About this file
This document is a Brand Name Justification to support a Request for Quotation (RFQ) for NanoString's CosMx Spatial Gene Expression Library Preparation Kits (6K). The National Cancer Institute's (NCI) Cancer Data Science Laboratory (CDSL) requires these kits to conduct ongoing research into tumor heterogeneity and evolution. The CDSL has been utilizing the NanoString platform and changing to a different brand would result in incomparable data and duplicated research efforts. The total estimated value for this requirement is and the anticipated delivery period is 30 days after receipt of order. This is a Firm-Fixed-Price commercial item purchase conducted under simplified acquisition procedures as a Total Small Business Set-Aside with a NAICS code of 325413 (In Vitro Diagnostic Substance Manufacturing). A combined synopsis/solicitation will be publicly posted on SAM.gov, and the Contracting Officer will determine price reasonableness prior to award.

a. Project title:
NanoString CosMx Spatial Gene Expression Library Preparation Kits (6K)
b. Project description:
NanoString’s CosMx is a commercially available high-plex in situ analysis platform that can provide spatial multiomics with formalin-fixed paraffin-embedded (FFPE) and fresh frozen (FF) tissue samples at cellular and subcellular resolution. CosMx SMI enables rapid quantification and visualization of up to 1,000 RNA and 64 validated protein analytes. It is the flexible, spatial single-cell imaging platform that will drive deeper insights for cell aliasing, tissue phenotyping, cell-cell interactions, cellular processes, and biomarker discovery. In order to continue their research, the CDSL requires four (4) CMx RNA, four (4) Inst Buffer Kit, Med, two

The anticipated delivery period for the items is thirty (30) days after receipt of order.
4. Identification of the statutory authority permitting other than full and open competition.
X This acquisition is conducted under FAR 13.106-1 (b)(1)(i)
(b) Soliciting from a single source.
(1) For purchases not exceeding the simplified acquisition threshold.
(i) Contracting officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).
5. Demonstration that the proposed contractor(s) unique qualifications or the nature of the acquisition requires use of the authority cited.
a. Name and address of the Brand Name contractor(s).
NanoString 530 Fairview Ave N, Suite 200 Seattle, WA 98109
b. Nature of the acquisition and proposed unique qualifications of the contractor(s).
The NCI, CCR’s, Cancer Data Science Laboratory (CDSL) has been conducting scientific research utilizing NanoString’s CosMx Spatial gene expression library preparation reagent kits (6K) in order to try and better understand tumor heterogeneity and tumor evolution. As such these kits are required to conduct further research, and to ensure scientifically comparable data to previous efforts are obtained. Utilization of a different brand or method by the CDSL for their ongoing research would result in scientifically incomparable data. A change from this platform to another at this time would require research efforts to be duplicated and additional cost to the Government. As such, no other brand of reagents is able meet the Government’s requirement at this time.
6. Description of the efforts made to ensure that offers are solicited from as many potential sources as practicable. Indicate whether a SAM.gov notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies.
As required by FAR Subpart 5.2, a SAM.gov combined synopsis solicitation will be publicized and cited as a commercial item purchase (as stated FAR Part 12) with the authority to use simplified procedures of commercial items as authorized in FAR 13.106-1 (b)(1)(ii). In accordance with FAR 5.102(a)(6), this brand name justification is being published with the solicitation.
7. Determination by the Contracting Officer that the anticipated cost/price to the Government will be fair and reasonable.
Prior to award the Contracting Officer (CO) will make a determination that the price is fair and reasonable. It is anticipated that determination will be made utilizing the IGE and historical data; however, the CO reserves the right to utilize any other means deemed appropriate in accordance with FAR 13.106-3 (a)(2).
8. Description of the market research conducted (see FAR Part 10) and the results, or a statement of the reasons market research was not conducted.
Market research for this effort included a review of historical data for similar past procurements conducted by the NCI’s CDSL and other Government entities for the purchase of the required materials. Additionally, a Source Sought Notice (SSN) #75N91024Q00139 was posted to SAM.gov on 06/26/2024 thru 06/28/2024, which upon closing received no responses.
9. Any other facts supporting the use of other than full and open competition.
All relevant information supporting the procurement of the brand name product are captured above.
10. Listing of sources, if any, that expressed, in writing, an interest in the acquisition.
At this time, no sources expressed interest in writing for the proposed acquisition.
All sources who respond to the combined synopsis solicitation will be considered.
11. Statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the required supplies or services.
NCI anticipates their needs will successfully be met as a result of an open market combined synopsis solicitation. If upon completion of the anticipated Purchase Order, it is identified that similar items are needed, the NCI will conduct market research to reevaluate if there are other manufacturers and products that can meet the requiring program’s needs, or better suit their research needs.
12. Program office certification.
This is to certify that the portions of this justification that have been developed by the undersigned program office personnel, including supporting information and/or data verifying the Government’s minimum needs, schedule requirements and other rationale for other than full and open competition, are accurate and complete.
