QUESTIONS & ANSWERS

Posted November 16, 2015

The following questions and answers are provided for informational purposes only.

Nothing contained in the below questions and answers constitutes a change to the terms and conditions of the solicitation. Any change to a term or condition will be issued through an amendment to the solicitation.

**Below questions shall numerically begin where Round 1[Questions1-108] ended**

QUESTION 109:

I am writing to request an extension to the deadline for proposal submissions in connection with the Federal Bureau of Investigation's ("FBI") RFP No. RFP-OSCU DSU1503 to obtain 9 mm Luger Pistols/Replacement Parts. The proposal due date for Solicitation No. W15QKN-15-R-0002 for the XM17 Modular Handgun System ("MHS") issued by the U.S. Army falls during the same time frame. Accordingly, requests that you extend the deadline for proposal submissions by 90 days .

..... requests this extension because the requirements in the two solicitations are different. Preparing an offer for the FBI RFP requires engineering, testing, and input from the same team that is also engaged in the MHS response. Also, the FBI RFP will require ...... to test its pistols using the specified ammunition to ensure the FBI needs and expectations are exceeded. This is a significant effort. Rather than dividing our resources on two proposals at the same time, ....... would prefer to focus our efforts on this extremely important FBI project, so the FBI gets our best.

ANSWER: DEADLINE FOR SUBMISSION OF OFFERS SHALL REMAIN

MONDAY, FEBRUARY 29, 2016.

QUESTION 110:

Can we use Austrian origin product assembled in the United States for the test articles?

ANSWER: REFER TO PAGE 58 OF SOLICITATION [ITEM #1 UNDER

CONTRACTOR'S CHECKLIST] REGARDING PISTOL SAMPLES AND

DELIVERABLES UPON AWARD. SAMPLES SUBMITTED IN RESPONSE TO

THIS SOLICIATION THAT ARE NOT MANUFACTURED IN THE UNITED

STATES ARE FOREIGN END PRODUCTS. FOREIGN OFFERS SHALL BE

EVALUATED IN ACCORDANCE WITH THE POLICIES AND PROCEDURES

OUTLINED IN FAR PART 25.1.

QUESTION 111:

The first page of the Amendment Sections 11 and 13 seem to indicate that the FBI wishes all contractors (as the contract is not awarded we are reading that as potential competitors) to sign and send in acknowledgements of the Amendments.

Can you confirm you do indeed wish this done?

ANSWER: CORRECT; REFER TO SECTION L.1 /PROVISION 52.212-

1(b)(9). AMENDMENTS ISSUED ON FEDBIZOPPS SHALL BE

ACKNOWLEDGED BY THE OFFEROR AND MAY BE INCLUDED WITHIN

VOLUME #2 ENTITLED PRICE PROPOSAL AND OTHER DOCUMENTS.

QUESTION 112:

This question comes out of the Government's answer to Q45 from the first Q&A; In C.4.2 Physical Characteristics, there is not mention of frame sizes other than max/min dimensions for OAL/Height and Barrel Length. Additionally in C.4.15.C and C.4.15.D there is discussion of accommodation of different shooters hands, and some options to accommodate that, there is no directive that the same frame cannot be used for the Class I and Class II guns if they meet the Physical Characteristics.

Nor is there any direction on the boundaries of the different frame sizes, outside of the overall size constraints in C.4.2 which a single frame can meet. Is it the government's intent on having different frames for the different class pistols, and if so, will the government be providing threshold and/or objective measurement both of the Classes, as currently as mentioned a 5.5'' height gun would fit both classes, given the measurements stated in C.4.2.b

ANSWER: IT IS THE GOVERNMENT'S INTENT TO HAVE DIFFERENT

FRAME SIZES FOR THE CLASS I & II PISTOLS. THE GOVERNMENT

DESIRES TWO UNIQUE FRAME SIZES IN PART TO ACCOMMODATE FOR

THE GREATER MAGAZINE CAPACITY BETWEEN CLASS I & II PISTOLS,

WITHOUT THE USE OF MAGAZINE EXTENSIONS OR MAGAZINE

"SURROUNDS."

QUESTION 113:

This question is a follow on to Answer for Q106 from the first Q&A. In C.4.15.D the accommodation of different sized hands is addressed by two stated options, and somewhat clarified by the government answer, however is an armorer replacement trigger acceptable to also assist in the accommodation of hand sizes. As depending upon hand make up, a short finger and large palm individual may be the same over all hand size, but have a vastly different grip and trigger reach requirement than someone with longer fingers and smaller palm. In addition to alternative grip inserts, we also have two different triggers (Standard, and Short Reach) in order to accommodate not just the 5-95% of hand sizes, but also to accommodate subsets of the population who cannot be accommodated simply by different size backstraps. Is this method also acceptable to the government?

ANSWER: NO, DIFFERENT TRIGGERS MAY NOT BE PROVIDED.

QUESTION 114:

Are non-USA manufactured pistols allowed as the samples for the proposal submission?

ANSWER: REFER TO PAGE 58 OF SOLICITATION [ITEM #1 UNDER

CONTRACTOR'S CHECKLIST] REGARDING PISTOL SAMPLES AND

DELIVERABLES UPON AWARD. SAMPLES SUBMITTED IN RESPONSE TO

THIS SOLICIATION THAT ARE NOT MANUFACTURED IN THE UNITED

STATES ARE FOREIGN END PRODUCTS. FOREIGN OFFERS SHALL BE

EVALUATED IN ACCORDANCE WITH THE POLICIES AND PROCEDURES

OUTLINED IN FAR PART 25.1.

QUESTION 115:

If the production pistols are USA-made, but the proposal sample pistols are made outside the USA, does the fact that the production pistols will be made in the USA avoid the Buy American Act penalties?

ANSWER: REFER TO PAGE 58 OF SOLICITATION [ITEM #1 UNDER

CONTRACTOR'S CHECKLIST] REGARDING PISTOL SAMPLES AND

DELIVERABLES UPON AWARD. SAMPLES SUBMITTED IN RESPONSE TO

THIS SOLICIATION THAT ARE NOT MANUFACTURED IN THE UNITED

STATES ARE FOREIGN END PRODUCTS. FOREIGN OFFERS SHALL BE

EVALUATED IN ACCORDANCE WITH THE POLICIES AND PROCEDURES

OUTLINED IN FAR PART 25.1.

QUESTION 116:

With reference to the "Made in USA" requirement please confirm that if the pistols are not made in the USA" this solution is acceptable, but is subject to a penalty in the pricing evaluation (as foreseen in the Buy American Act). Will a non-USA made pistol preclude the proposal from being evaluated further?

ANSWER: REFER TO AMENDMENT 2.

QUESTION 117:

The Government Answer to Question 51 is confusing to us, as Glock asked if their

0.4 7" difference from Glock 19 and Glock 17 barrels is acceptable below the stated 0.5'' minimum difference in barrel lengths, due to the measuring tolerance. The foot note (4) appears to reference the Government's tolerance for measuring from the breech face to the muzzle end, and not an allowable difference in length, as in theory given foot note 4, a measurement could be off 0.05 +/-,and if on the low side on the short barrel, and the high side on the longer barrel at maximum tolerance on both, the Glock (as reference only) barrels could be measured as much as 0.57 different.

Is it the government opinion that this is a measurement tolerance, or a manufacturing/ statement of work tolerance for acceptable barrel lengths?

ANSWER: THE GOVERNMENT WILL ALLOW A TOLERANCE OF+/- 0.05"

BETWEEN GOVERNMENT MEASURED BARREL LENGTHS OF AN

OFFEROR'S CLASS I & II PISTOLS.

QUESTION 118:

Does the government wish to accommodate any mini- red dot sights on the pistol, or will pistol with the ability to accept a red dot sight score higher points, and if so is there a model of red dot sight that is preferred. Or is there a possibility of a future CUN for these weapons to accommodate a Mini-Red Dot Sight.

ANSWER: NO

QUESTION 119:

Does the government envision a need for a threaded barrel on either model at a future date, for either compensator, or a signature suppression device.

ANSWER: NO

QUESTION 120:

Clarification to question 45 pg. 15

We request clarification to the FBI's response to question #45 stating the Class II frame must be larger than the class I frame. The specification listed in C.4.2.b Pistol Physical Dimensions has no minimum height listed for the Class II frame. Based on the specification this would allow one frame to be used for both Class I and Class II pistols providing sample submitted meets all specifications listed in C.4.2 Pistol Physical Dimensions.

Can the FBI please confirm that specification C.4.2.b does not have a minimum specification for height?

ANSWER: PURSUANT TO C.4.2.b, THE CLASS I MINIMUM HEIGHT IS

4.75" AND THE CLASS II FRAME HEIGHT MUST BE GREATER THAN THE

CLASS I PISTOL FROM THE SAME OFFEROR.

Can the Government please specify where in RFP-OSCU-DSU1503 does it require the Class II frame be larger or of a different size than the Class I frame?
