(a) The Government will award a contract resulting from this solicitation to the responsible quoter whose offer conforms to the solicitation and is most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
1. Technical
2. Price
All non-price factors are approximately equal.
All non-price factor(s) when combined are approximately equal to price.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options will not obligate the
Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful quoter within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
Addendum to FAR 52.212-2
Factor 1 – Technical:
The Technical factor will be evaluated to determine the extent to which the quoter’s proposal demonstrates compliance with the requirements of the Statement of Work (SOW) and includes the correct items or services. The Government will assess the completeness, accuracy, and appropriateness of the proposed technical approach.
Factor 2 – Price:
The Price factor will be evaluated to ensure the offer includes an itemized price breakdown that is complete, fair, and reasonable in relation to the items or scope of work proposed. The total evaluated price will include the base period, any option periods, optional quantities, and any applicable pro-rated amount under FAR clause 52.217-8, Option to Extend Services.
Basis for Award:
The Government intends to make a single award to the quoter whose proposal is determined to be most advantageous to the Government, considering both Technical and Price factors.
Quoters are advised that the Government reserves the right to award without discussions.
Therefore, proposals should be submitted with the quoter’s most favorable terms regarding both technical capability and pricing.
Once the Government determines the quoter that is best-suited (i.e., the apparent successful quoter), it reserves the right to communicate only with that quoter to address any remaining issues necessary to finalize the task order. These issues may include, but are not limited to, technical clarifications or price adjustments.
If the apparent successful quoter is unable to satisfactorily resolve the remaining issues—as determined at the sole discretion of the Government—the Government reserves the right to cease communications and initiate discussions with the next best-suited quoter based on the original evaluation.
Once communications begin with the next best-suited quoter, the Government will not resume discussions with any previously considered quoters unless and until a task order has been awarded. This process will continue until the Government successfully finalizes an agreement and awards a task order.
