The minimum requirement for applicants is recognition by the California Native American Heritage Commission. This RFQ is not subject to Disabled Veterans' Business Enterprise incentives, small business incentives, or TACPA preferences. The contract will not have mandatory DVBE participation goals, though the Commission maintains a DVBE participation program for veterans' contracting opportunities.

REQUEST FOR QUALIFICATIONS
Introduction and Background
Established in 1938, the California State Lands Commission (Commission) is composed of the Lieutenant Governor, the State Controller, and the Governor’s Director of Finance. The Commission is primarily a land and resource trust manager. It manages approximately 4 million acres of California's state-owned (sovereign) Public Trust lands and resources that were received upon admission into the Union in 1850. It also manages other lands that the federal government conveyed to the State (commonly known as school lands) and oversees the management of Public Trust lands legislatively granted in trust to over 70 local jurisdictions. The Commission also enforces the protections of the Public Trust Doctrine, the State’s property rights, and important environmental quality and marine pollution prevention laws.
The California Environmental Quality Act (CEQA) requires a lead agency to prepare, or cause to be prepared, and certify the completion of, an environmental impact report (EIR) on a project that it proposes to carry out or approve that may have a significant effect on the environment or to adopt a negative declaration if it finds that the project will not have that effect. The Commission regularly acts as the lead agency on a multitude and variety of projects throughout the state.
Executive Order B-10-11 (September 19, 2011), reaffirmed by Executive Order N-15-19 (June 18, 2019), directed all state agencies to encourage and participate in communication and consultation with California Native American tribes on matters that may affect tribal communities. Assembly Bill (AB) 52 (Statutes on 2014) specified that a project with an effect that may cause a substantial adverse change in the significance of a tribal cultural resource is a project that may have a significant effect on the environment.
AB 52 recognizes that California Native American tribes possess unique expertise regarding their own history and cultural practices, particularly those connected to the tribal cultural resources with which they are traditionally and culturally affiliated. Because CEQA calls for a sufficient degree of analysis, tribal knowledge about the land and tribal cultural resources at issue should be included in environmental assessments for projects that may have a significant impact on those resources. AB 52 further requires a lead agency, if requested by a tribe that is traditionally and culturally affiliated with the geographic area of a proposed project, to engage in CEQA-related consultation with that tribe.
Government Code section 4525, pertaining to Architectural and Engineering (A&E) procurement, defines “Environmental Services” as those services performed in conjunction with project development and permit processing in order to comply with federal and state environmental laws. Therefore, as tribal cultural resources monitoring clearly falls within A&E purview, the Commission is issuing a Request for Qualifications to California Native American tribes for on-call engagement related to CEQA projects that affect or impact a Tribe.
