National Oceanic Atmospheric Administration (NOAA) National Marine Fisheries Service (NMFS)

Human Capital Management Office Statement of Work

Industrial Organizational Psychologist Support Services

INTRODUCTION and BACKGROUND

The Department of Commerce (DOC), NOAA NMFS has a requirement for industrial organizational psychologist support services to support the Human Capital Management Office (HCMO). HCMO provides headquarters-level planning, development, implementation, direction, and oversight of NOAA Fisheries' human capital management guidance, programs, initiatives, and systems. HCMO’s primary functions and programs include: awards, training, performance management, executive resources, strategic workforce planning, telework, workforce reporting and analytics, and organizational changes.

Beginning in the Fall of 2020 and through the end of Fiscal Year (FY) 2021, HCMO undertook a study to understand workforce performance in the context of Diversity, Equity, Inclusion, and Accessibility (DEIA). The study was designed to better learn more about possible inequities across all represented groups. Conversations surrounding HCMO’s analysis showed that NOAA Fisheries’ offices overwhelmingly found the information presented to be very helpful and aligned to the priorities of equity and diversity, which they support in their organizations.

Requests for additional analyses, specific questions to research, and deeper insights into the data were commonplace throughout the presentation sessions.

Among the findings within the analysis was the lack of expertise within NOAA Fisheries to better understand drivers of inequity and recommendations for changing established practices and cultural norms that might negatively impact DEIA. A key recommendation as a result of the HCMO study was the need to hire Industrial Organizational Psychologist support services to undertake a comprehensive study of NOAA Fisheries culture and norms that impact DEIA in terms of performance scoring, succession planning, and employee retention.

This Statement of Work (SOW) is directly linked to NOAA Fisheries Strategic Plan Goal #3 of improving organization excellence and regulatory efficiency. To that extent, this SOW will help elevate NOAA Fisheries since DEIA is a key component of this goal. Through the identification of an appropriate Industrial Organizational Psychologist, NOAA Fisheries will gain a stronger capacity to align a diverse workforce to mission needs and foster the promotion of an inclusive and safe workspace.

PAGE 8 OF 57 1305M323QNFFK0011

According to the Society for Industrial and Organizational Psychologists (SIOP), “I-O Psychologists specialize in understanding human behavior at work and creating evidence-based practices to help organizations and workers thrive”. NOAA Fisheries requires this level of expertise to conduct research and data analysis in the areas of DEIA. The contractor will provide their findings on NOAA Fisheries issues related to “providing equal access to key opportunities, increasing diversity in leadership roles, and creating an environment of trust and belonging”.

OBJECTIVE

To undertake a comprehensive study of NOAA Fisheries culture and norms that impact DEIA and Organizational Excellence, the contractor will conduct advanced research studies and apply social science methods to understand fundamental causes of variation in DEIA workforce performance and inform strategies for organizational effectiveness. The contractor will also look across related workforce surveys and a wide array of data collected by HCMO (e.g. employee performance scores and compensation, climate survey results, exit surveys, etc.) to incorporate new insights into action planning and management practices with the aim of improving diversity, equity, inclusion, and accessibility in our organization. The contractor will conduct any necessary studies to understand how NOAA Fisheries culture influences equity across the organization including understanding how functions within the organization impact retention.

Lastly, the contractor will identify barriers to change the organizational culture including increasing diversity within the organization, creating a “One Fisheries” ethos.

INDUSTRIAL ORGANIZATIONAL PSYCHOLOGIST QUALIFCATIONS

The contractor must have successfully completed a full 4-year course of study in an accredited college or university leading to a bachelor's or higher degree that included a psychology major or equivalent in psychology for all specializations, except clinical psychology and counseling psychology.

ACTIVITIES

● Design, develop, and implement methods to identify and understand DEIA workforce findings with high fidelity, such as surveys, discussion forums, qualitative data collection, and sentiment analysis.

● Conduct data analysis and visualization to explore, monitor, and explain DEIA human capital issues.

● Develop and apply models based on theories, and subsequent analysis, to increase NOAA Fisheries knowledge of current and future human capital issues. Respond to senior leadership customer and partner questions and requests, as necessary.

● Provide consultations and advice to measure and analyze integral parts of strategic human capital management.

PAGE 9 OF 57 1305M323QNFFK0011

● Present summary reports, detailed analysis, analytics products, and findings to senior leadership and partners through the use of meetings, briefings, multimedia communications and collaborative technologies.

● Create presentations, reports, and other summaries and tools to aid senior leadership in communicating results to internal and external stakeholders.

DELIVERABLES

● Analysis of NOAA Fisheries workforce DEIA perspectives.

● Identification of organizational norms and processes that have the potential to undermine the stated goal to foster DEIA in NOAA Fisheries.

● Recommendations for NOAA Fisheries to strengthen its organizational culture and processes to address and mitigate identified human capital issues.

● The contractor will conduct any necessary studies to understand how NOAA Fisheries culture influences equity across the organization including understanding how functions within the organization impact retention.

● Strategies and tools to communicate and implement agreed-upon key recommendations aimed at mitigating some of the identified human capital issues.

● Develop a framework that guides how to support capacity/resource needs for DEIA human capital work in NOAA Fisheries.

● Identify barriers to change the organizational culture including increasing diversity within the organization, creating a “One Fisheries” ethos, and provide recommendations for addressing those barriers.

● Progress on deliverables will be reported out on a monthly basis with quarterly reports submitted to leadership.

ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT

YOUR EVALUATION OF THE CONTRACTOR’S PERFORMANCE

RATING DEFINITION NOTE

(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.

An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating.

Also, there should have been NO significant weaknesses identified.

(VG) Very Good Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.

A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.

(S) Satisfactory Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.

A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract.

There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.

(M) Marginal Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor's proposed actions appear only marginally effective or were not fully implemented.

A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.

(U) Unsatisfactory Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor's corrective actions appear or were ineffective.

An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.

(N) Not Applicable No information or did not apply to your contract Rating will be neither positive nor negative.

52.203-6 I RESTRICTIONS ON SUBCONTRACTOR SALES TO THE GOVERNMENT (JUN 2020)-- ALTERNATE I (NOV 2021)

(a) Except as provided in (b) of this clause, the Contractor shall not enter into any agreement with an actual or prospective subcontractor, nor otherwise act in any manner, which has or may have the effect of restricting sales by such subcontractors directly to the Government of any item or process (including computer software) made or furnished by the subcontractor under this contract or under any follow-on production contract.

(b) The prohibition in paragraph (a) of this clause does not preclude the Contractor from asserting rights that are otherwise authorized by law or regulation. For acquisitions of commercial products or commercial services, the prohibition in paragraph (a) applies only to the extent that any agreement restricting sales by subcontractors results in the Federal Government being treated differently from any other prospective purchaser for the sale of the commercial product(s) and commercial service(s).

(c) The Contractor agrees to incorporate the substance of this clause, including this paragraph (c), in all subcontracts under this contract which exceed the simplified acquisition threshold, as defined in Federal Acquisition Regulation 2.101 on the date of subcontract award.

(End Of Clause)

52.209-5 CERTIFICATION REGARDING RESPONSIBILITY MATTERS (AUG 2020)

(a)

(1) The Offeror certifies, to the best of its knowledge and belief, that--

(i) The Offeror and/or any of its Principals--

(A) Are /_/ are not /_/ presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

(B) Have /_/ have not /_/, within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract; violation of Federal or State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery,falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property (if offeror checks ''have'', the offeror shall also see 52.209-7, if included in this solicitation);

(C) Are /_/ are not /_/ presently indicted for, or otherwise criminally or civilly charged by a governmental entity with, commission of any of the offenses enumerated in paragraph (a)(1)(i)(B) of this provision.

(D) Have /_/, have not /_/, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds the threshold at 9.104-5(a)(2) for which the liability remains unsatisfied.

(1) Federal taxes are considered delinquent if both of the following criteria apply:

(i) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(ii) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(2) Examples.

(i) The taxpayer has received a statutory notice of deficiency, under I.R.C. 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(ii) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(iii) The taxpayer has entered into an installment agreement pursuant to I.R.C. 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(iv) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).

(ii) The Offeror has /_/ has not /_/, within a three-year period preceding this offer, had one or more contracts terminated for default by any Federal agency.

PAGE 16 OF 57 1305M323QNFFK0011

(2) "Principal," for the purposes of this certification, means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).

This Certification Concerns a Matter Within the Jurisdiction of an Agency of the United States and the Making of a False, Fictitious, or Fraudulent Certification May Render the Maker Subject to Prosecution Under Section 1001, Title 18, United States Code.

(b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.

(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the certification will be considered in connection with a determination of the Offeror's responsibility. Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.

(d) Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a) of this provision. The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.

(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If it is later determined that the Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.

(End of Provision)

52.209-11 REPRESENTATION BY CORPORATIONS REGARDING DELINQUENT TAX LIABILITY OR A FELONY CONVICTION

UNDER ANY FEDERAL LAW (FEB 2016)

(a) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that--

(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or

(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.

(b) The Offeror represents that--

(1) It is [ ] is not [ ] a corporation that has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability; and

(2) It is [ ] is not [ ] a corporation that was convicted of a felony criminal violation under a Federal law within the preceding 24 months.

Volume 1: Non-Price Technical Solution Volume 2: Price (Attachment C - Pricing Schedule (complete attached Excel file and SF1449)

Vendors shall submit a Non-Price Technical Solution that clearly demonstrates that the vendor has a thorough understanding of the effort required to successfully meet all tasks outlined in the SOW. Vendors shall provide sufficient information for the Government to determine its level of confidence in the ability of the vendor to perform the requirements of the RFQ based on an assessment of the vendor’s technical approach.

Vendors shall assume that the Government has no prior knowledge of them or their capability. The Government will base its evaluation on the information presented in the Non-Price Technical Solution; as such, it must be fully self-sufficient and provide all necessary information for a comprehensive evaluation.

To be acceptable, the quote must meet all of the requirements of this solicitation, including instructions in the attachments.

Failure to follow instructions regarding the format and content of the quote may result in the quote not being considered for award. Quotes that merely offer to perform in accordance with the requirements of the SOW, merely state that requirements are understood and will be complied with, paraphrase the SOW or parts thereof, or use phrases such as “standard industry practices will be employed” and “well established techniques will be employed,” etc., may be considered unacceptable responses.

Volume 1 shall be subdivided into the following:

A. Technical Approach (Page Limit: 6 pages. Resume excluded from Page Limit) B. Past Performance (Page Limit: 6 Pages)

Electronic copies shall include all information required for evaluation, excluding any reference to price.

A. Technical Approach:

The technical approach must be sufficient enough so as to show how the vendor proposes to accomplish the effort described in the SOW. Specifically, vendors shall provide, and elaborate, on the following:

Key personnel to include one (1) resume and one (1) letter of commitment for the following labor category: (Industrial Organizational Psychologist)

Technical expertise for the Activities section of the SOW, including, but not limited to industry standards and technical methods

PAGE 20 OF 57 1305M323QNFFK0011

B. Past Performance:

The quoter shall demonstrate recent and relevant past performance or affirmatively state that it possesses no relevant past performance. Relevant past performance is performance under contracts or efforts within the past three (3) years prior to the RFQ closing date and demonstrated at least one (1) year of completed performance that is the same as or similar to, the size and scope of the work described by this RFQ.

To demonstrate its past performance, the quoter shall identify up to three (3) of its most relevant contracts within the past three (3) years from the RFQ closing date. Quoters shall provide a detailed explanation demonstrating the relevance of the contracts to the requirements of the RFQ. For purposes of this RFQ, a contract is defined as a purchase order, a contract, a single task order or call order placed under an ID/IQ contract, a Blanket Purchase Agreement (BPA), or a Federal Supply Schedule. The Government reserves the right to not consider multiple delivery orders, call orders, task orders, and/or technical direction letters that are combined to be used as one (1) past performance.

1. If proposed subcontractor past performance is provided as part of the three (3) of its most relevant contracts or efforts and type of work to be done by the subcontractor on the solicitation requirement must be stated. The quoter’s submittal shall clearly detail the aspects of the work in the solicitation that the subcontractor is proposed to perform. A Past Performance example which does not clearly detail the aspects of the work in the solicitation that the subcontractor is proposed to perform will not be evaluated.

2. If the prime vendor or intended subcontractor/partner submits a past performance example in which it served as a subcontractor, the prime/sub/partner shall clearly detail the work that it performed and the size (dollar value) of that subcontracted work only. A Past Performance example that does not differentiate between the overall contract effort and the subcontractor effort will not be evaluated.

Subcontractor performance (either the quoter's own subcontractor experience or proposed subcontractor’s experience) of major or critical aspects of this requirement will be considered the same as prime contractor past performance information for the quoter. Failure of quoters to provide the required information and level of specificity will result in the contract reference not being evaluated.

The following minimum information shall be provided within contractor submitted references:

• Contract Number/Order Number

• Date of Contract Award

• Name and Address of the Government Agency or Commercial Entity

• Contract Type

• Annual Contract Cost

• Period of Performance

• Description of Work

• Valid name, phone number and e-mail address of Contracting Officer, Contracting Officer’s Representative or Prime Contractor (if company was subcontracted).

• In the description of work, quotes should provide a detailed explanation demonstrating the similarity of the contract, in terms of scope and size to the requirements of the solicitation for

PAGE 21 OF 57 1305M323QNFFK0011

purposes of the relevancy review. Additionally, quoters should provide a brief description of work performed and results achieved; description of the methodology, tools, and processes utilized.

In addition to the information requested above, quoters shall complete Blocks 1 through 4 on Page 1 of Attachment B, Past Performance Questionnaire. The quoter is required to send Attachment B, Past Performance Questionnaire, to those Government and commercial activities provided by the quoter in their submission and e-mail the completed survey form directly to Jack Huckleby at Jack.huckleby@noaa.gov only if CPARS has NOT been completed within three years (six for construction and architect-engineer contracts) of the completion of performance for the past performance reference by the DUE DATE OF THIS SOLICITATION. If a CPAR is completed within three years (six for construction and architect-engineer contracts) then the quoter shall not send the Attachment B Past Performance Questionnaire to those Government and commercial activities. The Government reserves the right to consider past performance report forms received after the due date of the solicitation and to contact references for verification or additional information. Quoters are cautioned that the Government reserves the right to obtain information for use in the evaluation of past performance from any sources including sources outside of the Government. The Government may obtain whatever information it deems most relevant to the required effort by telephonic and/or written inquiry. This information may include CPARS reports, the Federal Awardee Performance and Integrity System (FAPIIS), or past performance information from any source.

Quoters lacking relevant past performance history, or for whom past performance information is either not available or has not been submitted to the Government, will receive a neutral rating for past performance.

In addition to the above, the Government may contact other sources to obtain information on the quoter’s past performance.

C. Volume 2: Price

The price quote shall be submitted separately from Volume 1, Technical Solution. Quoters may develop price quote using the Pricing Template (Attachment C - Pricing Schedule), but are encouraged to submit their own skill mix of position(s) as long as labor categories demonstrate full conformance to the SOW requirements. The labor category hourly rates shall not extend beyond two (2) decimal places to the right (i.e. $0.00). The vendor shall include the unit price per hour and the total amount for each corresponding labor category in Attachment C. The Pricing Schedule shall be completed in its entirety and submitted in Excel format without password protection or as read-only. All formulas, lookup tables, and links should be intact, and no links shall exist to files not included with the submission. Spreadsheets shall not contain hidden worksheets. Adobe PDF or flat files will not be considered adequate.

The vendor shall provide a completed SF1449, along with acknowledgment of any solicitation amendments, within Volume 2. If the vendor’s Attachment C submission and SF1449 contain conflicting or inconsistent information, the SF1449 pricing shall be used for evaluation. The vendor shall complete all representations and certifications included herein as well as all other fill-in clauses. This information shall be included in Volume 2.
