About this file

This is a Request for Quotations (RFQ) issued by the Export-Import Bank of the United States to establish multiple Blanket Purchase Agreements (BPAs) for asset protection and recovery legal services worldwide. The solicitation number is 83310126Q0058, with a quotation due date of Monday, August 31, 2026, at 10:00 AM Eastern Time. Questions are due by Monday, August 17, 2026, at 4:30 PM Eastern Time. Quotations must be submitted electronically via email to Travis Finkle at travis.finkle@exim.gov. The work is classified under NAICS code 541110 (Offices of Lawyers) with a size standard of $15.5 million and PSC code R418 (Support-Professional: Legal).

The Government intends to award multiple BPAs (up to eight awardees) with an estimated ordering amount per vendor of approximately $7.5 million over a five-year period. The BPA period of performance extends up to five years, potentially extendable by six months. Vendors must identify countries where they can perform services and provide details of local legal and operational capabilities. Two Call/Order Line Items (CLINs) structure the pricing: CLIN 0001 is a firm-fixed-price Due Diligence Fee (per case basis), and CLIN 0002 is a contingency fee based on a percentage of recovered assets, paid only upon successful recovery. At BPA establishment, vendors propose contingency fee percentages for evaluation only; detailed pricing is required at the call/order level, with 2-5 business days for turnaround. The contractor must perform collection, servicing, legal, and recovery services including borrower negotiations, asset searches, investigations, legal proceedings, litigation, enforcement actions, and credit restructuring related to defaulted loan obligations from obligors and guarantors worldwide. Evaluation is based on technical and management approach (including geographic coverage and demonstrated capability), past performance (requiring at least two relevant projects for each proposed country), and price. Vendors must demonstrate relevant experience with successful recovery or collection outcomes, not merely advisory services. Technical and management approach is weighted more heavily than past performance, which combined are significantly more important than price.

EVALUATION FACTORS & BASIS OF AWARD

Evaluation (Best-Value Tradeoff)

The Government will evaluate quotations using a best-value tradeoff approach under FAR 13.106-

2. Prior to the tradeoff evaluation, the Government may assess quotations for compliance with mandatory submission requirements and country-specific minimum experience requirements.

Quotations may be evaluated and selected on a country-by-country basis.

Failure to demonstrate the required capability for a proposed country may result in the quotation being rated Unsatisfactory for that country and excluded from further consideration for that country.

The Government intends to establish BPAs with up to five vendors whose quotations represent the best value to the Government. The Government may establish BPAs without discussions;

therefore, vendors should submit their best terms in their initial quotation.

• Factor 1 - Technical & Management Approach Factor 1 includes geographic coverage and demonstrated capability in the countries proposed for support.

• Factor 2 - Past Performance

• Factor 3 - Price

Evaluation Factors:

FACTOR ONE (1) – TECHNICAL & MANAGEMENT APPROACH

The Government will evaluate the vendor’s quotation for consistency with the requirements described in the Performance Work Statement (PWS). Under the tradeoff approach, the Government may consider the relative strengths, weaknesses, significant weaknesses, and deficiencies of each quotation. In this category, the Government will consider:

1. Technical & Management Approach. The quotation shall outline a credible and comprehensive approach to performing international asset recovery services, including methodologies for asset identification, recovery, enforcement, reporting, and cross-border execution in accordance with the PWS.

2. Geographic Coverage. The Government will evaluate the vendor’s demonstrated ability to perform in the countries proposed, including:

- Strength of in-country capability or partnerships

- Applicability of regional or cross-border experience

- Demonstrated ability to operate within foreign legal systems

For regional submissions, the vendor must clearly explain:

- The geographic scope of the work (countries covered)

- How the work involved cross-border legal, financial, or recovery operations

- The applicability of that experience to the proposed country.

FACTOR TWO (2) – PAST PERFORMANCE

The Past Performance evaluation will consider the vendor’s track record in performing similar services, focusing on relevance, timeliness, quality of past work, and measurable recovery or collection outcomes. The Government may evaluate performance in work of comparable size, scope, complexity, and geographic context. Inaccurate reference information may be assessed negatively. Vendors must demonstrate relevant past performance supporting asset recovery, debt recovery, legal enforcement, or comparable financial enforcement services. Projects should demonstrate successful recovery outcomes or measurable collections activity, not merely advisory or legal support.

For each country proposed for support, the vendor shall provide:

• At least two (2) completed or ongoing projects performed for the U.S. Federal Government demonstrating successful recovery, enforcement, or collection activities within that country; OR

To demonstrate the necessary experience the vendor must submit two (2) similar projects on which the vendor was the prime contractor.

Submittal Required by Vendor:

The vendor shall submit the following data and information for each project submitted (not to exceed three (3) pages per project):

• Project Title

• Location of the project

• Date of Contract Award

• Completion Date

• The Government reserves the right to obtain and use past performance information from sources other than those identified by the vendor. Projects deemed not relevant may receive little or no evaluation credit. The Government may consider CPARS records, customer references, relevant facts, circumstances, and other information available to the Government.

The Government reserves the right to obtain and use past performance information from sources other than those identified by the vendor. Projects deemed not relevant will not be considered for further evaluation. The government will also consider subjective information such as relevant facts, circumstances, and knowledge of the vendor and any corresponding CPARs past performance assessments

FACTOR THREE (3) - PRICE

The Government will evaluate price to determine whether the proposed pricing is fair and reasonable. At the BPA establishment phase, the Government will evaluate the proposed contingency fee percentage for reasonableness and consistency with the vendor’s proposed technical approach. The Government may consider whether the proposed fee reflects an adequate understanding of the risks and complexities associated with international recovery efforts. The Government may use one or more price analysis techniques to determine fairness and reasonableness.

To fully assess and evaluate the merits of the submitted quotation, the CO may seek clarifications from vendors. The Government intends to evaluate quotations and establish BPAs without discussions. Therefore, the vendor’s initial quotation should contain the vendor’s best terms from both a price and technical standpoint. The Government reserves the right to conduct exchanges if the CO later determines them to be necessary.

Evaluation of Quotations:

Each quotation will be evaluated against the evaluation factors and standards described in this RFQ. Evaluators will use their judgment in assessing each quotation against the stated factors and documenting the basis for assigned ratings and any tradeoff decisions.

The ratings will be developed in accordance with the following adjectival rating standards.

These standards are intended to promote uniformity in evaluation, support a clear comparison of quotations, and document the rationale for a best-value tradeoff decision.

Ratings: The rating of each non-price factor will be based on the adjectival ratings below:

Superior, Above Average, Average, and Unsatisfactory.

Rating Abbreviation Definition

Superior

S

The quotation greatly exceeds all minimum requirements of the criteria; has a high probability of success; contains no significant weaknesses or deficiencies.

Above Average

AA

The quotation exceeds all the minimum requirements of the criteria; has an above average probability of success; contains no significant weaknesses and only minor, correctable weaknesses exist.

Average

A

The quotation meets all the minimum requirements of the criteria; has an average probability of success; no significant weaknesses and any deficiencies can be readily corrected.

Unsatisfactory

U

The quotation fails to meet a number of the minimum requirements of the criteria; quotation needs major revisions; very low probability of success.

Basis of Award:

The Government intends to establish BPAs with the vendors whose quotations provide the best value to the Government, considering the tradeoff among Technical & Management Approach, Past Performance, and Price. Technical & Management Approach is more important than Past Performance. Technical & Management Approach and Past Performance, when combined, are significantly more important than Price. Price will be evaluated for fairness and reasonableness and may become more important as non-price quotations become more equal. The Government may establish BPAs without discussions or exchanges.
