RFQ Solicitation Summary

This is a Request for Quotations (RFQ) issued by the Export-Import Bank of the United States (EXIM) to establish a Blanket Purchase Agreement (BPA) for Peru recovery services. The solicitation number is 83310127Q0005, issued October 1, 2026, with questions due October 13, 2026, and quotations due October 22, 2026, at 10:00 AM Eastern. Electronic submission via email to Travis Finkle is required. The work will be performed primarily in Peru with support available at EXIM offices in Washington, DC.

The BPA scope encompasses collection, servicing, legal enforcement, restructuring, asset protection, and recovery services for EXIM claims involving obligors, guarantors, assets, or enforcement activity located exclusively in Peru. Services include borrower negotiations, settlement efforts, asset searches, site visits, legal proceedings, litigation, and seizure/enforcement actions. The acquisition is limited to Peru only; proposals covering other regions are outside scope. EXIM intends to establish one BPA with an estimated aggregate ordering amount not exceeding approximately $7,500,000 over a five-year period from November 15, 2026, to November 14, 2031. The BPA is not a guarantee of future work. Pricing consists of two components: CLIN 0001—a firm-fixed-price Due Diligence Fee per case (vendor-proposed); and CLIN 0002—a Contingency Fee as a percentage of recovered assets, paid only upon successful recoveries. Vendors may submit supplemental pricing for bundled cases or follow-on tasks and propose alternative pricing plans. Quotations must remain valid for 90 days and be submitted as separate technical and price documents in PDF format. Evaluation uses a best-value tradeoff approach considering Technical and Management Approach (most important), Past Performance, and Price, with technical and past performance combined significantly more important than price alone. Vendors must demonstrate established Peru capability, properly licensed professionals, conflict-of-interest management, and measurable recovery outcomes. Federal Government experience is evaluated favorably but is not required. The NAICS code is 541110 (Offices of Lawyers; size standard $15.5 million) and PSC is R418 (Support, Professional: Legal).

This acquisition is limited to Peru. Quotations proposing coverage outside are outside the scope of this RFQ and will not receive evaluation consideration.

This acquisition will be conducted under FAR 13.303 and FAR Subpart 13.5, using simplified acquisition procedures and a best-value tradeoff approach consistent with FAR 13.106-2.

1.1 NAICS Code and Product Service Code

• NAICS: 541110 - Offices of Lawyers (size standard: $15.5 million)

• PSC: R418 - Support, Professional: Legal

1.2 Type of Agreement

EXIM intends to establish one BPAs. The number of BPAs established, if any, will be based on evaluation results, anticipated competition at the call level, and the Government's best interests. A BPA is not a contract and does not obligate funds. The Government is obligated only to the extent of authorized purchases actually made under an awarded BPA.

The estimated aggregate ordering amount under each BPA may not exceed approximately $7,500,000 during the five-year BPA period. This estimate is provided for planning purposes only and is not a minimum guarantee, maximum guarantee, or promise of future work.

EXIM may issue multiple calls/orders during the BPA period. Each call/order will identify the applicable case, authorized work, deliverables, schedule, ceiling or fixed price, and other case-specific conditions.

1.3 Communications, Language, and Currency

All communications, quotations, reports, invoices, and deliverables shall be in English. All proposed and awarded monetary values shall be stated in United States Dollars (USD).

1.4 SAM Registration and Invoicing

1.5 BPA Cancellation and Order Termination

Either party may cancel a BPA in whole or in part by providing written notice. BPA cancellation does not, by itself, terminate an existing call/order. Any cancellation or termination of a call/order will be governed by the terms of that call/order and applicable FAR clauses, including FAR 52.212-4 when incorporated.

1.6 Period of Performance

The anticipated BPA period is five (5) years from the effective date stated in each BPA, and may be extended up to six (6) months per clause 52.217-8.. The period of performance for each call/order will be stated in that call/order. A call/order issued before BPA expiration may continue through its specified period of performance, subject to its terms and available funding.

1.7 Place of Performance

The principal place of performance is Peru. Work may also be performed at the Contractor's facilities or at EXIM offices in Washington, DC, when necessary to support Peru -related recovery activity. The Contractor shall furnish all personnel, supervision, facilities, systems, travel, local counsel, and other resources required for performance unless a call/order expressly identifies Government-furnished property or information.

2. BPA PRICING AND CALL/ORDER STRUCTURE

CLIN 0001 (Firm-Fixed-Price): This Due Diligence Fee is applicable to new cases and on a per case basis. Follow-On tasks are not always applicable with this fee.

CLIN 0002 (Firm-Fixed-Price): The Contingency Fee is the % of recovered assets, paid only on successful recoveries.

CLIN PRICING - BPA Establishment Evaluation Pricing (Estimated BPA Period of Performance: November 15, 2026 – November 14, 2031; final period will be specified in each BPA and applicable BPA call/order)

The following rates are requested for BPA establishment and evaluation. The awarded BPA will state the accepted rates or ceilings. Each call/order will establish the final authorized price and payment terms for the assigned case. No work may begin before issuance and acceptance of an authorized call/order.

****Submit the below chart with your price quotation****

***END OF PERFORMANCE WORK STATEMENT***

4. ORDERING PROCEDURES

Calls/orders may be issued among BPA holders determined capable of performing the Peru requirement. For each call/order, EXIM may consider the case-specific technical approach, demonstrated Peru capability, relevant past performance, price, availability, conflicts of interest, and ability to meet the required response time.

The Contracting Officer will identify the quotation response period for each call request. BPA holders should generally be prepared to submit a call quotation within two (2) to five (5) business days when that period is stated in the call request.

The existence of a BPA does not guarantee that a BPA holder will receive a call/order. Each call/order is subject to applicable competition, funding, authorization, and documentation requirements.

4.1 Conflicts of Interest

For each call request, the BPA holder shall promptly identify any actual or potential conflict of interest involving the obligor, guarantor, related party, counsel, creditor, or transaction. The Government may require mitigation, additional information, or nonparticipation in a call competition.

4.2 Key Personnel and Local Partners

The BPA holder shall identify the personnel and Peru -based legal or operational resources proposed for each call.

Substitution of key personnel or local counsel may require prior written approval when specified in the BPA or call/order.

5. QUOTATION PREPARATION AND SUBMISSION

Vendors shall furnish all information required by this RFQ. Quotations shall be submitted electronically in PDF format to Travis Finkle at Travis.Finkle@exim.gov by the date and time stated on the cover page. Facsimile quotations will not be accepted.

Technical and price quotations shall be submitted as separate documents. The technical quotation shall not contain pricing information. Vendors shall acknowledge all amendments in the price quotation.

Quotations shall remain valid for ninety (90) calendar days after the quotation due date unless the Government agrees otherwise in writing.

5.1 Technical Quotation

• Company name, address, UEI, CAGE Code, business size, and active SAM registration status;

• Technical and Management Approach responsive to the Peru PWS;

• Detailed explanation of the vendor's ability to operate in Peru;

• Identification of Peru -based offices, personnel, investigators, collection resources, local counsel, partnerships, or other operational arrangements;

• Explanation of how the vendor will comply with applicable Peru licensing and authorization requirements;

• Past Performance submission responsive to Factor Two;

• Identification of proposed key personnel and their Peru -relevant qualifications; and

• Disclosure of known actual or potential organizational conflicts of interest.

5.2 Price Quotation

• Completed BPA Establishment Pricing Sheet for CLINs 0001 and 0002 or alternate proposed pricing plan;

• Any clearly identified supplemental or bundled pricing;

• Acknowledgment of all amendments; and

• Statement that proposed pricing is stated in USD and remains valid for the required acceptance period.

5.3 Submission Compliance

A quotation that fails to provide material information required for evaluation may be found unacceptable. Responses that merely repeat RFQ language or state that the vendor will comply, without supporting detail, may be assessed as insufficient. The Government may seek clarifications or conduct exchanges when the Contracting Officer determines they are necessary.

6. EVALUATION FACTORS AND BASIS OF AWARD

The Government will evaluate quotations using a best-value tradeoff approach under FAR 13.106-2. Quotations may first be assessed for compliance with mandatory submission requirements and minimum Peru capability requirements. The Government intends to establish BPAs without discussions but reserves the right to conduct exchanges.

The evaluation factors are:

1. Factor One - Technical and Management Approach

2. Factor Two - Past Performance

3. Factor Three - Price

6.1 FACTOR ONE (1) - TECHNICAL AND MANAGEMENT APPROACH

The Government will evaluate the quotation for consistency with the PWS and the likelihood of successful performance in Peru. The Government may identify strengths, weaknesses, significant weaknesses, deficiencies, and performance risks. The evaluation will consider:

• The credibility, clarity, and completeness of the proposed approach to asset identification, due diligence, collection, restructuring, enforcement, reporting, and cross-border coordination;

• Demonstrated ability to operate in Peru, including established local capability, access to qualified personnel, and ability to use properly licensed or legally authorized professionals;

• Understanding of Peru -specific legal, regulatory, judicial, insolvency, collections, and enforcement considerations relevant to the PWS;

• Management of local counsel, subcontractors, investigators, or operational partners;

• Quality controls, information security, conflict screening, communications, and reporting; and

• Ability to meet required response times and manage multiple case assignments.

A quotation that does not demonstrate a credible ability to perform the required services in Peru may be rated Unsatisfactory and excluded from further consideration.

6.2 FACTOR TWO (2) - PAST PERFORMANCE

The Government will evaluate the Vendor's demonstrated record of performing services similar in size, scope, complexity, and legal environment to the Peru recovery requirements in this solicitation. The evaluation will focus on relevance, quality, timeliness, effectiveness of recovery efforts, customer satisfaction, and measurable recovery or collection outcomes. Inaccurate, misleading, or unverifiable reference information may adversely affect the evaluation.

The Government will consider experience involving asset recovery, debt recovery, legal enforcement, sovereign claim recovery, collection services, financial recovery services, restructuring activities, litigation support, or other comparable recovery-related services. Projects should demonstrate successful recovery outcomes, collection efforts, enforcement actions, restructurings, settlements, or other measurable performance results. Projects consisting primarily of advisory services, legal opinions, or administrative support without demonstrated recovery-related outcomes may be considered less relevant.

Due to the unique legal, regulatory, reporting, oversight, diplomatic, and operational considerations associated with performing recovery services on behalf of the United States Government, past performance performed for U.S. Federal Government agencies will be evaluated more favorably than otherwise similar work performed for commercial entities, foreign governments, state or local governments, non-governmental organizations, export credit agencies, or private-sector clients. Federal Government experience is not required for BPA establishment. The Government considers successful performance for U.S. Federal Government agencies to be a stronger indicator of the Vendor's ability to satisfy the Government-client requirements of this solicitation.

The Vendor shall submit up to two (2) completed or ongoing projects demonstrating successful recovery, enforcement, collection, restructuring, asset recovery, or similar recovery-related activity performed in Peru. If the Vendor does not have two qualifying Peru projects, it may submit relevant projects performed elsewhere in South America or in another foreign jurisdiction involving comparable cross-border legal, financial, or recovery complexity.

Direct Peru experience will be evaluated more favorably than otherwise similar experience performed outside Peru.

The Government will give greater evaluation weight to projects demonstrating:

• Successful performance on behalf of a U.S. Federal Government agency;

• Recovery, enforcement, collection, restructuring, or asset-recovery activity performed in Peru;

• Work similar in size, scope, complexity, and legal environment to this requirement;

• Documented and measurable recovery outcomes;

• Successful operation within the Peru legal, regulatory, and judicial environment; and

• Strong quality, timeliness, and customer satisfaction.

Projects demonstrating both relevant Peru experience and successful performance for a U.S. Federal Government agency may receive the highest relevance assessment. The absence of Federal Government experience will not, by itself, make a Vendor ineligible for BPA establishment or result in an unfavorable past performance assessment;

however, a Vendor without such experience will not receive the additional evaluation credit associated with successful U.S. Federal Government performance.

Past Performance Submittal

For each project submitted, the Vendor shall provide the following information, not to exceed three (3) pages per project:

• Project title and contract or project number, if applicable;

• Client or agency name;

• Country and location of performance;

• Award or start date and completion date, or indication that the project is ongoing;

• Contract type and approximate value, if disclosure is permitted;

• Description of services performed and the Vendor's role;

• Recovery, enforcement, collection, restructuring, settlement, or other measurable outcomes;

• Identification of whether the work was performed as a prime contractor, subcontractor, local counsel, or other team member; and

• Customer reference name, title, telephone number, and email address, if available.

The Government may obtain and consider past performance information from sources other than those identified by the Vendor, including CPARS, customer references, questionnaires, Government records, and Government knowledge. The Government will evaluate the source, currency, relevance, context, and quality of available information. Projects determined to be more relevant may receive greater consideration than less relevant projects.

6.3 FACTOR THREE (3) - PRICE

The Government will evaluate the proposed Due Diligence Fee and Contingency Fee for fairness and reasonableness.

The Government may consider whether the proposed pricing is consistent with the technical approach and demonstrates an adequate understanding of Peru -specific recovery risks and complexity. The Government may use one or more price analysis techniques.

6.4 Evaluation Ratings

Rating Abbreviation Definition

Superior S

Greatly exceeds minimum requirements, presents a high probability of success, and contains no significant weaknesses or deficiencies.

Above Average AA

Exceeds minimum requirements, presents an above-average probability of success, and contains no significant weaknesses and only minor correctable weaknesses.

Average A Meets minimum requirements and presents an acceptable probability of successful performance.

Unsatisfactory U Fails to meet material requirements, requires major revision, or presents a low probability of successful performance.

6.5 Basis of BPA Establishment

The Government intends to establish BPAs with Vendors whose quotations represent the best value to the Government, considering the tradeoff among Technical and Management Approach, Past Performance, and Price.

Technical and Management Approach is more important than Past Performance. Technical and Management Approach and Past Performance, when combined, are significantly more important than Price. Price may become more important as non-price quotations become more equal.

The Government may establish fewer BPAs than anticipated, establish no BPAs, or establish BPAs without discussions. Vendors should submit their best technical and price terms in their initial quotations.

7. CONTRACT ADMINISTRATION

The Contracting Officer is the only person authorized to establish, modify, or cancel a BPA and to issue or modify a call/order, except to the extent another official is expressly authorized in writing. Direction from any unauthorized individual does not change the BPA or call/order and does not authorize additional cost or performance.

A Contracting Officer's Representative (COR) or other technical representative may be appointed for day-to-day technical administration. The COR is not authorized to change price, scope, schedule, terms, or conditions unless separately authorized in writing by the Contracting Officer.

Contracting Office Address:

Office of Contracting Services Export-Import Bank of the United States 811 Vermont Avenue, NW Washington, DC 20571
