SECTION M - EVALUATION FACTORS FOR AWARD
M.1 GENERAL EVALUATION INSTRUCTIONS
The Government does not anticipate requesting revisions to proposals conducting discussions.
However, the Government reserves the right to enter into discussions, and request proposal revisions if determined necessary to establish reasonable pricing.
M.2 BASIS FOR AWARD
1. This acquisition will utilize the Lowest Price Technically Acceptable Source Selection Process utilizing commercial streamlined evaluation procedures under FAR 12.602 – Streamlined Evaluation of Offers. Award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors. Trade-offs are not permitted.
The Federal Acquisition Regulation (FAR), Health and Human Services Acquisition Regulation supplement (HHSAR) are available electronically (http://farsite.hill.af.mil). By submission of its offer, the offeror accedes to all solicitation requirements, including terms and conditions of the basic contract and as contained herein, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or subfactors. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale.
The Source Selection Authority (SSA) will base the source selection decision on an integrated assessment of proposals against all source selection criteria in the solicitation (described below).
2. While the Government source selection evaluation team and the SSA will strive for maximum objectivity, the source selection process, by its nature, is subjective and, therefore, professional judgment is implicit throughout the entire process. The Government reserves the right to award without discussions therefore; each initial offer should contain the offerors best terms from a price and technical standpoint. The Government reserves the right to negotiate any and all aspects of the proposal (technical and price)
M.2.1 Clauses incorporated by full text:
FAR 52.212-2 -- Evaluation -- Commercial Items (Oct 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
(i) Factor 1: technical capability of the item offered to meet the Government requirement;
(ii) Factor 2: business/price
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

The Government reserves the right to consider mitigation plans proposed by the apparent successful offeror. If this acquisition is governed by FAR Part 15, the process of approving an OCI mitigation plan and revisions to such a plan does not constitute discussions as described in FAR 15.306.
M.3.3 Solicitation Requirements, Terms and Conditions
