL line items within the Schedule B will be considered.

a. The following process will be followed:

(i) Quotes will be reviewed to ensure that all line items have been priced. Quoters that submitted prices for ALL line items in the Schedule B attachment will initially be ranked based on total evaluated price (TEP). Total evaluated price will be determined by adding all the line-item unit prices in Schedule B for an overall amount, then ranked lowest to highest by TEP.

(ii) If three (3) or fewer quotes are received, the Government will evaluate all quotes for technical acceptability. If more than three (3) quotes are received, the Government will evaluate the three

(3) lowest ranked quotes for technical acceptability. However, the Government reserves the right to evaluate additional quotes for technical acceptability if deemed to be in the Government’s best interest. If additional quotes are evaluated for technical acceptability they will be selected in the order of price.

Award will be made to the responsible vendor whose quote is the lowest evaluated price among technically acceptable quotes

• Acceptable: Quote clearly meets the minimum requirements of the solicitation.

• Unacceptable: Quote does not clearly meet the minimum requirements of the solicitation

5. Technical Factor. The Government will evaluate the quotes for technical acceptability, assigning ratings as described in paragraph 4 above. The failure of a quote to meet any or all of the technical criteria below will result in a technically unacceptable rating and preclude award.

Factor 1. Technical Approach and Methodology The contractor must submit detailed plans for conducting hazardous materials testing, including specific methodologies, tools, and techniques for testing lead, asbestos, PCB, mercury, mold, and soil. The approach should ensure compliance with relevant regulations and guarantee reliable and accurate results.

Standard Met:

The contractor provides a comprehensive approach with clear methods, tools, and quality control measures, ensuring reliable testing and compliance with applicable standards.

Factor 2. Qualified Personnel and Certifications The Contractor shall be licensed by the Texas Department of State Health Services (TDSHS). The Contractor must provide proof that personnel performing hazardous materials inspections, sampling, or assessments possess the applicable TDSHS certifications for lead, asbestos, and mold, as well as any other required certifications for hazardous materials testing.

Standard Met:

The standard is met when the Contractor provides proof of a current Texas Department of State Health Services (TDSHS) license and documentation showing that personnel performing hazardous materials inspections, sampling, or assessments possess the applicable TDSHS certifications for lead, asbestos, mold, and any other required hazardous materials testing.

Factor 3. Quality Control Plan (QCP) The contractor must submit a detailed Quality Control Plan (QCP) outlining how they will ensure compliance with the PWS and government standards. The QCP should include procedures for monitoring and evaluating the quality of hazardous materials surveys, managing potential issues, corrective actions, and ensuring timely report submissions.

Standard Met:

The contractor provides a well-structured QCP with specific monitoring, evaluation, and corrective actions to ensure continuous compliance with the PWS and quality standards. The plan also includes clear processes for timely and accurate report submissions.

6. Price Reasonableness. The Government will use one or more of the techniques defined in FAR 13.106-3 and/or 15.404-1, to determine whether the lowest priced, technically acceptable quotes are fair and reasonable.

7. Interchanges. It is the Government’s intent to award without interchanges. The Government may consider, throughout the evaluation, the “correction potential” of any quotes to this BPA solicitation. The judgement of such “correctional potential” is within the sole discretion of the Government and may be held with all, some, or none of the Quoters. If any aspect of an Offeror’s quote does not meet the Government’s requirements and is not considered correctable, the offer will be ineligible for a BPA award. The Government may determine one or a few Quoters have the highest potential to provide the best value to the Government. The Government may conduct interchanges with those Quoters that, at the discretion of the Contracting Officer, have the highest potential to represent the best value. These interchanges may address technical or price matters, and any required BPA documentation including any other matter in the evaluation process.

Resolution of minor or clerical issues would not constitute interchanges and the Government reserves the right to award the BPAs without the opportunity to revise quotes.

8. Mandatory Registrations. To be eligible for award, registration with the System for Award Management (SAM) must be current (legacy for On-line Registration and Certifications Application (ORCA) and Central Contractor Registration (CCR) registrations). To register or update former CCR and Reps & Certs that are not current go to https://www.sam.gov/portal/public/SAM/ and provide mandatory information.
