STATEMENT
1.3 STATEMENT OF WORK:
1.3.1 Background/Introduction
The U.S. Embassy Nairobi (Mission) is soliciting tax consultancy and withholding services for the Tax Year 2026 as the Mission continues to withhold income taxes and other required statutory deductions on behalf of all U.S. Government employees who are obligated to pay income tax and statutory deductions under Kenya law. The Mission requires the services of a contractor to provide guidance on employee tax obligations and withholdings, calculate required withholdings, and remit taxes and deductions to the Kenya Revenue
Authority (KRA) and other authorities in compliance with Kenya’s laws and regulations.
1.3.2 General scope/objectives
The contractor will work in coordination with Mission management, payroll staff, human resources, and the Bureau of the Comptroller and Global Financial Services (CGFS) to conduct bi-weekly tax calculations for approximately 900 local employees, maintain an escrow account to collect bi-weekly withholdings sent from CGFS, and remit required taxes and statutory deductions to KRA and other applicable authorities on a monthly basis or in compliance with Kenya law.
The contractor will be required to work with management, payroll, and human resources contacts from two entities falling under the Mission umbrella, namely U.S. Department of
State and Peace Corps Kenya. Department of State has approximately 839 LE staff, while
Peace Corps Kenya has approximately 28 locally engaged staff and approximately 33 intermittent contractors who are compensated under a separate pay schedule and whose payroll processes are managed by Peace Corps Kenya. Relevant pay schedules will be shared before February 2026.
The contractor shall provide tax calculation, collection, and remittance services for all employees who fall under the local compensation plan of the U.S. Embassy Nairobi or are contracted local employees or intermittent contractors of Peace Corp Kenya.
1.4 TASKS TO BE PERFORMED BY CONTRACTOR:
The Contractor must have legal authority to operate in Kenya and shall provide all the services usually provided by an independent tax withholding consultant including, but not limited to the following:
1.4.1 Initial Set Up

• Create and configure a tax computation database to include applicable prevailing tax rates/tables including deductions and reliefs in line with Kenyan PAYE and other statutory deduction regulations.
• Configure the database to receive and process Mission payroll data (from CGFS) and output files for returning withholding calculations to Mission payroll offices.
• Establish a process in coordination with Mission Payroll and Human Resources staff for payment calculation methodology for bi-weekly income tax, statutory employee deductions, and employer contributions for each employee.
• Set up a system to collect relevant employee information on existing facilities such as mortgage interest, education, and insurance policies that may qualify for relief or exemptions when calculating tax due.
• Establish and maintain appropriate accounts with wiring instructions in place for receipt and consolidation of bi-weekly tax withholdings to allow monthly remittances to KRA and other authorities.
• Create and maintain an onboarding process in coordination with the Mission to ensure newly hired employees are promptly and accurately added to the employee database and required withholdings are initiated.
• Create and maintain an exit process in coordination with the Mission to ensure proper tax and statutory withholdings and remittances of all final payments to separating employees.
• If applicable, set up a dummy payroll for the transition period between the incumbent service provider and the incoming service provider. The dummy payroll will be tested at the inception of the contract for the overlapping pay period(s) during the transition period.

• Receive relevant employee information on existing facilities such as mortgage interest, education, and insurance policies that may qualify for relief or exemptions when calculating tax due.
• Maintain appropriate accounts with wiring instructions in place for receipt and consolidation of bi-weekly tax withholdings to allow monthly remittances to KRA and other authorities.
• Electronically provide employees with biweekly statutory deduction memos/tax calculation slips showing the PAYE and all statutory deductions calculated on the relevant earnings for the subject pay period.
• Generate payment registration number (PRN) for remitting PAYE, Housing Levy, and National Industrial Training Authority (NITA) on iTax and for remitting Social Health Insurance Fund (SHIF) and National Social Security Fund (NSSF) on Eslip.
• Provide a dedicated point of contact/account manager for the contract, as well as a clear backup structure and an escalation matrix.
• Ensure security and confidentiality of all employees’ personal information.
• Acquire and maintain a security bond, bank guarantee, insurance, or a suitable commercial vehicle to safeguard the Mission and its employees from any form of malpractice or liability.
• Maintain an email address through which employees can seek clarification/ask questions regarding their individual PAYE withholding calculations and statutory deductions.
1.4.2.1 The contractor shall provide the following services bi-weekly.
• On receipt of biweekly LE staff salaries and benefits payment file from the Mission, compute amount of tax and other deductions to be withheld from each employee’s gross biweekly employment income and share the file with the designated Mission contacts.

• The Contractor will advise the Mission of relevant policy changes and answer questions from Management staff as it pertains to the execution of employer withholding.
• Ad hoc service fees may be charged for deliverables outside the scope of the contract
(e.g. training on specific topics outside the current scope). Any additional services provided under this arrangement will be separately priced and bilaterally agreed upon prior to delivery.
