About this file
This is a Scope of Work attachment for a solicitation issued by the State of Oregon (through the Oregon State Police) for the procurement of pistol holsters under a brand name or equal specification. The agency seeks approximately 850 new pistol holsters molded to fit Smith & Wesson M&P9 M2.0 9mm pistols with 4.25-inch barrels, configured to accommodate Aimpoint COA optics and Streamlight TLR-1 HL weapon lights. The holsters must meet duty-grade retention standards requiring at least two distinct operator actions from a normal firing grip, be available in both right and left hand configurations, and be manufactured from rigid thermoplastic laminate or equivalent material in black non-reflective finish. All holsters must be new, factory-sealed, and unissued, with belt loop attachment compatible with 2.25-inch duty belts. The specification includes provisions for manufacturer verification samples at no cost to the agency prior to bulk shipment.
The procurement includes a trade-in component with two condition tiers for used and unissued Safariland holster models (6360, 6377, and 6378 series). Offerors must quote per-unit credits for trade-in property, which the agency will evaluate as a net cost calculation by deducting the extended trade-in value from the new holster purchase price. Trade-in property will be sorted and staged by the agency at Oregon State Police headquarters in Salem for offeror pickup at the offeror's expense, including all freight and handling costs. The agency will turn in trade-in property within 90 calendar days after accepting the final new holster shipment. Delivery of new holsters is not contingent on receipt of trade-in property, and payment will be issued at the net amount without withholding pending trade-in completion. The procurement is subject to Oregon Small Business Enterprise preference requirements per OAR 125-246-0230(5)(d) and conditional on the agency obtaining required state surplus property disposal authorization.

ATTACHMENT A - MINIMUM SALIENT CHARACTERISTICS
Solicitation S-25700-00017993, Pistol Holsters
This solicitation is brand name or equal under ORS 279B.215(1). The named brand establishes the standard of quality, performance and functionality. The Agency determines whether an offered product is equal or superior, and that determination is final under ORS 279B.215(1)(b).
Each characteristic below is a minimum. Products that do not meet every minimum will be found not equivalent.
1. WEAPON FIT. Molded to fit Smith & Wesson M&P9 M2.0, 9mm, 4.25 in barrel, 17 round, black, SKU 14777. The pistol must seat fully and index positively with no fore and aft or lateral play.
2. OPTIC CLEARANCE. Cut to clear an Aimpoint COA enclosed-emitter optic mounted on the pistol. The optic housing and window must not contact the holster body, hood or retention hardware at any point during draw or reholster.
3. WEAPON LIGHT. Molded to fit the pistol with a Streamlight TLR-1 HL mounted. The holster must retain the pistol with the light installed, and must not require removal of the light to holster or draw.
4. RETENTION. Duty grade. Release must require at least two distinct, deliberate operator actions performed from a normal firing grip, with no change of hand position between actions.
Retention must engage automatically on reholster without a secondary manual step. Passive friction retention alone does not meet this minimum.
5. HAND. Available in both right hand and left hand in the same model, same finish and same retention configuration.
6. MATERIAL AND FINISH. Rigid thermoplastic laminate or equivalent rigid duty material. Black, plain, non-reflective. The holster must hold its form under duty carry and retain the weapon if inverted.
7. BELT ATTACHMENT. Compatible with the mounting hardware currently on Agency duty belts:
2.25 in belt loop. The quoted unit price must include all hardware necessary to mount the holster on a 2.25 in duty belt. Holsters requiring replacement of existing belt hardware must state so in the quote and itemize the replacement hardware at no additional cost.
8. DURABILITY AND ENVIRONMENT. Rated by the manufacturer for full time law enforcement duty carry. Serviceable in wet, freezing and dusty conditions without loss of retention function.
9. CONDITION. New, unissued, factory sealed, in original manufacturer packaging, free of marks, debris or adhesive residue.
10. WARRANTY. Full manufacturer warranty, minimum one year, covering retention hardware and holster body.
11. FIT VERIFICATION. Before bulk shipment the Agency reserves the right to request two sample holsters, one right hand and one left hand, shipped by Offeror at no cost, for Agency verification against the actual duty pistol, optic and light. The Agency may reject the offered product and terminate if the samples do not meet these minimums.
12. TRADE-IN PROPERTY (ITEMS 2 AND 3)
12.1 Property offered. The Agency will turn in Safariland duty holsters of the 6360, 6377 and 6378 series, in assorted weapon fits and both hands, sorted into the two condition tiers below.
The models listed on the Items tab are representative examples and are not an exhaustive list.
12.2 Used (Item 2). Previously issued and carried. Expect scuffing, finish loss and cosmetic wear consistent with law enforcement duty carry. Each unit will be complete with its original belt mounting hardware, and with retention hardware present and operating.
12.3 Unissued (Item 3). Never issued and never carried. In original manufacturer packaging where available. No carry wear. Some units are discontinued weapon fits.
12.4 Quantities. Quantities shown on the Items tab are estimates. Final counts will be established at turn-in. The per unit credit quoted for each tier is firm and applies to the actual count turned in, up to 110 percent of the estimated quantity for that tier. If the Agency turns in fewer units than the estimated quantity for a tier, the credit for that tier is reduced proportionally and the offeror's recovery is governed by Section 13.5.
12.5 Classification and reclassification. The Agency will sort each unit into a tier before turn-in. If the offeror determines that a unit tendered as Unissued does not meet Section 12.3, that unit is credited at the Item 2 Used rate. Units are not rejected on condition grounds except where a unit is incomplete, has missing or inoperable retention hardware, or is physically damaged beyond cosmetic wear.
12.6 Exclusions. Weapons, optics, weapon lights, magazines and ammunition are not part of the trade-in. Holsters will be turned in empty.
12.7 Turn-in logistics and freight.
(a) Location and timing. Turn-in will occur at OSP HQ, 3545 Trelstad Ave SE, Salem, OR 97317 on dates agreed after award, subject to the sequencing and deadline in Section 13.
Property will be available for pickup during normal business hours.
(b) Agency responsibility. The Agency will sort trade-in property by condition tier, count it, package it and stage it for pickup at the turn-in location.
(c) Offeror responsibility. The offeror bears all cost of transporting trade-in property from the turn-in location to the offeror's facility, including carrier charges, fuel surcharges, accessorial charges, and liftgate or inside pickup charges if required. The offeror will either arrange carrier pickup at its own expense or provide prepaid shipping labels. If requested by the Agency, the offeror will supply pallets, cartons and other shipping materials at no cost to the Agency.
(d) Freight included in credit. Return transportation cost is deemed included in the per-unit credits quoted on Items 2 and 3. The offeror may not deduct, invoice, offset or otherwise charge freight, packaging, handling or restocking costs against the trade-in credit after award.
(e) Scope. The F.O.B. Destination, freight prepaid term applicable to Item 1 governs delivery of new holsters only. It does not apply to trade-in property, which is governed by this Section 12.7 and by Section 13.7.
12.8 Condition precedent. The trade-in is contingent on the Agency obtaining the State surplus property disposal authorization required under ORS 279A.280 and applicable State policy. If that authorization is not obtained, Items 2 and 3 will be deleted and the purchase order will issue for Item 1 only at the quoted Item 1 unit price, with no adjustment to that price.
12.9 How credits are quoted and evaluated. Trade-in credits on Items 2 and 3 are quoted as positive per-unit amounts. The quote total generated by OregonBuys will show these as positive values and will not reflect the trade-in deduction. For evaluation the Agency will compute net cost as the Item 1 extended price less the extended value of Items 2 and 3. The resulting purchase order will be issued at that net amount.
13. SEQUENCING OF DELIVERY AND TURN-IN
13.1 Delivery is not contingent on trade-in. Delivery of new holsters under Item 1 is not contingent on the Agency first delivering trade-in property. The offeror will not condition shipment, release or invoicing of Item 1 on receipt, inspection or valuation of trade-in property.
Any quote that conditions delivery on prior receipt of trade-in property does not meet the requirements of this solicitation.
13.2 Order of performance. Trade-in property will be turned in only after the Agency has accepted new holsters under Item 1. The Agency will not ship or release trade-in property before acceptance.
13.3 Agency turn-in deadline. The Agency will turn in trade-in property within 90 calendar days after acceptance of the final Item 1 shipment. The Agency may turn in property in one consolidated shipment or in multiple shipments within that period, at Agency election. The parties may extend this period by mutual written agreement.
13.4 Partial deliveries. If Item 1 is delivered in more than one shipment, the 90 calendar day period in Section 13.3 runs from Agency acceptance of the final shipment, not from the first.
13.5 Remedy for Agency shortfall. If the Agency turns in fewer units than the estimated quantity for a tier within the period in Section 13.3, as extended, the offeror may invoice the Agency for the shortfall at the per-unit credit rate quoted for that tier. The offeror's recovery under this section may not exceed the total trade-in credit applied to the purchase order. This is the offeror's sole remedy for Agency shortfall or delay in turn-in.
13.6 Payment. The purchase order will issue at the net amount, meaning the Item 1 extended price less the extended value of Items 2 and 3. Payment is due on acceptance of Item 1 in accordance with ORS 293.462. No portion of payment will be withheld pending turn-in, and the offeror will not withhold delivery pending turn-in.
13.7 Title and risk of loss. Title to trade-in property passes to the offeror upon receipt by the offeror or its carrier at the turn-in location. Risk of loss in transit on trade-in property is the offeror's. Until that receipt, the trade-in property remains State of Oregon property.
