Scope of Work
Annual Boiler Safety Device Third Party Review in Accordance with The VHA Boiler Plant
Safety Device Testing Manual 7th Edition
Requirements:
The contractor shall be responsible for the boiler plant safety device testing of 2 water tube boilers
35,000 PPH located at the Temple facility Building 58, and 3 fire tube boilers 24,150 PPH located at the
Waco facility Building 225. The vendor shall provide the VA COR with a completed summary and deficiencies report. The work will not be considered completed by the Government until the VA COR accepts the work. The vendor shall provide all transportation and materials to perform this job. The contractor shall be familiar with all the terms, conditions, and requirements within this contract. The government reserves the right to add additional locations within the Central Texas Veterans Healthcare
System if ever needed in the future. Pricing for servicing those locations will be reviewed and evaluated at such time the need exists. The safety device testing of the facilities boilers (Waco &
Temple) does not involve connectivity of a device/system to the VA computer network and does not involve sensitive VA data.
New Work – Base Bid for an Annual Test
This contract will be for a 1-year base with four additional 1-year option renewals.

Qualifications as Stated in VHA Directive 1810(1)
• Section 4(e)
Qualified Third-Party Review. A qualified third-party review means the utilization of a vendor that has documented knowledge and experience in the design and construction of boiler plants and VA’s standards for construction and testing of safety devices. In addition, the individual shall have demonstrated experience in conducting equipment assessments and performing testing in compliance with the VA safety device testing manual on at least 5 sites within the past 3 years.
This testing DOES NOT require a National Board Inspector.
SPECIFICATIONS
1. GENERAL INFORMATION:
A. VA Hours of operation: Regular hours: Monday - Friday, 8:00a.m. to 4: 30p.m.
After Hours: Times vary and must be scheduled with Contracting Officer
Representative (COR); generally, after 4:00 p.m. and before 7:00 a.m.
B. Contractor shall provide all services including supervision, labor, travel, mileage, overtime and required parts/materials and testing equipment.
C. Document conditions, values and recommendations on Contractor provided forms and submit to the COR at the completion of inspection.
D. Invoices submitted without correct purchase order/obligation document number and contract/purchase order number will not be processed.
2. GENERAL REQUIREMENTS
1. The contractor shall conduct safety checks on all safety devices in the system in order to ensure that the system is safe.
2. The contractor shall provide a complete schedule of projected work 1 month prior to arriving on station to conduct testing. This shall include but not limited to the following.

3. Upon arriving on station, the vendor will meet with the COR or appointed representative to conduct an entry brief prior to work being started.
4. The service receipt and the VA compliant test report containing the certification form found in section 1.3.2 of the VHA Boiler Plant Safety Device Testing Manual
7th Edition shall be on the first page following the cover page of the report.
3. REQUIREMENTS FOR SAFETY TESTING
3.1 Properly test and analyze each safety device to determine VA Compliance.
There are three questions that the person conducting the safety test must be able to answer affirmatively for a safety device to be VA compliant.
1) Is the correct device installed?
• A device approved by the VA that meets all VA requirements and standards
• The device is in the right location as defined by VA requirements and standards
• The device is set up to accommodate testing
• Any valve isolating the device is lockable only in open position
• If the device is a switch, it must open when it actuates.
• Any signal used in process control cannot be used as an input to a safety system.
• Independent safety control includes the fact that the safety control must be located in an enclosure that contains no other type of control.
• Any shunt on low water cutoffs (bypass switch) must be a non-latching device.
No other shunts are allowed.
• The use of a snubber, dampener, pneumatic accumulator or other such device to dampen the pressure provided to a safety switch or gage used in testing the switch is not VA compliant.
2) Does the device activate at the proper set point that is in accordance with the criteria for the set point as defined herein and VA standards?
3) Does the device produce the proper result for its intended purpose?
If any of the three questions are not answered affirmatively for a safety device, the device in question FAILS to be VA compliant. If there is a failure of any safety device that can’t be fixed immediately, the boiler must be removed from service or an Interim Safety
Measure (ISM) developed, approved, and instituted until the repair is completed. The contractor will not be responsible for repairs, as repairs will be conducted by another contractor.
4. BASIC SAFETY TESTING INFORMATION
The final report should include the information required in Table A.3.1 found in the attached VHA
Boiler and Associated Plant Safety Device Testing Manual 7th Edition.
The contractor shall be required to comply with all guidelines and testing procedures set forth in the attached VHA Boiler and Associated Plant Safety Device Testing Manual 7th Edition. The contractor shall be required to report safety device failure immediately upon discovery.

C.3 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. (a) Definition. for the Department of Veterans Affairs, ‘‘Service-disabled Veteran-owned small business concern or SDVOSB’’:
(1) Means a small business concern—
(i) Not less than 51 percent of which is owned by one or more service-disabled Veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled Veterans or eligible surviving spouses (see VAAR
802.201, Surviving Spouse definition);
(ii) The management and daily business operations of which are controlled by one or more service-disabled Veterans (or eligible surviving spouses) or, in the case of a service-disabled
Veteran with permanent and severe disability, the spouse or permanent caregiver of such

(iii) The business meets Federal small business size standards for the applicable North
American Industry Classification System (NAICS) code identified in the solicitation document;

SDVOSB shall comply with requirements in VAAR subpart 819.70 and SBA regulations on small business size, and government contracting programs at 13 CFR part 121 and part 125, including the non-manufacturer rule and limitations on subcontracting (LOS) requirements in 13
CFR 121.406(b) and 13 CFR 125.6. For the purpose of limitations on subcontracting, only certified SDVOSBs listed in the SBA certification database (including independent contractors) shall be considered eligible and/or ‘‘similarly situated’’ (i.e., a firm that has the same small business program status as the prime contractor). An otherwise eligible firm further agrees to comply with the required LOS certification requirements in this solicitation (see 852.219–75 or
852.219–76 as applicable). These requirements are summarized as follows:
(1) Services. In the case of a contract for services (except construction), the SDVOSB prime contractor will not pay more than 50% of the amount paid by the government to the prime for contract performance to firms that are not certified SDVOSBs listed in the SBA certification database (excluding direct costs to the extent they are not the principal purpose of the acquisition and the SDVOSB/ VOSB does not provide the service, such as airline travel, cloud computing services, or mass media purchases). When a contract includes both services and supplies, the 50 percent limitation shall apply only to the service portion of the contract.
(2) Supplies/products.
(i) In the case of a contract for supplies or products (other than from a non-manufacturer of such supplies), the SDVOSB prime contractor will not pay more than 50% of the amount paid by the government to the prime for contract performance, excluding the cost of materials, to firms that are not certified SDVOSBs listed in the SBA certification database. When a contract includes both supply and services, the 50 percent limitation shall apply only to the supply portion of the contract.
(ii) In the case of a contract for supplies from a non-manufacturer, the SDVOSB prime contractor will supply the product of a domestic small business manufacturer or processor, unless a waiver as described in 13 CFR 121.406(b)(5) has been granted. Refer to 13 CFR
125.6(a)(2)(ii) for guidance pertaining to multiple item procurements.
(3) General construction. In the case of a contract for general construction, the SDVOSB prime contractor will not pay more than 85% of the amount paid by the government to the prime for contract performance, excluding the cost of materials, to firms that are not certified
SDVOSBs listed in the SBA certification database.
(4) Special trade construction contractors. In the case of a contract for special trade contractors, no more than 75% of the amount paid by the government to the prime for contract performance, excluding the cost of materials, may be paid to firms that are not certified
SDVOSBs listed in the SBA certification database.
(5) Subcontracting. An SDVOSB subcontractor must meet the NAICS size standard assigned by the prime contractor and be certified and listed in the SBA certification database to count as similarly situated. Any work that a first tier SDVOSB subcontractor further subcontracts will count towards the percent of subcontract amount that cannot be exceeded. For supply or construction contracts, the cost of materials is excluded and not considered to be subcontracted. When a contract includes both services and supplies, the 50 percent limitation shall apply only to the portion of the contract with the preponderance of the expenditure upon which the assigned NAICS is based. For information and more specific requirements, refer to 13
CFR 125.6.
(e) Required limitations on subcontracting compliance measurement period. An SDVOSB shall comply with the limitations on subcontracting as follows:
[X] By the end of the base term of the contract or order, and then by the end of each subsequent option period; or
[] By the end of the performance period for each order issued under the contract.
(f) Joint ventures. A joint venture may be considered eligible as an SDVOSB if the joint venture complies with the requirements in 13 CFR 128.402 and the managing joint venture partner makes the representations under paragraph (c) of this clause. A joint venture agrees that, in the performance of the contract, the applicable percentage specified in paragraph (d) of this clause will be performed by the aggregate of the joint venture participants.
(g) Precedence. The VA Veterans First Contracting Program, as defined in VAAR 802.101, subpart 819.70, and this clause, takes precedence over any inconsistencies between the requirements of the SBA Veteran Small Business Certification Program and the VA Veterans
First Contracting Program.
(h) Misrepresentation. Pursuant to 38 U.S.C. 8127(g), any business concern, including all its principals, that is determined by VA to have willfully and intentionally misrepresented a company’s SDVOSB status is subject to debarment from contracting with the Department for a period of not less than five years (see VAAR 809.406–2 Causes for Debarment).

(a) Pursuant to 38 U.S.C. 8127(l)(2), the offeror certifies that—
(1) If awarded a contract (see FAR 2.101 definition), it will comply with the limitations on subcontracting requirement as provided in the solicitation and the resultant contract, as follows:
(i) [X] Services. In the case of a contract for services (except construction), the contractor will not pay more than 50% of the amount paid by the government to it to firms that are not certified SDVOSBs listed in the SBA certification database as set forth in 852.219–73 or certified VOSBs listed in the SBA certification database as set forth in 852.219–74. Any work that a similarly situated certified SDVOSB/VOSB subcontractor further subcontracts will count towards the 50% subcontract amount that cannot be exceeded. Other direct costs may be excluded to the extent they are not the principal purpose of the acquisition and small business concerns do not provide the service as set forth in 13 CFR 125.6.

(2) The offeror acknowledges that this certification concerns a matter within the jurisdiction of an Agency of the United States. The offeror further acknowledges that this certification is subject to Title 18, United States Code, Section 1001, and, as such, a false, fictitious, or fraudulent certification may render the offeror subject to criminal, civil, or administrative penalties, including prosecution.
